Bitcoin Insurance vs. Self-Custody: Which Risks Does Each One Cover?

Short answer: bitcoin insurance and self-custody solve different problems. A custodian’s commercial crime policy may reimburse the insured business for specifically defined fraud, hacking, security-breach or theft losses, subject to limits, exclusions and claims procedures. It does not automatically give every customer a right to repayment. Self-custody removes a third party from control of the private keys, but makes you responsible for protecting those keys and recovering access. Neither arrangement guarantees recovery, and neither is FDIC deposit insurance.

The only reliable way to know what is covered is to examine the custody agreement, the policy wording and the law governing the arrangement. The word “insured” on a website is not a substitute for those documents.

What “bitcoin insurance” usually means

“Bitcoin insurance” is not one standardized product. In practice, the phrase often describes a commercial crime, specie, cyber or similar policy purchased by an exchange, trust, broker or other custodian. The policy protects the named insured against the events and amounts specified in its contract. Customers may benefit indirectly if the business recovers a covered loss, but that is different from having an individual insurance policy or a direct claim against an insurer.

A 2026 annual report filed with the U.S. Securities and Exchange Commission describes limited commercial crime coverage connected with a named custodian’s operations. The disclosure identifies categories including fraud, security breaches, hacks and asset theft, while warning that the coverage may be insufficient for all bitcoin losses. That is a company-specific risk disclosure, not a description of every custodian’s program.

#1 Best Overall
Bitkey Bitcoin Hardware Wallet, No Screen - Self-Custody, No Seed Phrase
  • BITCOIN EXCLUSIVE, PHONE VERIFICATION: Bitkey is designed from the ground up exclusively for bitcoin — a dedicated hardware wallet for secure bitcoin storage. Approve transactions with a tap using your phone and NFC. No device screen is required.
  • SELF-CUSTODY, NO EXCHANGE OR CUSTODIAN REQUIRED: You hold two of the three keys in the Bitkey system – one on your phone and one on your Bitkey device. The third is stored on Bitkey’s server and cannot move your bitcoin on its own.
  • NO SEED PHRASE: Set up and use Bitkey without creating or storing a seed phrase.
  • 2-of-3 MULTISIG: Three keys are stored separately across your phone, Bitkey device, and Bitkey’s server. Any two keys are required to move your bitcoin.
  • BUILT-IN RECOVERY: Encrypted backup and recovery tools can help you regain access if you lose your phone or Bitkey device. You can also designate a Recovery Contact.

“Our limited insurance protection exposes us and our stockholders to the risk of loss of our bitcoin for which no person is liable.”

That sentence, from the reporting company’s annual-report risk factors, captures the central limitation: a loss can occur without a responsible party or an applicable policy response. Insurance is a possible source of recovery for a defined event, not a guarantee that the value of your coins will be restored.

How self-custody differs

The World Federation of Exchanges describes self-custody as the owner holding crypto-assets in a personal digital wallet and safeguarding the private keys. The keys authorize transactions; whoever controls them can generally move the bitcoin. In a self-custody arrangement, no exchange or custodian is supposed to approve a transfer for you.

That control changes the risk allocation rather than eliminating risk. You must create and protect the wallet, keep backups available, verify addresses before signing transactions, plan for illness or death, and respond if a key or recovery phrase is exposed. A lost or destroyed recovery phrase can make funds inaccessible. A phrase copied by an attacker can let the attacker transfer funds, and confirmed bitcoin transfers are ordinarily difficult or impossible to reverse.

A hardware wallet can be one way to keep signing keys isolated from an internet-connected computer. It is a custody tool, not an insurance policy. A metal backup plate can help protect a recovery phrase from fire or water, but that is a practical inference about durability, not a guarantee and not an evaluation of any particular product.

Side-by-side: who bears each risk?

Question Third-party custody with possible insurance Self-custody
Who controls the private keys? The provider safeguards the keys or controls the access process. Your ability to transact depends on its systems and agreement. You control the keys and authorize transactions directly.
What may respond to theft or hacking? A policy may respond to specifically defined fraud, security-breach, hack or theft events affecting the insured party. The cited 2026 filing warns its protection may be insufficient. There is no automatic insurance response. Recovery depends on preventing compromise, retaining a valid backup and any legal remedy available against a wrongdoer.
Who can make an insurance claim? Usually the policyholder. The cited filing does not establish a universal direct claim right for each customer. There is normally no custody insurer to claim against.
Lost key or seed phrase A custodian may have account-recovery procedures, but those procedures and their limits are contract-specific. Insurance coverage for a customer’s lost credentials is not established by the cited disclosure. You are responsible for the phrase and recovery design. Losing the necessary secrets can permanently block access.
Mistaken or unauthorized transfer Whether a transfer is covered depends on the policy’s definitions, security procedures, exclusions and investigation requirements. Do not assume every customer error is insured. You bear the risk of signing or approving an incorrect transaction. Bitcoin transfers generally cannot be canceled after confirmation.
Market-price decline Crime coverage does not establish protection against a fall in bitcoin’s market price. You bear market risk directly.
Custodian insolvency An insurance policy may not resolve ownership, segregation or insolvency questions. Coverage, if any, depends on the policy and applicable law. There is no custodian insolvency risk for coins held solely in your wallet, but your own incapacity, death or loss of backups can create access problems.
FDIC or SIPC protection Bitcoin held by a crypto business is not automatically an FDIC-insured deposit. A trust disclosure cited in the source material says that trust’s bitcoin is not insured and its non-depository custodian is not an FDIC or SIPC member for the trust’s assets. A personal wallet is not an FDIC-insured deposit.

