The Office of the Australian Information Commissioner (OAIC) says the company did not respond to preliminary questions about how the glasses record information, who can access it and where it is stored. The investigation is ongoing; the OAIC has not announced a finding that the company or any retailer breached the law.
What the OAIC is investigating
On 7 October 2026, the OAIC announced a formal investigation into Shenzhen Qingcheng and its handling of personal information under the Privacy Act 1988. The regulator says it began preliminary inquiries on 12 August, contacting manufacturers and distributors—including Shenzhen Qingcheng—and asking how the glasses work and record information, who has access to it, and where it is stored. The OAIC says Shenzhen Qingcheng did not respond. Commissioner Carly Kind said this left the regulator without assurance that Australians’ personal data was being protected as required by the Act. The OAIC has also written to retailers of devices using HeyCyan to express its concerns. Kind urged responsible retailers to consider whether it is appropriate to continue making the devices available. That is an appeal to retailers, not an announced ban or a finding against a retailer. The regulator says it will wait for the investigation to conclude before commenting further.

Which glasses and app are involved
The OAIC says HeyCyan is needed to access the full functionality of many lower-cost smart glasses made in China and sold under different brands. It identifies Anko glasses sold by Kmart and products sold through Big W Marketplace, Amazon and other retailers. Users connect a phone to the app for features such as music, calls and the app’s voice assistant; information gathered by the glasses is collected through the app for processing.

The investigation is about the HeyCyan app’s maker, not a blanket assessment of every smart-glasses brand or every product sold by those retailers. For a particular pair, check the model’s documentation and app requirements to establish whether it uses HeyCyan. The OAIC’s announcement does not establish that other glasses are safe or unsafe.
What is known—and what remains an allegation about security
Separately from the regulator’s inquiry, ABC News reported on 22 September 2026 that independent testing by NSB Cyber and Abstract Shield found more than a dozen flaws across the glasses, app and website. ABC reported that testers could connect to glasses over Bluetooth without a password, and that email addresses, dates of birth, images and videos could be exposed. Those are findings as reported by ABC about the named testing firms’ work. They are not findings by the OAIC, and the regulator has not concluded that the reported vulnerabilities establish unlawful handling of personal information. Keep the two issues distinct: the OAIC is examining privacy safeguards and the company’s practices, while the technical findings described above come from independent testing reported by ABC.
Why the regulator is concerned about wearables
In an August 2026 blog, Privacy Commissioner Carly Kind discussed risks associated with surveillance wearables, including concealed or covert collection of images, sound and other personal information. The OAIC highlighted questions of consent, location data, what counts as personal information, and heightened risks to vulnerable people. There is also a separate policy debate. On 31 August 2026, the Attorney-General’s portfolio released a consultation paper and draft legislation proposing changes to modernise privacy laws, with emerging technology such as AI and wearable devices among the risks discussed. These proposals are not the basis for the current HeyCyan investigation and should not be treated as enacted law. See the consultation paper and draft legislation.

The OAIC says the Commissioner may investigate an act or practice that may interfere with privacy or breach Australian Privacy Principle 1 under section 40(2) of the Privacy Act 1988. If an investigation supports a finding of interference with privacy, the Commissioner may make a determination requiring steps to stop or prevent the conduct from continuing or recurring, and to redress loss or damage. For serious or repeated interferences, the Commissioner may seek civil penalties in the Federal Court. These are powers available under the law, not predictions about the outcome of this investigation.

As of 7 October 2026, the OAIC had announced no findings, compulsory notices, final enforcement outcome or retailer stock decision. The regulator says it will comment further after the investigation concludes.
