Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesStart with Nintendo’s current digital stores, then use Nintendo’s official Classics applications, and finally consider genuine used media with compatible original hardware. Those are the clearest legal routes for a game that has disappeared from retail shelves. Preserve the cartridge or disc, manuals, labels, console, and collection records. Do not download or share a ROM from an unauthorized site: Nintendo states that uploading and downloading pirate copies is illegal, and owning a physical copy is not a universal license to obtain a file from an unrelated source.
Choose the route that fits the game
“Out of print” describes physical availability, not necessarily legal availability. A title may be missing from stores yet still be sold through the Nintendo eShop, included in a licensed compilation, or available in a Nintendo Classics application. Conversely, a game absent from Nintendo’s catalog does not become lawful to download merely because a website offers its ROM.

| Route | Rights basis | What you depend on | Preservation control | Main limitation |
|---|---|---|---|---|
| Nintendo eShop or Nintendo website | Official digital sale | Your account, compatible hardware, and store availability | Lower: access depends on the platform and account | The exact title may not be sold in your region |
| Nintendo Classics application | Official, licensed catalog access through the relevant Nintendo service | Active service access, region, subscription eligibility, and catalog licensing | Lower than owning media; titles can change | It is a selected catalog, not every legacy game |
| Genuine used cartridge or disc | Lawful purchase of authentic physical media | Working, compatible original hardware and the condition of the media | High: you retain the artifact and its documentation | Prices, repairs, batteries, accessories, and region compatibility |
| Licensed reissue or compilation | Publisher-authorized release | The edition’s hardware or service support | Depends on whether it is physical or account-based | Not every title receives a reissue |
| ROM from an unverified site | Unclear or unauthorized | The site, file integrity, and potentially circumvention tools | Poor legal footing | Nintendo identifies unauthorized uploading and downloading as piracy |
Compare every option on four questions: Is the exact game available, is the rights basis clear, what will it cost to maintain, and how much control will you have over the preserved copy and context?

Search the eShop for your region
Nintendo says authentic games can be purchased for download through the Nintendo eShop or Nintendo’s website. Search the store serving your account’s country, using the exact title and any regional subtitle. A game that is unavailable in a local physical shop may still have a digital listing. Check the product page for supported hardware, language, age rating, edition differences, and whether the purchase is a complete game or downloadable add-on.

- Dock that supports 4K when connected to a compatible TV*

Store listings are region-specific. A title sold in one country may be absent in another because publishing, ratings, music, or other rights differ. Do not assume that changing an account region creates a lawful entitlement to a different market’s purchase; review Nintendo’s account and payment rules before doing so.
Use the official Classics applications when the title is included
Nintendo’s current support instructions say Nintendo Switch and Nintendo Switch 2 users can access official Classics applications for NES, Super NES, Game Boy, Nintendo 64, SEGA Genesis, Game Boy Advance, and Virtual Boy. Nintendo GameCube is included on Switch 2. These applications provide a legal way to play only the games Nintendo has placed in the catalog for your region and service tier.
The catalog is curated. Nintendo’s Switch FAQ describes the service as paid and says it includes selected classic games, compatible online play, and save-data backup for most games. “Selected” matters: a console generation’s presence does not mean every title from that generation is available. Licensing, ratings, regional rights, technical work, and business decisions determine the list.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Before paying for a subscription or buying a console, open the current Classics catalog and search for the exact game. Confirm the required application, hardware generation, region, controller or accessory support, and whether online features are still functional. Nintendo’s UK FAQ says there are no current plans to bring classic games together under the old Virtual Console banner, so treat Classics as a changing service rather than a promise that every absent title will eventually return.
What this route is good for
- Quick access without finding and maintaining aging hardware.
- Official emulation and presentation supplied by Nintendo.
- Convenient save features and, for supported games, compatible online play.
- Lower initial cost than buying a scarce cartridge or disc.
The trade-off is control. A catalog entry is tied to Nintendo’s service, account rules, regional availability, and licensing decisions. Keep any physical copy and documentation you own even if the digital version is convenient.
Buy authentic used media when digital options are absent
Verify that the cartridge or disc is genuine
A legitimate used sale is the most direct consumer route when a title is not currently offered digitally. Buy from a seller who allows inspection and returns, and compare the item with reliable photographs of the correct release. Check the label, shell, board or disc markings where visible, print quality, screws, contacts, serial information, and included manuals. Counterfeit cartridges can fail early, contain altered software, or damage a console.
Record the game’s region and edition before purchase. Some systems enforce regional differences; others accept the media but display a different language or rating. A special controller, sensor, adapter, memory accessory, or peripheral may be required. Games that once used online servers can lose features when those servers shut down, even though the physical game still boots.
Inspect condition and aging components
- Cartridge contacts: oxidation or grime can cause intermittent reads. Clean only with methods appropriate to the hardware; avoid abrasive materials and liquids that can damage the board.
- Save battery: older cartridges may use a coin cell. A depleted battery can erase or prevent saves. Replacing it may require soldering and can create a brief power interruption, so use a qualified repair service when you are not equipped for the job.
- Optical discs: inspect for deep scratches, cracks near the center hole, and disc rot. A resurfaced disc may work, but resurfacing cannot repair every failure.
- Console hardware: check power supplies, video cables, controllers, card slots, disc drives, and cooling. An inexpensive game can become costly if the compatible console needs major repair.
Keep the complete physical record
Preservation is stronger when the media remains with its context. Retain the box, manual, inserts, labels, warranty cards, maps, and region markings. Photograph the front, back, spine, cartridge or disc, and serial information. Record the platform, release region, language, edition, purchase date, seller, condition, known accessories, and any repairs. These records help identify a future replacement and document what you actually own without creating or distributing an unauthorized game image.

