Bitcoin is legal to use in the United States, but it is not US legal tender, is not issued or guaranteed by the government, and can carry significant financial and security risks. The network lets people send bitcoin without a central bank; federal agencies treat it as a commodity for specified regulatory purposes, while the IRS treats it as property for federal income tax purposes.
What Bitcoin is and how the network works
Bitcoin is a peer-to-peer payment network and a form of digital money. It runs under open-source rules rather than being operated by a central authority or bank. Network participants collectively validate transactions and apply the protocol’s rules. Bitcoin.org describes it as “a consensus network that enables a new payment system and a completely digital money.”

Confirmed transfers are recorded on a shared public ledger called the blockchain. Cryptography helps protect the ledger’s integrity and the ordering of transactions. The ledger is public, but a wallet address is not, by itself, a person’s name; that does not make activity on the network automatically anonymous.
What a wallet actually does
A wallet is software or a device interface used to create and manage addresses and authorize transfers. It does not hold bitcoin in the way a physical wallet holds cash: the bitcoin is recorded on the network, and control of the relevant private keys enables someone to spend it. Bitcoin.org recommends using a new address for each transaction to help protect privacy.
#1 Best Overall
- BITCOIN EXCLUSIVE, PHONE VERIFICATION: Bitkey is designed from the ground up exclusively for bitcoin — a dedicated hardware wallet for secure bitcoin storage. Approve transactions with a tap using your phone and NFC. No device screen is required.
- SELF-CUSTODY, NO EXCHANGE OR CUSTODIAN REQUIRED: You hold two of the three keys in the Bitkey system – one on your phone and one on your Bitkey device. The third is stored on Bitkey’s server and cannot move your bitcoin on its own.
- NO SEED PHRASE: Set up and use Bitkey without creating or storing a seed phrase.
- 2-of-3 MULTISIG: Three keys are stored separately across your phone, Bitkey device, and Bitkey’s server. Any two keys are required to move your bitcoin.
- BUILT-IN RECOVERY: Encrypted backup and recovery tools can help you regain access if you lose your phone or Bitkey device. You can also designate a Recovery Contact.
What happens when you send bitcoin
- The sender uses a wallet to create a transaction directing bitcoin to a recipient address.
- The transaction is shared with the network, where participants check that the sender is authorized to spend those funds.
- Once confirmed, the transfer is recorded on the public blockchain ledger.
Bitcoin transactions are generally irreversible. Check the recipient address and transaction details carefully before confirming a payment.
Is Bitcoin legal in the United States?
At the federal level, Bitcoin is not legal tender, but that is different from saying it is illegal to own or use. The Commodity Futures Trading Commission (CFTC) says Bitcoin and other virtual currencies have been determined to be commodities under the Commodity Exchange Act. The CFTC also says virtual currencies do not have legal-tender status.

In an explainer dated April 22, 2026, the Securities and Exchange Commission (SEC) lists Bitcoin as an example of a digital commodity in its discussion of crypto systems and federal securities laws. That classification does not amount to blanket approval of every Bitcoin-related product or transaction, and it does not mean every crypto activity is regulated in the same way. This is a federal overview, not a determination of every state or local rule that may apply to a particular service or transaction.

On July 29, 2025, the SEC announced that it had approved orders permitting authorized participants to create and redeem Bitcoin and Ether exchange-traded product (ETP) shares in kind. This was a market-structure development, not a guarantee or endorsement for investors. An ETP share is a financial product; owning one does not give the shareholder direct control of private keys on the Bitcoin network.

How federal taxes apply to Bitcoin
The IRS treats Bitcoin and other qualifying digital assets as property for federal income tax purposes, so general property tax principles apply. The IRS uses “digital asset” for Bitcoin and other crypto assets recorded on a cryptographically secured distributed ledger, among other qualifying assets.
The IRS divides its FAQs by transaction date: its virtual-currency FAQ generally covers transactions completed before January 1, 2025, while its digital-asset FAQ covers transactions on or after that date. Under IRS guidance, selling digital assets for US dollars or similar currency can require recognition of a capital gain or loss, subject to applicable rules and limits, including limits on deducting capital losses. Merely holding Bitcoin is not the same as selling it.

How people get Bitcoin in the US
Bitcoin.org describes several ways to acquire bitcoin: buying it through an exchange, receiving it as payment for goods or services, or exchanging directly with another person. Mining is another way the network’s rules allow new bitcoin to enter circulation, but the sources cited here do not establish the practical costs or likely returns of mining for an individual.

Before using a platform or wallet, the CFTC advises researching it before entering payment-card details, wiring money, or sharing sensitive personal information. Availability, terms, and legal requirements can vary by provider and location; verify them directly rather than assuming a service is available or appropriate in your state.

The main difference among common routes is who controls the keys and whether you need to use the Bitcoin network directly. No option removes Bitcoin’s market-price risk, and the available official information does not establish that one route is universally safer or cheaper.
| Route | Who controls the keys? | What it means for the user |
|---|---|---|
| Self-custody wallet | You control the private keys. | You take responsibility for safeguarding the keys and recovery information, and for authorizing transfers correctly. This route can support direct on-chain use. |
| Custodial account | The service provider controls custody. | You depend on the provider’s security, solvency, and account access. The account is not the same as personally controlling the network’s private keys. |
| Bitcoin ETP shares | The product structure governs custody; you do not directly control Bitcoin-network keys through the shares. | You hold a financial product rather than bitcoin for direct on-chain use. Product terms and risks differ from direct ownership. |
Protect access if you use self-custody
- Keep private keys and recovery information secure. Losing them can mean losing access; exposing them can let someone else spend the bitcoin.
- Never give a recovery phrase or private key to someone claiming to be support staff.
- Verify the recipient address and transaction details before sending. A mistaken or unauthorized transfer may not be reversible.
A dedicated hardware wallet is optional, not a requirement established by the sources cited here. A device cannot eliminate market risk, user error, or the need to protect recovery information.

What risks should you understand?
Bitcoin’s protocol can operate as designed while users still face losses from price movements, custody problems, mistakes, or third parties. The CFTC says bitcoin’s value is driven by market supply and demand and can be more volatile than traditional fiat currencies. The risks include:
- Price and investment risk: Bitcoin’s value can change sharply, and an investment can lose money over a short or long period. No return is guaranteed.
- Custody and access risk: A custodian can face security, solvency, or account-access problems. With self-custody, lost recovery information or a bad transfer can cause loss of access or funds.
- Operational and security risk: Software or hardware failures, unauthorized access, user mistakes, and fraud can lead to losses.
- Product risk: An ETP has a different structure from direct bitcoin ownership. Its share price and terms do not give the holder direct control of network keys.
- Leverage risk: The CFTC warns that margin can amplify both gains and losses in Bitcoin futures; futures are not the same as simply holding bitcoin.
How common is cryptocurrency use in the US?
In the Federal Reserve’s household survey about activity in 2025, published in 2026, 9% of respondents reported buying cryptocurrency or holding it as an investment in the past year. Two percent reported using cryptocurrency to buy something or make a payment, and 1% reported using it to send money to friends or family. The survey asked about cryptocurrency such as Bitcoin or Ethereum, so these figures are not Bitcoin-only ownership or transaction rates.
