The Arizona Court of Appeals has vacated Gabriel Paul Horcasitas’s 10.5-year manslaughter sentence and ordered resentencing after finding that an AI-generated video of the victim was unreliable and unduly prejudicial in this case. The court affirmed Horcasitas’s manslaughter conviction; it did not overturn the jury’s finding of guilt or ban AI from court proceedings.
What the Arizona court decided
In State v. Horcasitas, No. 1 CA-CR 25-0191, filed September 30, 2026, the Arizona Court of Appeals, Division One, affirmed the manslaughter conviction but vacated the manslaughter sentence and remanded for resentencing. Presiding Judge D. Steven Williams wrote the opinion, joined by Judge Anni Hill Foster and Vice Chief Judge David D. Weinzweig.
The appeal also challenged the exclusion of text messages from the victim’s phone. The court rejected that claim. Its sentencing ruling concerned the AI-generated portion of a victim-impact video, not the jury’s decision about guilt.
How the AI-generated video came up at sentencing
The case followed a road-rage confrontation at a red light in which Horcasitas shot and killed Christopher Pelkey. A jury found Horcasitas guilty of manslaughter and one endangerment count; he later pleaded guilty to that endangerment count.

At sentencing, Pelkey’s friends and relatives spoke about his life and the loss caused by his death. His brother read a statement Pelkey had actually written about his beliefs and hopes. Pelkey’s sister, Stacey Wales, then described what she imagined her brother might say if he could speak. An AI video followed: it combined authentic footage of Pelkey with a synthetic portrayal of his appearance and voice delivering new words about forgiveness, his family, and Horcasitas.
Why the court distinguished real footage from generated speech
The opinion did not treat every part of the video as improper. The court said the embedded real footage was permissible. Its concern was that the synthetic segment presented thoughts created from Wales’s imagination as if Pelkey himself were speaking them, complete with apparent facial expressions and voice.

The court explained: “Indeed, rather than documenting an event or recording a particular moment, the AI video presents a depiction of the victim and his thoughts created from the imaginings of the victim’s sister.” It said the presentation “erases the interpretive distance between the family’s belief about what the victim would have said and the victim’s own voice and opinions.”

The distinction was about provenance and attribution: whether material recorded or written by Pelkey was kept separate from a relative’s interpretation of what he might have said. The ruling does not say that all victim-impact statements, family reflections, or AI-created material are inherently inadmissible.

Why the video made the sentence fundamentally unfair
Horcasitas did not object to the video at sentencing, so the appeals court reviewed the claim for fundamental error. It found the synthetic portrayal unreliable and unduly prejudicial on this record, in part because the sentencing judge expressly reacted to it and it played a role in his sentencing calculus.
As the opinion recounts, sentencing Judge Todd F. Lang said he “loved” the video and felt it “was genuine.” He referred to the AI victim’s “obvious forgiveness” of Horcasitas and characterized it as coming from the victim’s “heart.” The appellate court observed: “And it clearly impacted the sentencing judge, who said he ‘loved’ the video and felt it ‘was genuine,’ pointing to the AI victim’s ‘obvious forgiveness’ of Horcasitas, which he characterized as coming from the AI victim’s ‘heart.’”

The appellate judges said the record did not show precisely how much the video affected the sentence, but concluded there was no question it played a role. Considering the generated portrayal as though it conveyed Pelkey’s own views prejudiced Horcasitas enough to make the sentencing fundamentally unfair.

Accordingly, “sentence vacated” refers specifically to the manslaughter sentence. The disposition does not amount to an acquittal or erase the conviction.
What the ruling does—and does not—establish about AI in court
The court described the issue as novel in Arizona and applied existing victim-impact and due-process principles to the facts before it. It did not announce a categorical ban on AI in court proceedings or establish that every synthetic image, voice, or video is inadmissible.
The decision is narrower: in this sentencing, AI-generated speech was attributed to a deceased person, the presentation blurred the line between the victim’s actual words and a relative’s imagined message, and the judge’s remarks showed that the material affected the sentencing decision. The court also said no disclaimer could cure the error in this video because it continued to present the generated statement as coming directly from Pelkey.
