UK software engineer Lewis Barber has filed a High Court claim against HDR Global Trading Limited, BitMEX’s owner and operator, seeking the return of bitcoin he says he lost on BitMEX derivatives between 2018 and 2022. The reported claim is valued at £20 million, described in the headline as approximately $27 million. Barber alleges that BitMEX offered derivatives to UK customers without the Financial Conduct Authority (FCA) authorisation required by UK law. The claim had been reported but not served on the company, and no court has found BitMEX liable.
What Barber’s lawsuit alleges
Barber’s statement of claim argues that BitMEX entered into crypto-derivative contracts with him despite lacking the UK authorisation he says was required. His pleaded case relies on the Financial Services and Markets Act 2000 (FSMA), which he says makes the relevant contracts void or otherwise gives customers a route to restitution.

The requested remedy is the return of the bitcoin allegedly lost in those trades, or equivalent damages. The reported value is £20 million; the headline conversion to about $27 million is an approximation, not a separate amount awarded by a court.

- BITCOIN EXCLUSIVE, PHONE VERIFICATION: Bitkey is designed from the ground up exclusively for bitcoin — a dedicated hardware wallet for secure bitcoin storage. Approve transactions with a tap using your phone and NFC. No device screen is required.
- SELF-CUSTODY, NO EXCHANGE OR CUSTODIAN REQUIRED: You hold two of the three keys in the Bitkey system – one on your phone and one on your Bitkey device. The third is stored on Bitkey’s server and cannot move your bitcoin on its own.
- NO SEED PHRASE: Set up and use Bitkey without creating or storing a seed phrase.
- 2-of-3 MULTISIG: Three keys are stored separately across your phone, Bitkey device, and Bitkey’s server. Any two keys are required to move your bitcoin.
- BUILT-IN RECOVERY: Encrypted backup and recovery tools can help you regain access if you lose your phone or Bitkey device. You can also designate a Recovery Contact.
Why authorisation is central to the case
UK financial-services rules generally require firms carrying on regulated activities in the UK to obtain permission or rely on a valid exemption. Barber’s legal theory is not simply that his trades lost money; it is that the contracts were made in circumstances prohibited by FSMA and therefore should not be enforceable in the ordinary way.
Whether that argument applies to his contracts will depend on questions such as the precise products traded, where and how the transactions were arranged, BitMEX’s activities directed at the UK, the applicable version of the law at each date, and the effect of any statutory exceptions. Those issues have not been decided in the reported proceedings.

What BitMEX products were involved?
The US Commodity Futures Trading Commission (CFTC) described BitMEX as a peer-to-peer platform offering cryptocurrency derivatives linked to bitcoin, ether and litecoin. Its 2022 consent order records that BitMEX launched its first perpetual bitcoin-US-dollar leveraged swap on 13 May 2016. The product was designed to trade in a way similar to a traditional futures contract, but it could remain open without a conventional expiry date.
A CFTC complaint filed in 2020 alleged that BitMEX accepted bitcoin deposits as margin and offered futures, options and swaps without the registrations asserted in that case. When a customer’s margin fell below the maintenance-margin level, the complaint said BitMEX took over the position, liquidated it and the customer lost the maintenance margin. Leverage can therefore make a relatively small market movement produce a much larger gain or loss in the account’s bitcoin balance.

The same complaint alleged that more than 2.5 trillion contracts were traded on BitMEX between 22 November 2014 and 9 February 2020 and that the platform had earned more than $1 billion in fees from transactions since launch. Those allegations describe the scale of the business; they do not establish Barber’s UK claim or prove that every historical contract was unlawful.
Key dates in the dispute
| Date | Event | What it shows |
|---|---|---|
| November 2014 | The CFTC complaint says BitMEX began live trading. | The platform operated before the later UK trading period in Barber’s claim. |
| 13 May 2016 | BitMEX’s first perpetual bitcoin-dollar leveraged swap was launched, according to the CFTC’s 2022 order. | It establishes the documented launch date for the product type central to BitMEX’s business. |
| 2018–2022 | Barber says his alleged losses arose from BitMEX derivative trading. | These are the trading years covered by his restitution demand. |
| 3 January 2019 | The claim cites a BitMEX advertisement in The Times. | Barber uses the advertisement to support his allegation that UK customers were not excluded from promotion. |
| 3 March 2020 | The claim cites an FCA warning about possible unauthorised regulated activity. | The warning is part of Barber’s argument about BitMEX’s UK status; it is not a court judgment. |
| 23 September 2026 | The Guardian reported that BitMEX voluntarily closed after a strategic review. | The reported closure predates the High Court news but does not decide the claim. |
| 13 October 2026 | The Guardian reported the £20 million High Court claim. | The report said the claim had not yet been served on HDR Global Trading Limited. |
Has BitMEX been served or found liable?
Not according to the available report. A BitMEX spokesperson said: “No such claim has been served on HDR Global Trading Limited.” Filing a claim is the start of a civil case, not a finding that the allegations are true. The defendant must be served and given the opportunity to respond before the court considers pleadings, evidence and any application to strike out or defend the case.

Barber’s solicitor, Gareth Keillor of Seladore Legal, said the proceedings may have wider relevance to other UK-based people who entered similar contracts. He also stressed that whether an individual has a claim depends on that person’s particular facts and trading history.

That qualification matters. A potential claimant would need to establish matters such as:
- the person’s residence, location and connection to the UK when each trade was made;
- the exact BitMEX instruments used, including perpetual swaps, futures, options or another product;
- the dates, account records, deposits, liquidations and withdrawals;
- how the contracts were marketed or made available to that customer;
- the bitcoin amount allegedly lost and how any claimed damages should be calculated; and
- any limitation, contractual, jurisdictional or statutory issue affecting recovery.
A warning from the FCA does not automatically refund losses, and Barber’s filing does not create an automatic right for every former customer. Anyone considering a claim should obtain advice from a solicitor experienced in UK financial-services litigation and preserve original account statements, trade exports, emails, advertisements and wallet records.
What the case could decide
The High Court may eventually have to determine whether BitMEX carried on regulated activity in the UK, whether the contracts fell within the relevant FSMA provisions, and what remedy follows if Barber proves his case. Possible outcomes include restitution of identifiable bitcoin, a money award equivalent to proven losses, dismissal of the claim, or a settlement. The reported material does not establish which outcome is likely.

The case should therefore be read as an allegation about historic leveraged-derivative trading and UK authorisation, not as a ruling that all BitMEX perpetual swaps were illegal in Britain or that all UK customers can recover losses.
