Start with the BBC for most disputes about BBC programme content. Under the “BBC First” model, you normally submit a detailed complaint to the BBC within 30 working days of the broadcast, or of the date a programme stopped being available on the BBC’s on-demand service. If the BBC’s response and internal escalation do not resolve an eligible standards complaint, you may be able to ask Ofcom to consider it. A fairness or privacy grievance uses Ofcom’s dedicated procedure. Defamation is different again: it is a civil claim about serious reputational harm, brought in court and potentially leading to damages or an injunction.
Choose the rule you say was broken
The correct route depends on the legal or editorial question, not simply on whether you disliked a programme. BBC editorial complaints test the BBC’s own editorial standards. Ofcom tests regulated content against the Ofcom Broadcasting Code. A defamation action asks a court whether a published statement caused, or is likely to cause, serious harm to a person’s reputation and whether a defence applies.

| Concern | First forum | Main test | Typical result |
|---|---|---|---|
| Accuracy, impartiality, harmful or offensive material, sponsorship or product placement | BBC complaints process (BBC First) | BBC editorial standards, with possible later Ofcom assessment | BBC response, editorial correction or other internal action; Ofcom investigation or regulatory action where its criteria are met |
| Unfair treatment of an individual or intrusion into privacy | BBC first, identifying the fairness or privacy issue | Ofcom’s fairness and privacy procedure and relevant Broadcasting Code rules | Finding, required action or other regulatory outcome; no automatic damages |
| Allegation that seriously harms reputation | Civil court after urgent legal advice | Defamation Act 2013 and related procedural rules | Damages and court orders, potentially including removal or stopping distribution |
Ofcom regulates BBC television, radio and relevant BBC on-demand content, but it is not a general court for every reputational dispute. The BBC Framework Agreement distinguishes the BBC’s editorial-guideline assessment from Ofcom’s assessment against Ofcom standards.
How the BBC First complaints route works
1. Submit to the BBC promptly
For an ordinary content-standards complaint, identify the programme, channel or service, transmission date and time (or on-demand availability period), and the exact words, images or segment you challenge. Explain the specific concern—such as inaccuracy, lack of due impartiality, harmful treatment, sponsorship or product placement—rather than saying only that the programme was offensive.

Ofcom’s procedure, updated 22 November 2024, says complainants should normally submit to the BBC within 30 working days of the broadcast or the date the programme ceased to be available on the BBC on-demand service. Keep a copy of what you sent and the date of submission. If you are late, explain the reason and any continuing impact; acceptance is not guaranteed.
2. Use the BBC’s internal stages
The BBC handles the initial complaint under its editorial complaints process. If the first response does not address the point, follow the escalation instructions in that response. Unresolved matters can proceed through the BBC’s later stages, including the Executive Complaints Unit where applicable. Set out what the earlier response missed and point to the relevant programme evidence; repeating a general objection without new precision is less useful.

3. Escalate to Ofcom only when the complaint is eligible
Ofcom describes this sequence as “BBC First”: “Although the BBC is now regulated by Ofcom, under the BBC Charter and Agreement approved by the UK Parliament we consider complaints about BBC content through a process called ‘BBC First’.” In practical terms, Ofcom normally expects you to give the BBC an opportunity to resolve the matter before Ofcom involvement. Submit the BBC correspondence and explain why the issue remains unresolved. Exceptional circumstances may affect that expectation, but they should be explained rather than assumed.

When to use Ofcom’s fairness and privacy procedure
Fairness and privacy complaints are handled under a distinct Ofcom procedure. Use the BBC route first, but describe clearly that the complaint concerns unfair treatment of an individual or an intrusion into privacy. That classification matters because the dedicated procedure has its own requirements and can involve representations from the person affected.
The cited procedure covers BBC UK public broadcasting and BBC UK public on-demand programme services. It does not cover BBC World Service material. Confirm that the service and programme fall within that scope before relying on the procedure. A complaint about an international service, a non-BBC publication or a private online upload may require a different regulator or legal route.

Information to include
- Your name and contact details, and whether you were directly treated in the programme or are complaining as a viewer.
- The programme title, service, transmission or on-demand date, and the precise scene, quotation or editorial decision.
- Why the treatment was unfair or how your privacy was invaded, including what relevant facts were omitted or presented misleadingly.
- Any consent, warning, safeguarding or contact history that bears on the issue.
- The BBC response and the specific point that remains unresolved.
Neither the BBC complaint process nor an Ofcom finding automatically produces an apology, correction or compensation. Any action depends on the applicable procedure, the evidence and the regulator’s decision.