Understand the difference between an emulator and a ROM
An emulator is software; a ROM is a game image
An emulator imitates a console’s hardware or operating environment. A ROM, cartridge dump, disc image, or similar file is a copy of game data. They are separate legal questions. An emulator may be lawful software in one jurisdiction, while a particular game image may be unauthorized. Conversely, having an authorized game image does not automatically permit bypassing a console’s encryption or security controls.
| Question | Why it matters |
|---|---|
| Who wrote and distributed the emulator? | Software distribution and licensing differ from the rights in a game’s code, music, artwork, and trademarks. |
| Where did the game image come from? | A file from an unofficial site may be an unauthorized reproduction, regardless of whether you own a cartridge. |
| Was encryption or access control bypassed? | Anti-circumvention rules can apply separately from ordinary copyright analysis. |
| What is the purpose and jurisdiction? | Exceptions and enforcement differ by country, and a personal-use argument is not a universal defense. |
Why “I own the cartridge” is not a blanket answer
Nintendo’s Intellectual Property & Piracy FAQ states: “The uploading and downloading of pirate copies of Nintendo games is illegal.” Ownership of one physical copy generally shows that you bought an authentic artifact; it does not grant a universal right to download a copy from an unrelated ROM site, share a dump with others, or bypass every technical measure. The Library of Congress likewise cautions: “Just because we’ve put a work online doesn’t mean that you can freely reuse it.”
Because the legality of personal copying, format shifting, and circumvention varies, avoid treating forum advice as a license. If you need an emulator for accessibility, research, or preservation, use software with clear licensing and obtain game data through a route your local law expressly permits. When the answer is uncertain, consult an attorney or a library, archive, or museum with copyright expertise rather than relying on a claim that ownership makes every copy lawful.
Preserve a personal collection without distributing ROMs
Stabilize the physical media
- Handle cartridges and discs by their edges and keep them in protective cases.
- Store media, manuals, and boxes in a clean, dry, stable environment away from direct sunlight, heat, moisture, and rapid temperature changes.
- Keep labels attached and avoid writing on original packaging. Place collection identifiers on removable sleeves or an inventory record instead.
- Separate damaged, leaking, or mold-affected items from the rest of the collection until they can be assessed.
- Inspect batteries, disc surfaces, connectors, and cases periodically instead of waiting for a failure.
Document the game and its dependencies
Create one record per title. Include the exact name, platform, publisher, region, language, edition, media type, serial or catalog number, purchase source, date acquired, condition, accessories, save-battery status, required hardware, and known online requirements. Photograph the item and scan manuals or box art only to the extent permitted by your local law and the purpose of your archive; do not post copyrighted scans or game files publicly.
Record the console model, firmware or operating environment when relevant, controller adapters, memory devices, display cables, and any unusual setup needed to launch the game. A future owner can then distinguish “disc is unreadable” from “required peripheral is missing” and can recreate the original context without guessing.
Maintain compatible hardware safely
Keep at least one compatible, working console when feasible, along with tested cables, controllers, power supplies, and region-appropriate accessories. Store spare hardware separately from media and inspect old power supplies for brittle insulation or swelling components. Do not energize equipment that shows electrical damage. Professional servicing is preferable to improvised repairs that could destroy an irreplaceable board or create a safety hazard.
Use documentation when full technical recreation is impossible
The Library of Congress Recommended Formats Statement treats a console game as more than a file. A proprietary platform, a virtual or emulated platform, DRM or encryption, and documentation can all be part of the preservation package. When a preservation copy or a significant online dependency cannot be recreated, video of the software in use can document behavior, menus, graphics, and a play session. Keep such recordings with the catalog record and clearly identify the hardware, software version, date, and limitations.

