Are You Allowed to Keep Treasure Found on a Beach? Reporting and Ownership Rules Explained

Usually, you cannot simply keep a valuable object found on a beach. The result depends on the country, the beach’s land manager, what the object is, and whether it may be wreck material. In England and Wales, potential legal treasure must be reported; a qualifying find does not automatically become the finder’s property.

The short answer depends on four facts

“Treasure” is not a universal beach-finding rule. Before taking an object home, establish:

As an Amazon Associate I earn from qualifying purchases.

  • Jurisdiction: England and Wales, Scotland, Northern Ireland, the United States, or another country.
  • Land manager: a public authority, protected park, Crown foreshore, private owner, or another operator.
  • Object type: possible statutory treasure, an ordinary lost item, an archaeological object, or material from a shipwreck.
  • Your permission and conduct: whether you were allowed to search and whether you acted honestly and preserved the find’s context.
Situation Required response Key timing or condition
Potential treasure found in England or Wales Report it to the local Finds Liaison Officer (FLO) Within 14 days of finding it, or within 14 days of realizing it might be treasure
Possible UK wreck material Report it to the Receiver of Wreck An owner has one year after the report form is received to come forward and prove ownership
Artifact on US National Park Service land Leave it where it is and notify park staff Digging, collecting artifacts, and metal detecting are prohibited in national park units
Metal detecting on Crown Estate foreshore Follow the Crown Estate’s terms, third-party rights, and heritage law Formal Crown Estate consent is not required on its foreshore, but that policy is not a universal beach permission
Scotland or Northern Ireland Use the relevant national heritage authority’s process Rules differ from the England and Wales Treasure Act process

What legally counts as treasure in England and Wales?

The word “treasure” in ordinary conversation covers anything old, valuable, or exciting. The legal category is narrower and technical. Under the 2023 Treasure Act Code of Practice, certain metal-containing objects at least 200 years old can qualify when they also meet the specified historical, archaeological, or cultural-significance threshold. Other statutory routes can apply to qualifying groups or objects, so age and apparent market value alone do not decide the issue.

A find can require reporting even if it was lost rather than deliberately buried. A beach location does not exempt an otherwise qualifying object: the Treasure Act ownership provisions apply whatever the nature of the place where the treasure was found. If you cannot classify the item confidently, treat it as a potential protected find and ask a Finds Liaison Officer rather than making a private decision to keep, clean, sell, or export it.

The official process is about more than the object itself. The FLO or a museum curator records where and how it was found, because location and associated material can be archaeologically important. Removing nearby objects, scraping corrosion away, or separating items from a group can destroy evidence that helps determine both significance and ownership.

England and Wales: report potential treasure within 14 days

The current GOV.UK guidance sets a clear deadline. It says:

“You must report treasure to your local Finds Liaison Officer within either: 14 days of first finding it; 14 days of realising an item might be treasure, even if you’ve had it for longer.”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The rule applies to a find on a beach, foreshore, seabed area covered by the legislation, or another location in England and Wales. If you initially thought an object was ordinary and later learn facts that make treasure plausible, the 14-day period runs from that realization. The government states that failing to report can lead to an unlimited fine or up to three months in prison. See GOV.UK’s report-treasure guidance for the official route and contact details.

Step 1: Preserve the find and its context

  1. Handle the object as little as practical. Do not polish, acid-test, melt, drill, or otherwise alter it.
  2. Photograph the object as found and record the date, tide or weather if relevant, precise beach area, nearby landmarks, and whether anything else was with it.
  3. Do not continue digging around the spot unless the responsible authority specifically instructs you. Further disturbance can damage associated evidence.

Step 2: Contact the local Finds Liaison Officer

Use the local FLO route described by GOV.UK and explain that the item may be treasure. Provide photographs and your location notes, but follow the officer’s instructions about transport or temporary storage. Do not mail an irreplaceable object without arranging secure handling.

Step 3: Cooperate with identification and assessment

The FLO or museum curator will discuss the circumstances of discovery and prepare a report. The official determination, rather than a finder’s guess, decides whether the object falls within the statutory treasure category. If a museum wishes to acquire a treasure find, it is valued through the official process.

Step 4: Understand what happens if it is not acquired

If the object is determined not to be treasure, or no museum wants to acquire it, GOV.UK says it may be returned to the finder. The landowner and site occupier are informed and have an opportunity to object. Immediate possession and ultimate entitlement are therefore separate questions; do not assume that receiving an item back resolves every ownership issue.

Who owns treasure under the Treasure Act?

The Treasure Act 1996 provides that treasure vests in a franchisee if one exists, and otherwise in the Crown, subject to prior interests and rights. That rule applies regardless of whether the object came from a dry beach, foreshore, or another place. Finding an object first does not create automatic ownership.

A reward can be available to an eligible finder, but it is not a guaranteed purchase price. Eligibility can depend on having permission to search and acting in good faith. Trespassing, concealing a find, failing to report it, or otherwise behaving improperly can reduce or remove reward eligibility. The landowner, occupier, and other parties may also have relevant rights. Keep written permission and honest location notes where possible; they can matter when the find is assessed.

