The Arizona Court of Appeals has ordered a new sentencing hearing for Gabriel Paul Horcasitas after finding that the sentencing judge relied on an AI-generated video portraying the victim, Christopher Pelkey, expressing thoughts Pelkey never recorded or wrote. The court left Horcasitas’s manslaughter conviction intact: this appeal concerned the sentence, not the jury’s finding of guilt.
What the Arizona appeals court decided
In State v. Horcasitas, No. 1 CA-CR 25-0191, filed September 30, 2026, the Arizona Court of Appeals, Division One, affirmed Horcasitas’s manslaughter conviction, vacated his 10.5-year sentence, and sent the case back for resentencing. The 10.5-year term was the presumptive sentence in the circumstances before the sentencing court; it is a case-specific figure, not a general sentencing statistic.

Horcasitas had not objected to the video at sentencing, so the appeals court reviewed the issue for fundamental error. It concluded the video was unreliable and that the judge’s own comments showed the portrayal affected the sentencing decision. The court’s remedy was a new sentencing hearing, not a new trial.

At the May 2025 sentencing hearing, Pelkey’s sister, Stacey Wales, presented a video made with an AI-generated likeness and voice of her brother. Wales wrote the script. The avatar addressed the court and Horcasitas, expressed forgiveness, and spoke about what might have been. The video did not request a particular prison term.

The appeal turned on what the video purported to represent. It was not a recording of Pelkey speaking, nor a statement he had authored. The court explained: “Indeed, rather than document an event or recording a particular moment, the AI video presents a depiction of the victim and his thoughts created from the imaginings of the victim’s sister.”
The panel’s concern was therefore not simply that the video used AI. Family members can describe their own grief and experiences; this video instead presented imagined words and thoughts through a synthetic version of the deceased. The sentencing judge, Todd F. Lang, said he “loved” the AI and described the video as genuine and as speaking from the victim’s heart. The appeals court cited those remarks in finding that the unreliable portrayal affected the sentence.

Why the sentence was vacated but the conviction stands
The video was presented during sentencing, as victim-impact material—not to the jury as evidence for deciding whether Horcasitas was guilty. The appellate ruling addressed the sentencing judge’s consideration of that material. It did not disturb the manslaughter verdict or acquit Horcasitas.
The court’s reasoning distinguishes between a person’s own account and a synthetic depiction attributed to someone who did not create or record it. That distinction matters especially when a judge treats the generated portrayal as an authentic expression of the deceased person. Because the opinion found the video unreliable and the judge’s comments demonstrated reliance on it, the sentence could not stand.

What happens next
The case returns to the trial court for resentencing. The appellate decision does not establish what sentence the judge will impose at the new hearing, and the available case information does not establish a hearing date. No outcome should be assumed in advance.
This is a case-specific appellate decision, not a universal rule governing every AI-generated victim-impact submission or every court. Its holding concerns this video, this sentencing record, and the judge’s stated response to it.
