Brazil has moved from scattered game-support programs to a national policy framework. Law 14.852/2024 established the legal foundation, and Decree 13.138/2026 now assigns practical responsibilities for finance, training, exports, innovation, intellectual property and player protection. The shift matters because Brazil has a large audience and a growing developer base, but studios still struggle to obtain capital.
What Brazil’s new games policy changes
Law 14.852/2024 created the legal foundation
Known as Brazil’s legal framework for the electronic games industry, Law 14.852/2024 recognizes games as part of public policy and opens access to existing cultural, technology, research and innovation instruments. It gives government programs a statutory basis for treating game development as both a creative industry and a technology activity.

Decree 13.138/2026 turns the law into an operating framework
The 2026 decree sets objectives to stimulate Brazil’s electronic-games sector, strengthen the presence of Brazilian-produced or co-produced games in domestic and international markets, and train and qualify workers. It also calls for:
- Simplified customs and administrative treatment for essential development tools.
- An interministerial committee to coordinate policy.
- A national network of training and experimentation spaces.
- Joint work on export promotion, investment attraction and international business.
- Procedures covering intellectual-property matters and user protections.
These measures do not guarantee that every studio will receive funding or that every planned program is already operating. They establish who is responsible and what the policy is intended to accomplish.

Desenvolve Gamers Brasil targets the financing gap
The Ministry of Culture’s Desenvolve Gamers Brasil package proposes making public credit more accessible. The announced proposal would reduce the minimum loan supported by the Audiovisual Sector Fund (FSA) from R$500,000 to R$150,000 and change the stated rate from TR plus 2% to TR plus 0.5% per year. The Ministry identifies a 2026 FSA credit envelope of R$460 million for audiovisual industries, including games.
The loan changes are announced policy proposals, not a promise that every studio can immediately borrow on those terms. The Ministry also says it expects two initiatives in 2027, each valued at R$50 million: one for laboratories and development spaces, and another for production, launch and sales of independent Brazilian games. Those initiatives should be treated as planned until their operating rules and calls for applications are published.
How large is Brazil’s games market?
Brazil is already a major consumer market. A 2026 Ministry of Culture release citing Newzoo counted 123.3 million players and US$2.7 billion in games revenue in 2025, placing Brazil ninth worldwide by revenue. Earlier figures describe a different measurement year and should not be merged with the Newzoo estimate.

The earlier study called Brazil Latin America’s leading market. The differing player and revenue totals reflect different years and methodologies, not a single continuously measured series.
Domestic production is expanding, but money remains scarce
Brazil’s development base has grown quickly. The Ministry of Culture reported that the number of developers increased from 133 in 2014 to 1,042 in 2023. Brazilian companies released 2,624 games between 2020 and 2022, and 92% of surveyed companies said they owned their own intellectual property.
That growth has not solved access to finance. In an Abragames and ApexBrasil survey of 297 developers cited by the Ministry in 2026, 60% said they had never used public financing. A large consumer audience therefore coexists with a funding system that many studios have not been able to use, whether because of minimum loan sizes, application complexity, limited collateral or lack of awareness.

The proposed lower FSA threshold is aimed at that mismatch. Smaller studios could theoretically seek support before they have the budgets or revenue history required by larger audiovisual projects, while cheaper credit would reduce the cost of completing and marketing a game. Actual eligibility will depend on the final rules and each call for applications.

Training and infrastructure are part of the plan
University places and professional training
The Ministry of Education is to create game-related undergraduate courses at five federal universities, with 230 agreed places. The Ministry of Culture plans additional training through Escult and CTAv. These are capacity-building commitments; no official announcement establishes that all courses or places are already accepting students.
Shared experimentation spaces
The decree’s proposed national network is intended to connect laboratories and spaces where teams can learn, prototype and test games. The Ministry’s expected 2027 R$50 million laboratory and development-space initiative would provide a potential funding channel, subject to a future public notice.

Game Brasil discovery platform
Game Brasil is planned as a free public platform listing Brazilian games, their developers and the platforms on which they are available. The announced initial investment is R$1.4 million. Until an official launch notice confirms availability and coverage, it is best understood as a forthcoming discovery and visibility service rather than an operating storefront.

International sales are no longer an incidental benefit in the policy design. Decree 13.138/2026 gives government bodies roles in export promotion and attracting investment, while the Brazil Games Export Sector Project operates as a non-profit internationalization channel intended to create business opportunities abroad.

That indicates an existing export base, but it does not mean that a majority of all Brazilian studios export: the percentage applies only to respondents who answered that question. The new framework is designed to help more studios with promotion, market access, partnerships and investment.
Growth comes with player and creator safeguards
The framework is not only an industry-support package. It includes protections for children and adolescents, accessibility requirements, privacy, prevention of health-related risks, parameters for therapeutic games, supervision and intellectual-property procedures. Studios seeking public support will therefore need to consider compliance and responsible design alongside production schedules and commercial plans.
For players, the policy signals that safety, inclusion and data handling are part of the sector’s public responsibilities. For developers, it means that a clearer route to public support may also bring clearer expectations about age-appropriate design, accessibility and rights management.
What changes for Brazilian studios and investors
- Studios: monitor FSA calls and the final rules for the proposed R$150,000 minimum, because the announced figures are not automatically available financing.
- Indie teams: prepare documentation for intellectual-property ownership, budgets, milestones and launch plans; the policy emphasis covers production as well as sales and internationalization.
- Training providers: watch for federal-university, Escult and CTAv announcements tied to the 230 planned university places and other courses.
- International partners: use the Brazil Games Export Sector Project and future government promotion activity as ecosystem channels, while assessing each studio and project individually.
- Players and families: expect stronger attention to accessibility, privacy, child protection and health-risk prevention as implementation develops.
Brazil therefore has both sides of a functioning games industry: a large, established audience and a rapidly expanding production community. The 2024 law opened the legal door; the 2026 decree and related programs define how finance, skills, exports and safeguards may follow. Whether the framework closes the capital gap will depend on the final funding rules, the delivery of planned programs and studios’ ability to meet the new policy requirements.