What a custodial policy might cover—and what it does not establish

Defined criminal or cyber events

The cited SEC filing identifies fraud, security breaches, hacks and asset theft as examples of losses addressed by a commercial crime policy. Those words are not self-defining. “Hack,” for example, could be limited to an intrusion that meets the policy’s security conditions. “Theft” may require proof of a covered actor, a covered location or particular controls. The exact definitions, sublimits and exclusions control the outcome.

No blanket promise for every loss

The filing expressly says the coverage may be insufficient. It does not establish coverage for every cyber incident, an employee’s unauthorized act, an accidental transfer, a social-engineering scam, a lost seed phrase, an operational mistake, a blockchain fault, a customer’s negligence or an insolvency shortfall. Those events may be treated differently—or excluded—under a particular policy.

Insurance does not cover bitcoin’s price movement

A crime policy is designed around a covered loss event, not investment performance. If bitcoin falls from one price to another, that decline is not shown by the cited material to be an insured loss. A policy that pays after theft also may measure the claim under a specified valuation method and date rather than replacing an unlimited amount of future appreciation.

Five policy questions to answer before leaving coins with a custodian

  1. What exactly is the covered event? Request the policy definitions for theft, fraud, hacking, security breach, employee dishonesty, social engineering and digital-asset loss. Ask whether the definition requires a particular control failure or forensic finding.
  2. Who is the insured? Determine whether the insured is the operating company, a parent, a trust, a segregated custody entity or another party. A policy covering the company does not automatically make each customer an insured.
  3. Can customers claim directly? Ask for the mechanism by which a customer would be paid: a direct policy right, a contractual promise from the custodian, a trust claim or a distribution after the company submits its claim. Do not infer a direct right from the word “insured.”
  4. What are the limits? Obtain the per-event limit, aggregate limit, deductibles, sublimits, coinsurance terms and any customer-level cap. The cited filing refers to limited aggregate protection but supplies no universal dollar amount.
  5. What is excluded and where is the dispute resolved? Review exclusions for lost credentials, customer instructions, sanctions, insolvency, internal accounting errors, blockchain events, war or regulatory action. Confirm governing law, notice deadlines, proof requirements and the jurisdiction for a dispute.

Ask for the current wording, not only a marketing summary. Policies can renew, change carriers or change limits, and a program described in one filing does not prove that the same terms apply to another provider or to a later date.

Custody, insolvency and geography

Even a valid insurance policy does not answer who owns the coins if a custodian fails. You need to know whether customer bitcoin is held in segregated addresses or accounts, how records identify each customer’s interest, whether the provider can rehypothecate or lend it, and what the customer agreement says about title.

FINMA guidance dated January 12, 2026 warns that holding crypto-assets abroad can create complex legal issues, particularly if the custodian becomes insolvent. The relevant questions include the custodian’s legal entity, the location of the assets and records, the law governing the account, recognition of your property rights and the procedure you would have to use in a foreign insolvency.

Geography also affects the regulator and courts you can contact. A provider operating in your country may still place assets, keys or contractual relationships in another jurisdiction. Treat the custody location and governing-law clause as core risk information, not fine print.

Why FDIC insurance does not make bitcoin “insured”

FDIC deposit insurance generally applies to eligible deposits at FDIC-insured banks. It does not automatically attach to bitcoin held by an exchange, a non-depository custodian or an individual wallet. The FDIC has warned the public about confusion between crypto-company products and deposit insurance.

A trust registration document cited in the source material states that the trust does not insure its bitcoin and that its non-depository bitcoin custodian is not an FDIC or SIPC member for the trust’s assets. That statement is specific to the trust and should not be silently generalized to every crypto product. It does, however, illustrate why a familiar insurance acronym is not evidence that a bitcoin balance has deposit protection.

A July 14, 2025 joint statement by the FDIC, Federal Reserve and Office of the Comptroller of the Currency addressed bank risk management for crypto-asset safekeeping. The agencies wrote: “The statement does not create any new supervisory expectations.” The statement is banking guidance, not a promise that customer bitcoin is insured.

The self-custody risk model

Key compromise

If someone obtains your seed phrase or private key, they may be able to transfer the bitcoin. Phishing, malware, fake support agents, unsafe backups and photographing a recovery phrase are common ways secrets can escape. A device that displays a balance is not necessarily the device that controls the funds; the secret phrase is the critical asset.

Loss and recovery failure

Self-custody requires at least one reliable recovery path. Store backups so that one incident—fire, flood, theft or device failure—does not destroy every copy, while avoiding locations where an attacker can find them together. Decide who, if anyone, should be able to recover the funds if you are incapacitated. Test the recovery process with a small amount before committing a larger balance.

