The answer depends on the task: transcription and source retrieval can assist a caseworker, while credibility scoring, origin inference, risk profiling, or eligibility recommendations can materially shape a person’s claim and introduce serious error, bias, privacy, and due-process risks. A defensible system therefore measures a defined task, keeps a trained human in control, exposes the evidence behind every output, and preserves effective appeal and judicial-review routes.
What “automated screening” means in an asylum case
“AI screening” is not one operation. A system that converts speech to text is fundamentally different from one that labels a narrative implausible or predicts a person’s risk. Treating them as a single category makes accuracy claims and legal analysis misleading.

| Function | Typical output | How it can affect a case | Why the distinction matters |
|---|---|---|---|
| Transcription | A written record of an interview | Helps a caseworker search and review what was said | It is generally preparatory when it does not add credibility scores or recommendations; omissions or mistranscription can still alter the record. |
| Translation | Text or speech in another language | May determine which facts are visible to the reviewer | Dialect, idiom, and sensitive terms can be rendered incorrectly, so the original recording or text must remain available. |
| Summarisation | A shortened account of an interview or file | Can influence which facts a caseworker notices first | An apparently neutral summary can omit a material detail or introduce a wording that changes meaning. |
| Policy search | Relevant country-policy passages and a generated synopsis | Shapes the country-of-origin information considered | Every proposition needs a traceable source and a date because conditions can change. |
| Document or identity analysis | An authenticity, match, or anomaly signal | May cause extra scrutiny or undermine a document | A signal is not proof. Poor data, unusual documents, or name-transliteration differences can create false positives. |
| Narrative plausibility or discrepancy analysis | A credibility indicator or list of inconsistencies | Can affect how questioning and evidence assessment proceed | This is evaluative assistance, not neutral administration, and can harden a mistaken first impression. |
| Origin or person-level risk inference | A predicted nationality, region, or risk category | May affect routing, questioning, eligibility reasoning, or detention-related decisions | Proxy variables such as language, accent, name, or location can produce discriminatory outcomes. |
| Case matching or triage | A suggested priority, queue, or similar case | Changes who is seen first and which cases receive attention | Routing decisions can become substantive if they delay protection or reduce scrutiny of a claim. |
European Commission guidance on the EU AI Act makes a similar functional distinction. Neutral transcription, translation, or summaries without credibility scoring or recommendations may be preparatory. Systems that assess document authenticity, narrative plausibility, credibility-relevant discrepancies, country or regional origin for eligibility reasoning, or person-level risk can materially assist the examination of an asylum application and may fall within high-risk AI categories. The applicable classification depends on the intended purpose, actual use, and jurisdiction; the guidance is not a worldwide rule.

The UK Home Office says it ran two small-scale pilots from May through December 2024 and published an evaluation page on 29 April 2025. The Asylum Case Summarisation tool used AI to summarise asylum-interview transcripts. The Asylum Policy Search tool found and summarised country-policy information. The stated evaluation covered feasibility, accuracy, and impact.

Those descriptions establish decision-support trials, not autonomous adjudication. They do not report a common-metric comparison against human caseworker decisions, a general accuracy rate for asylum outcomes, or evidence that the tools replaced caseworkers. A pilot label cannot be converted into a claim that automated decisions are more accurate than human ones.
Why there is no reliable AI-versus-human accuracy winner
Asylum decisions rarely have an observable “correct” label
In many applications there is no immediate, independently verifiable answer to whether a grant or refusal was correct. Vladislava Stoyanova’s Delmi report, published 5 March 2026, identifies this lack of reliable outcome feedback as a structural problem: developers and agencies may not have dependable test data for validating or monitoring an AI system. A later appeal or a new piece of evidence does not create a complete, consistently labelled dataset for every earlier case.
Historical data can encode past mistakes
Even where past decisions are available, they reflect the practices, information, and biases of the institutions that made them. A model trained to reproduce historical outcomes may reproduce unequal treatment rather than discover the truth of a claim. Stoyanova also warns that historical patterns may not predict future risks in applicants’ countries of origin.

