Android Authority reported on October 13 that the suggestion was submitted through Regulations.gov and described the cards as allegedly containing unauthorized copies of games published by ESA members.

Is ANBERNIC banned in the US?
There is no verified USTR decision in the material available for this report that formally lists ANBERNIC, blocks its products, or orders retailers to stop selling its hardware in the United States. Android Authority notes that USTR makes the ultimate decision on official inclusion in the Notorious Markets process.

Even if USTR later acts, the practical effect would depend on the action it chooses and how agencies, customs authorities, marketplaces and retailers respond. The reports do not establish whether any future measure would cover ANBERNIC hardware generally, only bundles with preloaded cards, particular sellers or specific import channels. For buyers, check the exact configuration before ordering. A hardware-only listing and a bundle advertised with a “loaded,” “preloaded” or game-filled card are materially different offers. Availability, shipping eligibility, warranty coverage and return terms can also vary by seller and country.
Emulators and ROMs are not the same thing
An emulator
An emulator is software that imitates the behavior of another system so compatible software can run. Calling an application an emulator does not, by itself, establish that the application includes copied games.

A ROM or game image
In this context, a ROM is a digital copy of game data. Nintendo’s Intellectual Property & Piracy FAQ defines unauthorized game files as ROMs and states: “The uploading and downloading of pirate copies of Nintendo games is illegal.” Nintendo also says some emulator software may circumvent security measures and that preinstalled games on retro devices can infringe its rights. Those statements describe Nintendo’s position; they are not a universal court ruling about every emulator, ROM or country.
The practical distinction is important: emulator software and game files are separate questions, and a preloaded card can raise rights issues even when the underlying handheld is general-purpose hardware. Laws and exceptions differ by jurisdiction, so readers should consult the rights holder’s guidance and local law for their own circumstances.

Does a preloaded microSD card prove that every ANBERNIC device is illegal?
No. The reporting concerns an allegation about certain bundled cards. It does not establish that every device, bundle or seller has the same contents.
What should I do with a game card I already received?
