Best Legal Alternatives to Restricted GPUs for AI Inference: Hardware and Cloud Options

There is no accelerator that is automatically a legal substitute for a restricted GPU. Export-control eligibility depends on the specific item, destination, buyer and its parent company, end user, end use, and any required license or exception. For inference evaluation, the concrete options covered here are AMD Instinct MI300X hardware, Google Cloud TPU, and AWS Trainium compute. Treat each as a candidate to assess—not as a way around export controls.

What “legal alternative” means in practice

A chip’s marketing, a different supplier, or a cloud deployment does not by itself determine whether a transaction is permitted. The analysis depends on facts about the item and the full transaction, and the applicable rules can change. A physical accelerator purchase and access to hosted compute may raise different procurement and deployment questions; neither should be assumed permissible without checking the actual arrangement.

The U.S. Bureau of Industry and Security (BIS) said its May 2026 guidance clarifies licensing for advanced-computing items exported to entities headquartered in Country Group D:5 or Macau, as well as entities whose ultimate parent is headquartered there—even when the entity itself is located elsewhere. That is a reason to check the current guidance and underlying Export Administration Regulations (EAR), not a complete determination for every product or transaction.

For a specific procurement or deployment, establish the item’s classification, destination, consignee, end user and ultimate parent, end use, and the applicable license or exception. Seek qualified export-control advice when the facts or rules are unclear.

Hardware and hosted compute to evaluate

The sources below establish that these products or services exist and describe their providers’ own claims. They do not establish that a particular buyer is eligible to obtain or use them, or that one will outperform another for your workload.

Option What the provider source establishes What to evaluate for inference Important limit
AMD Instinct MI300X AMD describes MI300X as an AI and HPC accelerator. Supported frameworks and operators; model fit; usable memory; measured throughput and latency; scaling; system and total cost. AMD’s product description is not an independent workload benchmark or a transaction-specific eligibility determination.
Google Cloud TPU Google Cloud documents a hosted TPU accelerator service. Framework and model compatibility; region and access; serving latency; scaling; service pricing; data controls. Availability and service terms vary. Confirm the actual customer and use are permitted.
AWS Trainium AWS documents Trainium accelerators for machine-learning workloads. Framework and model support; instance and region availability; software migration; latency; scaling; total cost. Availability and service terms vary. Check export-control and account obligations for the actual deployment.

NVIDIA H100 can serve as a comparison point, but it is not presented here as an alternative to itself. NVIDIA’s live product page advertises “up to 30X” inference performance for a stated Megatron chatbot comparison involving a 530-billion-parameter model; NVIDIA labels projected performance subject to change. That is a vendor claim tied to its scenario, not an independent comparison with MI300X, TPU, or Trainium, and it says nothing by itself about whether a transaction is allowed in a given destination.

What recent BIS statements do—and do not—say

May 2026: check headquarters and ultimate parent

BIS’s May 2026 guidance highlights licensing requirements for advanced-computing items in transactions involving entities headquartered in Country Group D:5 or Macau, including entities whose ultimate parent is headquartered there even if the operating entity is elsewhere. A buyer’s local address alone may therefore not settle the question. Read the current BIS guidance and applicable EAR provisions against the actual parties, item, destination, and end use.

January 13, 2026: conditional case-by-case review

BIS said applications to export NVIDIA H200, AMD MI325X, and similar chips to China would receive case-by-case review if stated conditions were met. The conditions included demonstrating no reduction in production capacity currently available to U.S. customers, compliance procedures and customer screening by the Chinese purchaser, and independent third-party testing in the United States. Case-by-case review is not general authorization, a guarantee that a license will be granted, or a declaration that those chips are legal for every China-bound transaction.

Compare candidates on your inference workload

Peak specifications and provider claims do not substitute for a workload-matched evaluation. No independent apples-to-apples benchmark across MI300X, Google Cloud TPU, and AWS Trainium is established here. Compare candidates using the same model, serving conditions, and service requirements.

  1. Confirm model and software fit. Check support for the intended model, framework, operators, precision, quantization, and serving stack. Estimate migration work and identify the observability tools available to diagnose serving problems.
  2. Check usable memory and model configuration. Assess usable accelerator memory and memory bandwidth against the model, weights, KV cache, context length, and concurrency you need. Record any quantization or partitioning required; do not treat nominal memory as proof that a model will fit efficiently.
  3. Measure the service targets that matter. Test prefill and decode throughput, time to first token, and tail latency at the target context length, concurrency, and batch size. Record the exact model, precision, software versions, and serving configuration so the results are interpretable.
  4. Test scale-out behavior. Measure performance as you add accelerators or instances, including interconnect effects and communication overhead. A result on one device may not predict performance at production scale.
  5. Calculate full deployment cost. Include the complete system and operating requirements for owned hardware, or the relevant hosted usage, storage, networking, and other service costs for cloud compute. Compare cost at the throughput and latency you actually need, not only at peak utilization.
  6. Verify access and transaction eligibility. For physical hardware, check local stock and the proposed shipment and parties. For hosted compute, confirm the needed service and region are available to the account and that the customer, end use, and deployment comply with applicable rules and service terms.

Keep performance and legal review as separate gates: a technically suitable accelerator is not necessarily available or eligible for a particular transaction, and a permitted option may still be a poor fit for the model or service target.

Before committing to a purchase or deployment

  • Identify the precise accelerator or hosted service and determine its relevant classification.
  • Document destination, consignee, end user, ultimate-parent headquarters, and intended end use.
  • Determine whether a license or exception applies under current rules; do not infer eligibility from another company’s transaction or product announcement.
  • For cloud compute, confirm the specific region, account access, service terms, and data-handling requirements alongside export-control obligations.
  • For performance selection, run a representative evaluation with the intended model, context length, quantization, concurrency, batch size, latency target, and serving stack.