Country conditions change
Conflict, government policy, social conditions, and available evidence can change faster than a dataset or a policy index. A system that was useful for one period can become stale without a documented update process and renewed testing.
“Accuracy” is task-specific
For a transcript tool, useful measures include omissions, additions, mistranslations, and speaker attribution. For policy search, the relevant questions are whether the retrieved passages are authoritative, current, and relevant. For a credibility indicator, the stakes and error modes are different again. A single percentage would conceal these differences and could suggest a level of certainty the evidence does not support.
Principal risks of automated asylum screening
Errors and omissions in the record
A summary can leave out a qualifying detail, merge two events, or turn uncertainty into a definite statement. A search synopsis can misstate a country report or cite an outdated passage. If the caseworker reads the generated text instead of the original material, the error can become the working record and influence every later step.

Bias and unequal treatment
The European Parliament Research Service briefing Artificial intelligence in asylum procedures in the EU, dated 7 July 2025, identifies inaccuracy, bias, discrimination, weakened fairness and due process, and privacy and data-protection interference as central concerns. Dialect recognition, name transliteration, speech transcription, and case matching were among the early-stage examples described in EU Member States. Performance can vary by language, accent, nationality, gender, disability, literacy, or the availability of comparable training material. A tool can therefore be accurate on an aggregate test while disadvantaging a particular group.

Automation bias and weakened procedural fairness
A human signature does not guarantee meaningful human judgment. If a system’s score determines which questions are asked, which evidence is considered relevant, or whether a file is escalated, the reviewer may defer to it because it appears objective or efficient. The Council of Europe Parliamentary Assembly’s Resolution 2628 recommends mandatory human review and judicial review of AI-generated evidence precisely because nominal oversight may otherwise be superficial.
Privacy and data-security harms
Asylum files can contain interview transcripts, biometric information, family details, medical facts, and information about a person’s country of origin. The Parliamentary Assembly calls for end-to-end encryption and says sensitive information must not be shared with a country of origin where persecution risk exists. Access controls, retention limits, supplier permissions, audit logs, and breach procedures must cover the entire data flow, including any hosted service used to process files.

Stale or misleading risk signals
Country-risk patterns and language cues can change. A model may treat a formerly common route, name format, or dialect as evidence of something it no longer indicates. Without drift monitoring and current source material, a risk flag can outlive the conditions that produced it.
Discretion can move upstream
Stoyanova argues that choices about data, labels, thresholds, and system design can shift discretion away from the individual decision-maker toward the agencies, vendors, and officials who configure the system. Governance must therefore examine procurement, data selection, model updates, and institutional incentives, not only the conduct of the caseworker who sees the output.
What current European policy says
| Instrument | What it addresses | Status and practical meaning |
|---|---|---|
| European Commission AI Act Service Desk guidance on migration, asylum and border control | Distinguishes neutral preparatory support from systems that evaluate credibility, authenticity, origin, or person-level risk; identifies certain asylum-assistance uses as high risk. | Official EU guidance. The legal result depends on the use, intended purpose, implementation, and jurisdiction; it is not a universal rule for every country. |
| Council of Europe Parliamentary Assembly Resolution 2628 | Calls for rights, democracy, and rule-of-law impact assessments; lifecycle oversight; independent evaluation; mandatory human review; privacy and security; human verification of AI-generated evidence; and judicial review. | A Parliamentary Assembly recommendation, not automatically a directly applicable statute in every state. |
| European Parliament Research Service briefing, 7 July 2025 | Describes early-stage EU examples such as dialect recognition, transliteration, transcription, and case matching, and catalogues risks of inaccuracy, bias, discrimination, privacy harm, and due-process erosion. | Analytical briefing, useful for identifying deployment patterns and risks rather than establishing a universal performance result. |
| UK Home Office evaluation page, 29 April 2025 | Reports the scope of the two May–December 2024 pilots and their evaluation of feasibility, accuracy, and impact. | A description of pilot work; it does not establish autonomous decisions or a general benchmark against human caseworkers. |
Resolution 2628 states: “Oversight must be embedded throughout the life cycle of AI systems with independent evaluations and mandatory human review.” It also says: “At the arrival stage, AI can be used to support individualised, fair and rights-compliant asylum procedures, while never replacing the role of human caseworkers in interactions and decision making.” These are recommendations of the Parliamentary Assembly and should not be presented as identical to EU AI Act obligations or UK law.