What libraries, archives, and museums may do in the United States
The narrow preservation exception
U.S. regulation 37 C.F.R. § 201.40 provides a limited route for eligible libraries, archives, and museums. When the copyright owner or an authorized representative has stopped providing an authentication server required for gameplay, the institution may copy and modify a lawfully acquired game to restore playability. The activity must have no direct or indirect commercial advantage, and the game cannot be distributed or made available outside the institution’s physical premises.
This is an institutional exception, not a consumer license to publish ROMs or place a download online. Eligibility, server status, acquisition records, access controls, and the physical-premises restriction all matter. Institutions should document why the server is no longer provided, what copy was lawfully acquired, what modifications were made, who can access it, and how the copy is secured.
Preserve the platform and the online context
The Library of Congress guidance supports preserving the game together with the platform representation, DRM or encryption context, and descriptive documentation. If a game depends on a discontinued account service, matchmaking server, or authentication check, an institution should record that dependency even when it cannot legally or technically reproduce the service. A video demonstration, interface photographs, manuals, technical notes, and oral history can preserve evidence of how the game worked without making an unauthorized public copy available.
Match common problems to a lawful next step
The title is not in the eShop
Search the exact regional store, check whether a licensed compilation or Classics application includes it, and verify that you are looking at the correct platform edition. If no official listing exists, move to genuine used media or a rights-cleared reissue. Do not treat a ROM site as the next equivalent storefront.
The title is missing from the Classics catalog
Confirm the catalog for your region and the application supported by your hardware. If the game is not listed, the subscription does not grant access to it. Keep monitoring official announcements if you want a future release, but do not assume that the old Virtual Console model will return; Nintendo’s UK FAQ says there are no current plans to consolidate classics under that banner.
A used cartridge or disc does not work
First isolate the fault: test the media in known-compatible hardware, test the console with another authentic game, inspect contacts or disc damage, and verify region and accessory requirements. If the save battery is depleted, decide whether preserving existing saves is important before replacement. Seek a specialist repair when the board, drive, or power supply is at risk.
An old game requires a server that has shut down
For personal play, look for an official offline mode, licensed reissue, or a current release that removes the dependency. For institutional preservation in the United States, assess the specific conditions in 37 C.F.R. § 201.40. For everyone else, document the dependency, retain the original media, and avoid distributing a modified copy.
A practical buying and preservation checklist
- Search the current regional Nintendo eShop and Nintendo website.
- Search the current Classics catalog for the exact title and platform.
- Confirm region, language, edition, hardware, controller, accessory, and server requirements.
- If buying used, verify authenticity, condition, return rights, and save-battery status.
- Keep manuals, labels, boxes, and accessories with the media.
- Catalog photographs, serial information, purchase details, and technical dependencies.
- Store media in stable, clean, dry conditions and inspect aging components.
- Use only clearly licensed software and rights-cleared releases for digital play.
- Do not download, upload, or share ROMs from unauthorized sources.
- For institutional work, consult the applicable law and document access restrictions.
The legally strongest consumer choice is the option with the clearest chain of authorization: an official Nintendo sale, an included Classics title, or an authentic used copy played on compatible hardware. Preservation then means protecting the artifact and its context, not assuming that every technical copy or download is permitted.
