What the Board’s AI order covers
The Georgia State Board of Workers’ Compensation issued its “Directive of the Board regarding use of Artificial Intelligence and Certification of Citations in Filings” on August 26, 2026, effective immediately, according to Hall Booth Smith attorney Brandon H. Wilson’s September 17, 2026 account. It applies to briefs, motions, and other written submissions filed with the Board. Wilson’s article links to the four-page standing order PDF.
The article describes covered AI use as relying on generative AI to draft, summarize, edit, verify, or analyze legal or factual content in a filing. It says ordinary spell-check and grammar functions embedded in word processors are excluded. The key question is whether generative AI contributed to the substance of the filing, rather than whether a routine proofreading feature was switched on.
Which certification to include
The account says attorneys and people representing themselves must include the applicable certification. Choose the statement that matches how the document was prepared; the AI-assisted statement also commits the filer to review and citation checks.

The certification is not satisfied by checking only the passages AI drafted. It calls for independent review of the entire document and personal verification of every legal and record citation.

Use the no-AI certification only when it accurately describes the document’s preparation.
How to check AI-assisted citations
A citation that looks plausible in an AI-generated summary is not verified merely because it is formatted correctly. The filing certification requires the filer to check that each cited case, statute, rule, or record reference exists as cited and reasonably supports the proposition attached to it.

- Open the underlying authority or record material, rather than relying on an AI summary.
- Confirm the citation’s details and that the quoted or paraphrased point appears in the source.
- Check that the authority is relevant and applicable to the legal point being made.
- Review the filing as a whole for factual accuracy, applicable law, and the legal theories it asserts.
These duties remain with the person certifying the filing; the use of an AI tool does not transfer responsibility for accuracy to the tool.

AI-generated or AI-modified evidence has a separate disclosure rule
The article says evidence created or modified using AI must be disclosed when submitted. It gives reconstruction videos and AI-supported expert-analysis tools as examples of evidence whose AI involvement should be acknowledged. By contrast, deepfake videos, fabricated receipts, or manipulated photographs presented without disclosure as if they were untouched evidence are described as prohibited.
This is distinct from the certification about how a written filing was prepared. A filing may need the AI-assisted certification because AI helped draft or analyze its content; evidence submitted with it may independently require disclosure because AI created or changed that evidence.
Potential consequences and what has not been established
Wilson reports that the order provides for civil penalties of $100 to $1,000 per violation and says unacknowledged AI-generated evidence may also prompt referral to the Board’s Criminal Investigation Division. He reports that mistake, lack of expertise, or time constraints are not accepted as good-faith excuses. These are consequences described by the article, not evidence that a penalty or referral has already occurred.

The September 17, 2026 article does not identify an adjudicated sanction or give a count of violations under the order. It therefore does not establish how the Board has applied the penalty range in a particular case.