A safeguards checklist for agencies deploying a tool
The following controls combine the distinctions and safeguards in the European Commission guidance, Resolution 2628, and the published policy analysis. They are an implementation checklist, not a claim that every item is a statutory duty in every jurisdiction.
- Define the permitted task. Write down exactly what the system may do, what it may not do, the data it may receive, and the decisions it must never make. A transcription tool should not silently become a credibility scorer after a software update.
- Complete a rights-impact assessment before rollout. Examine effects on non-discrimination, privacy, dignity, access to asylum, fair hearing, and effective remedy. Include people with relevant lived experience and independent legal or human-rights expertise.
- Test meaningful groups and languages. Evaluate error and disparity by language, dialect, nationality, gender, and other relevant groups where lawful and meaningful. Document small-sample limitations instead of hiding them in an aggregate average.
- Keep source material accessible. A reviewer must be able to open the original recording, transcript, document, and policy passage behind every generated statement. Outputs without traceable provenance should not be treated as evidence.
- Require an empowered, trained reviewer. The reviewer needs time, subject-matter training, access to the underlying material, authority to reject the output, and protection from performance targets that reward automatic acceptance.
- Explain material use to the affected person. Where AI materially contributes to processing, provide an understandable notice of its role, the type of output used, the human decision-maker, and the way to challenge an error, subject to lawful security limits.
- Secure sensitive data end to end. Encrypt data in transit and at rest, restrict access by role, log use, control supplier retention and onward transfers, and prevent disclosure to a country of origin where that could expose a person to persecution.
- Record errors and near misses. Maintain an incident register covering omissions, mistranslations, false matches, inappropriate flags, privacy events, and cases in which a reviewer overrode the system. Use it to correct the workflow, not to blame applicants.
- Audit independently and repeatedly. Evaluate accuracy, disparate impact, traceability, security, and reviewer behavior before deployment and throughout the system’s life cycle. Re-test after model, data, policy, or country-condition changes.
- Preserve appeal and judicial review. A person must be able to obtain reasons, contest material errors, submit contrary evidence, and have an independent body review the decision. An automated output must never close that route.
How to measure a workflow without inventing a headline accuracy number
| Evaluation axis | Questions to answer | Evidence a reviewer should retain |
|---|---|---|
| Task fidelity | How often does the output omit, add, mistranslate, or misattribute material information? | Original audio or document, the generated output, corrections, and a reason for each correction. |
| Retrieval and source quality | Are policy passages authoritative, current, relevant, and correctly represented? | Source title, publication date, quoted passage, retrieval date, and the generated explanation. |
| Group disparity | Do error rates or escalation patterns differ by language, dialect, nationality, gender, or other relevant characteristics? | Disaggregated results with privacy protections and an explanation of sample limitations. |
| Human control | Can reviewers understand, correct, and reject an output in the time available? | Override records, reasons, training records, workload data, and interviews with reviewers. |
| Traceability | Can each material assertion be linked to source evidence and the version of the system that produced it? | Versioned logs, source links or identifiers, timestamps, and change history. |
| Outcome feedback | What reliable information exists about whether a decision was correct, and how is uncertainty handled when it does not? | Appeal outcomes, later evidence, expert review, and an explicit statement of what cannot be validated. |
| Drift and currency | Do language patterns, policy sources, or country conditions differ from the data used for development? | Update schedule, freshness checks, trigger thresholds, and suspension decisions. |
| Security and privacy | Who can access files, where are they processed, how long are they retained, and what happens after a breach? | Access logs, encryption configuration, supplier terms, deletion records, and incident reports. |
| Remedy | Can an applicant discover and challenge a material AI error before it affects the outcome? | Notices, correction requests, response times, appeal records, and judicial-review outcomes. |
This approach evaluates the combined human-machine workflow. It avoids treating a model’s internal test score as a substitute for evidence about the fairness and correctness of real asylum decisions.
A human-led operating model
- Intake and consent-sensitive capture: Record the interview accurately, preserve the original, and identify language or accessibility needs before any automated processing.
- Assisted preparation: Let the system produce a draft transcript, translation, summary, or policy-search result only within its approved purpose. Mark it as machine-generated and keep the source beside it.
- Independent verification: A trained caseworker checks material facts, names, dates, locations, quotations, uncertainty, and translation choices against the source. The caseworker documents corrections.
- Evidence assessment: The decision-maker considers the complete file, including information that the tool did not highlight. A score or flag can prompt a question but cannot establish credibility, nationality, or risk by itself.
- Reasoned decision: The written reasons identify the evidence relied upon and explain any disagreement with the applicant. They should not simply repeat an unexplained system label.
- Notice and challenge: Tell the person how automation contributed, provide understandable reasons, and offer a practical way to correct the record or appeal.
- Post-decision learning: Feed verified corrections, appeal findings, and security incidents into independent monitoring. Suspend or restrict the tool when a material failure pattern appears.
Uses that should not be delegated to an algorithm
Resolution 2628 calls for prohibition of automated credibility assessments, emotion recognition, and nationality- or ethnicity-based risk profiling. Those recommendations reflect the heightened danger of inferring a person’s truthfulness, identity, or protection needs from proxies such as facial expression, accent, name, or perceived demeanor. Even where a jurisdiction has not adopted that exact prohibition, an agency should treat such functions as incompatible with meaningful human examination unless a clear legal basis, rights assessment, and independently validated necessity exist.

