Autonomous weapon systems raise a civilian-protection problem because, after activation, they can select and engage targets without a person making that decision at the moment force is used. The International Committee of the Red Cross (ICRC) warns that this can make it harder to anticipate effects and apply humanitarian protections. International humanitarian law already applies to these systems, but the ICRC is urging states to agree on additional, specific rules. That is a serious global risk—not a quantified prediction of harm in every conflict, or proof that every autonomous weapon is unlawful.
What is an autonomous weapon system?
The ICRC’s working definition
For its analysis, the ICRC defines an autonomous weapon system as one that, once activated, can select and engage targets without further human intervention. Sensors gather information about the environment; software processes it and responds to a generalized target profile. A profile might describe features such as the shape, infrared or radar signature, speed, or direction associated with a type of military vehicle.

A system does not meet this definition simply because it uses artificial intelligence, or because software helps an operator. The key question is whether the weapon itself selects and engages targets after activation. A weapon may be autonomous in that critical function without using AI or machine learning; conversely, AI may support a human decision-maker without the weapon autonomously selecting and engaging a target. Automation limited to navigation or locking onto a predefined target does not, by itself, meet the definition used in the ICRC position paper.

Why does autonomous targeting raise civilian-protection concerns?
Sensor inputs and profiles cannot replace judgment about a particular situation
A weapon responding to sensor data and a generalized profile does not make the same contextual judgment as a person assessing a target at the moment of attack. What a sensor detects may not capture everything that matters in a changing environment. Operators may also have limited ability to understand or predict how a system will behave under particular conditions, especially when its operating parameters are broad or its functioning is difficult to explain.
The concern is not that every autonomous system will strike a civilian. It is that uncertainty about what a system will detect and do can make it harder to reliably protect people who are not lawful targets.

That uncertainty matters under humanitarian law
The ICRC identifies challenges for applying rules that protect civilians, including distinction, proportionality, and precautions in attack. In practical terms, forces must distinguish military objectives from civilians and civilian objects, assess expected civilian harm against the anticipated military advantage, and take feasible precautions. Whether a particular system can be used consistently with those obligations depends on its design, the way it is used, and the circumstances—not on the label “autonomous” alone.
The concern is also ethical and strategic
The ICRC warns of ethical concerns when decisions about life and death are effectively delegated to sensors and software, and it identifies possible risks of conflict escalation. These are concerns about human agency and the consequences of systems whose effects may be difficult to predict; they are not evidence of a particular casualty toll.

What is already law, and what remains unsettled?
International humanitarian law already applies
The ICRC says international humanitarian law (IHL) applies to autonomous weapon systems. It points to the 2019 reaffirmation by parties to the Convention on Certain Conventional Weapons (CCW) that IHL applies to all weapons systems, including autonomous weapon systems, and to UN General Assembly resolutions in 2023 and 2024 that echoed that position.
That does not amount to a new, AWS-specific treaty
Existing IHL sets obligations for parties to armed conflict, but it does not by itself settle every question about which autonomous systems should be prohibited or how others should be restricted. The ICRC’s calls for clearer, dedicated rules are recommendations for states to negotiate; they should not be mistaken for rules already adopted in a new international instrument. Nor does the ICRC’s position mean that every autonomous weapon is inherently unlawful.

What rules does the ICRC recommend?
The ICRC proposes a two-part framework: prohibit certain systems and impose strict limits on those that are not prohibited. This is the ICRC’s recommended approach, not an agreement already adopted by states.

Why does international cooperation matter now?
Rules need agreement across borders
Autonomous weapons are a question for international rules because their development and use concern states across conflicts and regions. A shared framework can clarify which systems are unacceptable and what limits apply to others, rather than leaving those questions to inconsistent national approaches. That is the policy case for cooperation; it does not mean states have already agreed on the ICRC’s proposed framework.

The latest diplomatic opening identified by the ICRC
On 25 August 2026, UN Secretary-General António Guterres and ICRC President Mirjana Spoljaric jointly renewed their call for international rules. They warned that battlefield use of advanced technologies could amplify risks to civilians and civilian infrastructure and aggravate civilian suffering. Their appeal stated: “We are now dangerously close to crossing a moral red line: the autonomous targeting of humans by machines.”
The ICRC’s 2026 FAQ identifies the CCW Seventh Review Conference, scheduled for 16–20 November 2026, as an opportunity for states to launch negotiations on a legally binding instrument. An opportunity to launch negotiations is not the same as a decision to begin them, much less an adopted treaty.
What does the record of use establish?
In a 26 July 2022 explainer, the ICRC characterized autonomous weapons used up to that point as generally directed against clear-cut military targets—such as weapons and munitions, military radars, and enemy tanks—in areas with few civilians or civilian objects. That is a dated description from 2022, not a verified inventory of current battlefield use. It also does not establish a casualty estimate or show how every system would perform in a populated or complex environment. The ICRC’s concern about those settings is a risk argument about system behavior, operating conditions, and the difficulty of applying civilian-protection rules.
What the debate comes down to
The central question is not whether software can assist military operations. It is whether people should be able to delegate the selection and engagement of targets to a weapon that acts on sensor inputs and target profiles, and under what safeguards. The ICRC’s answer is to prohibit systems whose effects cannot be adequately understood or predicted and those designed or used against people, while strictly restricting other systems. States have not yet turned that recommendation into a new binding instrument; the November 2026 CCW conference is the opportunity the ICRC has identified for states to decide whether to start negotiating one.
