Arkansas permits sports wagering through its regulated casino framework, including account wagers initiated while the bettor is physically in the state and made under applicable rules. But “social sportsbook” is not a legal category defined by those rules. A product’s social, peer-to-peer, sweepstakes, or free-to-play label does not by itself establish that it is authorized in Arkansas.
How sports betting works under Arkansas rules
Arkansas rules govern sports wagering through licensed books and casino wagering accounts. The Arkansas Department of Finance and Administration says casino licensees may accept sports wagers unless prohibited by federal law, and that casino gaming is authorized at four locations. The location count describes casinos, not the number of sportsbook apps or operators. Arkansas Department of Finance and Administration

Under 23 CAR § 358-2021, a book may accept a sports wager in person. The rule also permits an account wager under the account-wagering provisions when the patron initiates the transmission while physically present in Arkansas. The patron must be registered, and the book must obtain an acknowledgment of the location restriction.

This is a physical-location rule, not a residency rule: being an Arkansas resident does not, by itself, allow a patron to place a regulated account wager while physically outside Arkansas.

Does “social sportsbook” mean a product is legal?
No. The cited rules define terms such as “sports pool,” “book,” and wagering communication, but do not define “social sportsbook” as a separate legal category. A sports pool is a business that accepts wagers on sporting events other than horse or other animal races; wagering communication can include transmission through computers or mobile applications. Those definitions do not resolve the status of every peer-to-peer app, cash challenge, private pool, or other social product. 23 CAR § 358-2001
Instead of relying on an app’s label, consider what it actually does and whether it has documented authorization in Arkansas:
Rank #2
- Is it operated as a book by a casino licensee?
- Does it accept or facilitate a stake or wager on a sporting event?
- If it is account wagering, is the wager initiated while the patron is physically in Arkansas and under the applicable account rules?
- Does the user meet the applicable age and identity requirements?
- Is there evidence that this exact product is authorized for Arkansas?
The rules reviewed establish the regulated casino and account-wagering framework; they do not settle every private or peer-to-peer arrangement. Without product-specific confirmation, it is not possible to infer legality from “social,” “free-to-play,” or similar branding alone.
Who can register for a regulated wagering account?
23 CAR § 358-425 sets the account requirements. Only people aged 21 or older may register. The rule also requires identity verification and account-registration and security controls. It defines a licensee as a person holding a valid casino license and describes wagering accounts as ledgers maintained by a licensee for authorized gaming, including sports pools. Sports-wagering account use also requires a proposal and written administrative approval by the commission.

What happened to Arkansas HB1861?
HB1861 proposed an Interactive Gaming Act and would have made operation of an illegal online casino or sports betting a felony. Its title and proposed text are not current law: the Arkansas State Legislature’s official record says the bill was withdrawn by its author and recommended for interim study on April 7, 2025. Do not treat the proposal as enacted authority. Arkansas State Legislature, HB1861

- Identify the operator and product structure. Determine whether it is a licensed casino book, an account-wagering service, or a separate pool or peer-to-peer product.
- Check the wager and location conditions. For regulated account wagering, the rule requires the patron to initiate the wager while physically in Arkansas.
- Confirm account eligibility. Regulated wagering accounts require the user to be at least 21 and undergo identity verification.
- Look for Arkansas-specific authorization. Do not treat an app’s marketing label or a bill proposal as proof. The cited rules do not determine the status of every independent social product.
The Arkansas rules database notes that it is updated weekly and may not reflect recent rulemaking. For a time-sensitive or product-specific decision, check current rule text and information from the Arkansas Racing Commission before relying on an app’s availability or legal status.
