You can pay a private seller for a Moon land deed, but what you receive is a seller-issued certificate or registration. The sources this article relies on do not establish that such a document conveys legally recognized land ownership. Treat it as a novelty or symbolic gift, not as a real-estate investment.
What a lunar “deed” actually gives you
Lunar land is sold by private registries rather than by any government. The best-known seller is the International Lunar Lands Registry (often abbreviated ILLA). Its FAQ describes the organization as independent and unaffiliated with government or corporations, and says it registers claims on behalf of private entities and individuals.

A purchase therefore gets you documentation: typically a certificate, and sometimes a map or registration entry. The useful question is whether any authority that would enforce a property right stands behind that paperwork. The registry’s own materials do not show that any government recognizes its claims.

What the Outer Space Treaty says
The Outer Space Treaty, published by the UN Office for Outer Space Affairs, is the foundation of most arguments about lunar property. Article I provides that outer space, including the Moon and other celestial bodies, is free for exploration and use by all states, and that celestial bodies are open to access on that basis.

Article II and the private-ownership question
Article II is the provision most often cited. It states: “Outer space, including the Moon and other celestial bodies, is not subject to national appropriation by claim of sovereignty, by means of use or occupation, or by any other means.”
The clause clearly bars national appropriation. Whether it also reaches claims made by private companies or individuals is the open question, and it is where the interpretations diverge. Treaty text alone does not settle it, and no court has ruled that a private lunar deed is valid.
The 2018 Senate hearing
A 2018 hearing of the U.S. Senate Committee on Commerce, Science, and Transportation recorded both sides of this debate in named testimony. These are witness positions, not binding legal rulings.

- Laura Montgomery argued that Article II does not bar private ownership. Her words: “Article II does not prohibit commercial or private ownership of land, and I think that’s very clear.” This is her reading of the treaty, not a settled meaning of it.
- Dennis Burnett disagreed. Asked about private ownership, he said: “I don’t think the Outer Space Treaty, as it is written, would allow for the United States to even recognize domestically that.” In his view, the treaty as written would not allow U.S. recognition of such rights.
The Moon Agreement is a separate treaty
The 1979 Moon Agreement is a different instrument, and it is often confused with the Outer Space Treaty. The UN Treaty Collection records that it entered into force on 11 July 1984. Its status page, current as of 7 October 2026, lists 11 signatories and 17 parties. It also notes that Saudi Arabia’s withdrawal took effect on 5 January 2024.
That is a participation snapshot, not a measure of universal agreement. Countries that have not joined are not bound by it, and the treaty’s status can change.
Space resources are not the same as land
U.S. law addresses something narrower than land. Under the statute published by the U.S. Government Publishing Office, U.S. citizens engaged in commercial recovery of space resources may possess, own, transport, use, and sell resources they obtain in accordance with applicable law, subject to international obligations.

That provision concerns material a company extracts, such as minerals or water. It is not a grant of title to the ground beneath them. The same law acknowledges open questions about resource recovery and international obligations, so it should not be read as a settled framework for surface property.

It confirms that a launched object or piece of equipment can have an owner while the lunar surface itself is not thereby privately titled. Owning a piece of hardware on the Moon and owning the land under it are separate questions.
What the registry’s claim numbers do and do not show
The ILLA FAQ states: “As of July 2023, ILLA has registered more than 500,000 claims to properties on Luna,” covering “more than 1.25-million acres” on behalf of private entities and individuals. These are the registry’s own figures, dated July 2023, and they count registrations it has processed. They are not verified counts of legally recognized properties, and they do not show that any court or government has accepted the claims.

A large registration count is sometimes read as evidence of demand or legitimacy. It is neither. A registry can record a claim whether or not any authority will enforce it.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Real investment or cosmic hoax?
As an investment, the evidence does not support the claim. No independent market valuation, return data, or performance statistic for lunar deeds is available from the official or journalistic sources this article draws on. Resale value, liquidity, and enforceability have not been demonstrated.
“Hoax” overstates what the evidence shows. The sellers’ materials describe their documents accurately as registrations, and the legal debate is real. The accurate description is narrower: a collectible or novelty item sold on a property claim that no recognized authority has validated.
Checklist before buying any lunar deed
There are no legally equivalent lunar deeds to compare, so judge any offer by what it actually delivers. Check these five points before paying.
- What is delivered. A certificate, a map, a registry entry, or something else. A more elaborate certificate does not strengthen the legal claim.
- How the seller describes it. Does it claim legal title, or does it clearly market a novelty or symbolic item? Any claim of legal title should be backed by a named authority.
- Independent recognition. Which government or independent body, if any, recognizes the claim? A seller’s own registry does not count.
- Refund and fulfillment terms. Find out how and when the document is delivered, and what happens if it is not.
- Total price. Include shipping, fees, and any add-ons.
Novelty certificate; not established legal land title. If you buy a lunar deed as a gift, describe it that way, and do not present it as a real-estate asset.