A person-level risk score should not silently determine whether someone receives an interview, which questions are asked, or whether evidence is discounted. If a routing tool is used, the agency must check that triage does not delay vulnerable applicants or reduce the quality of examination for a particular group.
Questions applicants and representatives can ask
- Was an automated system used to transcribe, translate, summarise, search policy, match a case, or assess credibility or risk?
- Which part of the decision did the output influence, and who reviewed it?
- Can the original recording, document, and policy source be checked against the generated statement?
- How can a mistranslation, omission, false match, or outdated country report be corrected?
- What reasons were given for the decision apart from the automated output?
- What appeal, complaint, or judicial-review route remains available, and are deadlines affected by a request for correction?
These questions do not assume that automation was unlawful or inaccurate. They identify whether the person received a genuine examination and a usable remedy when something went wrong.
When automation can help—and when it increases risk
| Potential use | Conditions for a defensible benefit | Warning sign |
|---|---|---|
| Finding passages in a large policy library | Current authoritative sources, visible citations, date checks, and human confirmation. | The synopsis is accepted without opening the underlying country material. |
| Drafting a transcript or summary | Original audio and text remain available; material facts are checked by a trained reviewer. | The summary becomes the only record or the reviewer is not given time to verify it. |
| Administrative case matching | Clear non-substantive purpose, tested name and transliteration handling, and safeguards against queue discrimination. | A match or priority score changes eligibility reasoning or access to an interview. |
| Credibility, authenticity, origin, or risk assessment | At minimum, a specific legal basis, rights assessment, strong independent evaluation, explainability, and a human decision that does not defer to the score. | The system’s label is treated as evidence of truth, nationality, or danger without source-level verification. |
What to do when an automated output conflicts with the evidence
- Pause the affected decision or step if the conflict could prejudice the claim.
- Preserve the original file, the machine output, system version, prompts or settings, and the reviewer’s notes.
- Check the disputed passage with a qualified human interpreter, subject-matter specialist, or independent source as appropriate.
- Correct the case record and notify the applicant or representative of the material correction.
- Assess whether other cases processed with the same version or data may contain the same error.
- Report the incident through the agency’s oversight and data-protection channels, and restrict or suspend the tool if the failure is systemic.
- Keep the appeal or judicial-review route open; correcting a file should not remove the right to challenge the final decision.
The practical standard
The defensible question is not whether a machine or a person is inherently more accurate. It is whether a specified workflow improves a limited administrative task without hiding evidence, amplifying unequal treatment, exposing sensitive data, or weakening the applicant’s opportunity to be heard. Current published material supports cautious assistance for functions such as transcript preparation and policy retrieval when they are verified. It does not support a general claim that automated screening outperforms human asylum caseworkers in deciding protection claims. Meaningful human judgment, independent evaluation, secure handling, transparent reasons, and an effective remedy are the conditions that determine whether any particular deployment is acceptable.