Transaction mistakes

Check the destination address and amount on the wallet’s trusted display, send a small test transaction when appropriate, and keep a written record of what you are authorizing. A hardware wallet can reduce exposure of signing keys to a general-purpose computer, but it cannot correct an address you approve or recover coins sent to the wrong destination.

Human and estate risks

A self-custody plan can fail when the owner dies, loses capacity or forgets how the backup is organized. An estate plan should explain where instructions are stored without exposing the secret to everyone who handles the paperwork. Professional advice may be appropriate for tax, inheritance and jurisdiction-specific issues.

Self-custody checklist

  • Buy or obtain wallet software or hardware from a trustworthy channel and verify its authenticity before use.
  • Generate the recovery phrase in an environment you control; never accept a phrase supplied by another person.
  • Write the phrase accurately and keep backups protected from unauthorized access and physical damage.
  • Never type the phrase into a website, chat, cloud document or support form.
  • Use a strong device passcode and enable wallet security features that you understand.
  • Verify addresses and transaction details on the wallet’s trusted screen before signing.
  • Keep a small test balance while practicing backup and recovery.
  • Document an access and inheritance plan, including what happens if a primary device is lost.

Which arrangement fits which priority?

Your priority What the choice changes Trade-off to accept
Convenient account recovery A custodian may offer login recovery, internal controls and support processes. You rely on its solvency, security, identity checks and willingness to act under the agreement.
Direct control of transactions Self-custody lets you authorize transfers without a custodian’s approval. You must prevent key theft and retain a workable recovery plan.
Potential recovery after a covered crime A custodian’s policy may provide a recovery source for defined events. Coverage may be limited, the customer may lack a direct claim, and exclusions or aggregate limits may apply.
Minimizing third-party failure Self-custody removes dependence on a custodian’s balance sheet and insolvency process. Your own operational, inheritance and key-management failures become decisive.
Regulatory familiarity A regulated or established provider may disclose controls and governing entities. Regulatory status does not turn bitcoin into an FDIC-insured deposit or guarantee a particular claim outcome.

Many owners use a split approach: a limited operational balance with a custodian and a separately secured long-term balance in self-custody. That can diversify failure modes, but it also creates two sets of procedures to maintain. It is not automatically safer; the allocation should reflect your ability to manage keys, the provider’s documented protections and the amount you can afford to lose.

How to evaluate an “insured” claim on a website

  1. Identify the legal entity. Record the exact company, trust or affiliate that holds the assets and the entity named in the policy.
  2. Locate the contract. Read the custody agreement, insurance summary and any risk disclosure together. Marketing language alone is not enough.
  3. Map the loss path. Write down what happens after an incident: who investigates, who files the claim, what evidence is required, when customers are notified and how any payment is allocated.
  4. Check exclusions and limits. Pay particular attention to aggregate limits shared by all customers, deductibles, valuation rules and events that are not covered.
  5. Check insolvency terms. Confirm segregation, title, rehypothecation rights, governing law, asset location and the process for asserting a claim.
  6. Verify the date. Coverage and regulatory status can change. Use current documents and note whether a statement is a proposal, a disclosure or a binding rule.

What the October 6, 2026 proposal does—and does not—do

A Federal Register document published October 6, 2026 discusses self-custody disclosure and recourse in the adviser and regulated-fund setting. It is a proposed rulemaking, not a final rule that sets a universal protection for individual bitcoin holders. It should not be read as proof that retail self-custody has a new government backstop or that every custodian must provide a particular insurance benefit.

Answers to common questions

Is my bitcoin insured if an exchange gets hacked?

Only if the applicable arrangement responds to that event and the claim satisfies its definitions, limits and exclusions. A company’s policy may protect the company without giving each customer a direct claim. Ask for the actual terms and the customer-remedy process.

Does FDIC insurance cover bitcoin?

Bitcoin held by a crypto company or in a personal wallet is not automatically an FDIC-insured deposit. The cited trust disclosure specifically says its bitcoin and non-depository custodian are not covered by FDIC or SIPC insurance for the trust’s assets.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What happens if I lose my seed phrase?

In self-custody, losing the necessary recovery information can make the bitcoin inaccessible. A backup strategy and a tested recovery procedure are part of the owner’s responsibility; a hardware wallet or backup plate is not insurance.

Is self-custody safer than using a custodian?

There is no categorical answer. Self-custody reduces reliance on a custodian but increases the consequences of your own key, backup and transaction errors. Custody with insurance may provide a recovery source for defined events but leaves you exposed to policy limits, claim procedures, provider failure and insolvency questions.

Bottom line

Choose based on the risk you can manage, not on the label “insured.” Custodial insurance can address narrowly defined losses suffered by the insured party, subject to contract terms and limits. Self-custody gives you direct control but makes key protection and recovery your job. Before committing funds, establish who controls the keys, what event is covered, who can claim, how much protection exists, what is excluded and what happens if the provider fails. Treat FDIC protection, a hardware wallet and a policy badge as separate questions—not interchangeable guarantees.
