Australia’s minimum-age regime began on 10 December 2025, not in August 2026. It requires covered platforms to take reasonable steps to stop people under 16 who ordinarily live in Australia from creating or keeping accounts. Children and parents are not the main legal targets, and the rule is not a ban on the internet.
Early removals show that platforms are acting, but repeat attempts, privacy risks, mistaken blocks and movement to other services make the policy an unfinished test. Other governments are pursuing age limits, yet most are choosing different designs and are at different legislative stages.
What Australia’s rule actually does
The legislation was passed and assented to in December 2024; its operational obligation started on 10 December 2025. eSafety continues monitoring and investigating compliance during 2026. The statutory text is available at legislation.gov.au.
- It applies to under-16s ordinarily resident in Australia, including people who held accounts before commencement.
- Platforms, rather than children, carry the principal duty: they must take “reasonable steps” to prevent accounts being created or retained.
- There is no general ban on internet access, and children are not made criminally liable simply for trying to use a service.
- Parents are not automatically fined because a child attempts to use a covered platform.
eSafety describes the regime and its current operation at its parent guidance and industry guidance. The maximum civil penalty for a platform that fails to take reasonable steps can be A$54.6 million; that is a statutory maximum, not an automatic fine for every breach.

Which services are covered?
eSafety currently identifies or treats services including Facebook, Instagram, Snapchat, Threads, TikTok, Twitch, X, YouTube, Kick and Reddit as age-restricted social-media platforms. The list can change as services alter their functions or eSafety makes new determinations.
Coverage depends on the service’s functions and regulatory definitions. Messaging, education, gaming, commerce and other user-generated services are not automatically covered. The regulator’s FAQ and the government’s age-assurance fact sheet explain exclusions and borderline cases.
How platforms check age
Australia does not prescribe one universal identity-check procedure. Under eSafety’s risk-based guidance, a platform can combine:

- Age declarations;
- Account, device, location and account-history signals;
- Behavioural indicators;
- Facial-age estimation or other age-assurance technology;
- Human review and escalation; and
- Detection of repeated attempts to defeat a check.
Government-issued identity documents or an Australian Government-accredited digital-ID service cannot be the sole mandatory route for proving age. That can reduce dependence on identity databases, but indirect methods may be less accurate and can introduce biometric, bias and surveillance concerns. Platforms and age-assurance providers must still comply with the Privacy Act and applicable principles, as the Office of the Australian Information Commissioner explains.
What implementation has shown
eSafety said platforms removed access to approximately 4.7 million under-16 accounts by mid-December 2025. The figure is an implementation measure, not proof that 4.7 million unique children were identified or that wellbeing improved.
In its March 2026 update, eSafety reported repeated attempts to obtain an apparent 16-plus result, inaccessible reporting pathways and indications that some platforms had not done enough to stop under-16 users retaining accounts. Those findings are documented in the compliance update.

Where the system can fail
- False positives: a genuine 16- or 17-year-old may be blocked or asked for an intrusive check.
- False negatives: an under-16 user may pass a check or keep an old account.
- Repeat attempts: users may retry until a system produces an apparently adult result.
- Weak remedies: families may struggle to report suspected underage accounts or obtain meaningful review.
Removal can mean losing contacts, messages, drafts and content. It can also drive people toward shared or falsely aged accounts, VPNs, encrypted channels or smaller services outside the definition. A genuine age-review message may itself be difficult to distinguish from phishing.
Is the model effective?
The early record supports a mixed judgment. The law created a clear platform duty and forced major services to deploy age-assurance systems. But account removals do not establish lower cyberbullying, self-harm exposure, harmful content, poor sleep or other wellbeing outcomes. Those outcomes require separate, longer-term evidence. It is also unresolved whether harm is reduced or displaced to excluded and less-regulated services.
Who is following Australia?
The status below is as of 18 August 2026. “Following” can mean an operating law, an enacted law awaiting commencement, a bill, or only a political commitment.

The UK has announced a restriction but it is not yet an operating law. Its plan also considers limits on livestreaming, strangers contacting children, and certain addictive features. It proposes an overnight default from midnight to 6 a.m. for 16- and 17-year-olds, while messaging services such as WhatsApp and Signal are currently described as outside the social-media ban.
A UK consultation found that 90% of responding parents supported a minimum age of at least 16. That was a consultation sample, not a representative referendum; the government reported substantially weaker support among children. Details are in the consultation outcome and parent-support release.

Why governments are attracted to minimum ages
- A bright-line rule is easier to explain than dozens of separate design standards.
- Responsibility sits with well-resourced platforms rather than individual families.
- It responds to parental concern about recommendation systems, harmful content and social pressure.
- A delay may give children more time to develop coping and digital-literacy skills.
- It can reduce incentives for platforms to compete for younger users’ attention.
Why the model is contested
- Age assurance can collect sensitive data and produce inaccurate or discriminatory results.
- Young people may lose peer support, identity-building communities, political information or crisis resources.
- LGBTQ+ teenagers and children in unsafe homes may depend on online communities that are difficult to replace offline.
- False ages, shared accounts, VPNs and service substitution can defeat a bright-line rule.
- Regulating addictive design, stranger contact or livestreaming may address specific harms more precisely than excluding an entire age group.
- Courts may scrutinize restrictions affecting expression, association and access to information.
Will other countries copy Australia?
Yes, several are moving toward age restrictions, but not through one global template. Australia’s approach is attractive because it offers a simple message and places the duty on platforms. The UK is adapting it with feature restrictions; Canada proposes an exemption for services that can demonstrate safeguards; other countries are considering parental linkage, curfews, design duties or bans on particular functions.
Whether Australia’s model scales will depend on precise definitions, privacy limits, independent appeals, consistent enforcement and evidence of reduced harm—not merely the number of accounts removed. The decisive test is whether children become safer without simply being pushed into less visible and less accountable online spaces.