What makes a dispute defamation?
Defamation is a separate civil cause of action. Section 1 of the Defamation Act 2013 states: “A statement is not defamatory unless its publication has caused or is likely to cause serious harm to the reputation of the claimant.” If the claimant is a body trading for profit, the harm must involve serious financial loss.
Best Value
A broadcast can be inaccurate or upsetting without meeting that legal threshold. A claimant generally needs to establish the words’ defamatory meaning, that they identified the claimant, publication to a third party, and serious harm (or likely serious harm), while anticipating any applicable defence. The statutory framework recognises defences including truth, honest opinion and publication on a matter of public interest. Whether a particular programme is defamatory turns on its words, context and evidence; a regulator’s standards finding does not decide those elements.
Preserve evidence before it disappears
- Save a lawful recording or transcript, the programme page and the broadcast or upload date.
- Record the exact words, images, captions and surrounding context, not just a paraphrase.
- Document how viewers could identify you or your organisation.
- Gather evidence of actual or likely reputational harm, such as lost work, cancelled opportunities, complaints or measurable financial effects.
- Keep all correspondence with the BBC, Ofcom and anyone who published or repeated the material.
Mind the limitation period
In England and Wales, the general limitation period for a defamation action is one year from accrual. The single-publication rule generally treats a substantially identical later publication as accruing on the date of first publication, although statutory exceptions and judicial discretion exist. A BBC complaint does not stop the court limitation clock. Obtain specialist legal advice promptly, particularly if the one-year date is approaching.
Scotland and Northern Ireland have distinct legal rules. Do not assume the England-and-Wales deadline, defences or procedure applies there; obtain advice in the relevant jurisdiction.
What each route can and cannot deliver
| Question | BBC complaint | Ofcom | Defamation court action |
|---|---|---|---|
| Can it award damages? | No general right to damages through the editorial complaints process. | No damages award. | Yes, if the claimant proves the action and the court awards them. |
| Can it force removal or stop distribution? | Not as a court order; the BBC may choose editorial action. | Regulatory powers are not the same as a private injunction. | After judgment, the court may order a website operator to remove a defamatory statement or another distributor to stop distributing material containing it. |
| Does it decide defamation? | No. | No; it decides possible breaches of regulated standards. | Yes, subject to pleadings, evidence and available defences. |
| What evidence starts the process? | Programme details, exact segment and the editorial concern. | BBC complaint history plus the relevant Code or fairness/privacy issue. | Precise defamatory meaning, identification, publication, serious-harm evidence and responses to defences. |
Section 13 of the Defamation Act 2013 provides that, where a court gives judgment for a claimant, it may order removal by a website operator or cessation of distribution. That is a judicial remedy and should not be inferred from a BBC response or an Ofcom decision.
A practical decision guide
If the problem is accuracy, impartiality or harmful content
- Note the programme and the exact broadcast or on-demand date.
- Quote the disputed words or identify the precise segment.
- Explain the factual error, imbalance or harm and identify supporting evidence.
- Submit to the BBC within the normal 30-working-day window.
- Escalate through the BBC’s stated stages, then consider Ofcom if the matter is eligible and remains unresolved.
If you were treated unfairly or your privacy was invaded
- Use the BBC process first and label the issue as fairness or privacy.
- Describe the treatment, consent or expectation of privacy, and the specific harm.
- Check that the material is BBC UK public broadcasting or a covered BBC UK public on-demand service, not BBC World Service material.
- After the BBC stages, use Ofcom’s dedicated fairness and privacy procedure if its requirements are met.
If the programme alleges serious wrongdoing about you
- Preserve the recording, transcript, programme link and publication date immediately.
- Write down the meaning an ordinary viewer would take, how you were identified and who received the publication.
- Collect evidence of actual or likely serious harm and investigate possible truth, honest-opinion or public-interest defences.
- Take specialist defamation advice without waiting for the BBC or Ofcom process.
- Track the one-year England-and-Wales limitation date (or the applicable date in Scotland or Northern Ireland).
Common mistakes that weaken a complaint or claim
- Going straight to Ofcom for an ordinary BBC content complaint: normally complete the BBC First stages first, unless you can explain exceptional circumstances.
- Calling every inaccuracy defamation: defamation requires serious reputational harm and is tested in court, not by a programme-standards form.
- Using a general fairness complaint for a privacy case: identify the privacy issue so the dedicated procedure can be applied.
- Missing the 30-working-day BBC window: submit promptly and explain any delay rather than assuming a late complaint will be accepted.
- Waiting for a regulator before getting legal advice: the one-year limitation period for England and Wales continues to matter independently.
- Seeking an automatic apology, correction or payout: none is guaranteed by a BBC or Ofcom complaint; court remedies require litigation and a judgment.
Bottom line for choosing a route
Use the BBC first for programme-content concerns, normally within 30 working days, and follow its escalation route before asking Ofcom to examine an eligible standards issue. Use the dedicated fairness/privacy path when an individual’s treatment or private information is the focus, remembering that the cited scope excludes the BBC World Service. Treat a serious reputational allegation as a potential defamation claim: preserve evidence, obtain specialist advice and protect the applicable one-year court deadline in England and Wales. Choose the forum according to the rule you need tested and the remedy you need, because a complaint outcome and a court judgment are not interchangeable.