Beach access, foreshore detecting, and permission

Permission to search is a separate issue from what happens after a discovery. The Crown Estate says formal Crown Estate consent is not required to metal detect on its foreshore, provided the detectorist follows its terms and respects third-party rights. Its guidance also requires compliance with the Treasure Act and warns that wreck found on the seabed may legally belong to a third party. Read the Crown Estate’s metal-detecting conditions for the particular foreshore.

That statement does not grant a general right to detect on every UK beach. A beach may be owned or managed by a local authority, conservation body, port, private landowner, or another organization with its own permit system. Protected archaeological sites can have additional restrictions. Check the actual land manager before using a detector or removing anything, and comply with by-laws, conservation rules, and any requirement to obtain the owner’s permission.

When a beach find may be wreck material

An old coin, fitting, timber fragment, cannon component, or other object washed ashore may have come from a ship. UK wreck law follows a different reporting route from the Treasure Act. Material recovered from UK territorial waters, or brought into those waters, must be reported to the Receiver of Wreck.

The Receiver’s process gives an owner one year after the report form is received to come forward and prove ownership. The official Treasure Act Code also distinguishes wreck for Merchant Shipping Act purposes from treasure: an object that is wreck under that legislation is not treasure under the Treasure Act. Therefore, do not decide that an object is ordinary beach property merely because waves delivered it to shore.

Record the point of recovery, keep the object intact, and tell the Receiver exactly whether it was recovered from the water, exposed at low tide, or found on the upper beach. Follow instructions about delivery and conservation. If the object appears to be both historically important and possibly from a wreck, report it through the wreck route and mention the potential heritage significance rather than choosing whichever process seems more favorable.

US beaches: identify the land manager first

There is no single “US beach treasure” rule. Federal, state, municipal, tribal, and private beaches can have different laws. The National Park Service gives a strict example: on National Park Service land, visitors who find an artifact should leave it where it is. Its guidance prohibits digging, collecting artifacts, and using metal detectors in national park units. Read the National Park Service artifact guidance and contact park staff.

Those restrictions should not be extended automatically to every beach in the United States. A beach outside a national park may still be subject to state antiquities laws, submerged-cultural-resource rules, local ordinances, beach-combing permits, or private-property rights. Before searching, identify the agency or owner responsible for the exact stretch of shore. After a discovery, leave an archaeological-looking object in place unless the responsible authority tells you otherwise, photograph it, and report its location.

Scotland, Northern Ireland, and other countries

England and Wales are not the whole of the United Kingdom. GOV.UK expressly states that Scotland and Northern Ireland have different rules for historic or valuable finds. Do not apply the England and Wales 14-day Treasure Act instructions automatically in either jurisdiction. Contact the relevant heritage authority or museum service before removing, keeping, selling, or disposing of an uncertain object. The same caution applies in every other country: ownership can depend on national heritage law, the foreshore or seabed regime, and the beach’s owner.

If you are traveling with a find, check export and customs requirements before crossing a border. A lawful discovery in one jurisdiction may be protected property or subject to reporting in another, and moving it can make the situation harder to resolve.

What to do immediately after finding a suspicious object

  • Stop and observe: note the exact position, depth, tide line, and nearby objects.
  • Photograph before moving: include a scale and wide shots that show the setting.
  • Avoid cleaning: soil, encrustation, and corrosion can carry useful evidence.
  • Check the land manager: determine whether the site is a national park, protected area, Crown foreshore, private beach, or another managed location.
  • Classify cautiously: an apparently valuable item may be ordinary lost property; an unattractive corroded fragment may be archaeological or wreck material.
  • Report through the right channel: use a Finds Liaison Officer for potential treasure in England and Wales, and the Receiver of Wreck for UK wreck material.
  • Keep records: save permission messages, photographs, coordinates, and every report reference.
  • Do not sell or post the object for trade: wait until the responsible authority confirms the legal position.

Common mistakes that create legal problems

“It was on the beach, so it belongs to whoever picks it up.”

Beach location does not override statutory ownership. In England and Wales, the Treasure Act applies to qualifying finds wherever they are found, and wreck has its own reporting regime.

“It is valuable, so it must be treasure.”

Market price is not the legal test. Age, metal content, significance, associations, and the technical statutory criteria matter. Report uncertainty instead of relying on an online appraisal.

“The Crown Estate allows detecting, so every find is mine.”

The Crown Estate policy concerns detecting on its foreshore under stated conditions. It does not transfer ownership of treasure or wreck and does not cover beaches managed by other parties.

“National park rules apply to every US shoreline.”

The National Park Service rule is specific to national park units. Other beaches require checking the actual federal, state, local, tribal, or private land manager.

“I can report it later if someone asks.”

For England and Wales, the reporting period is 14 days from discovery or from realizing that the item might be treasure. The stated consequences for non-reporting are an unlimited fine or up to three months in prison.

How ownership is decided after a report

Reporting does not mean you automatically lose every possibility of receiving the object or a reward. It puts the find into the official process. The authority records its context, determines whether it is treasure or wreck, and identifies any institutional or ownership claims. A museum acquisition of treasure involves official valuation. If no acquisition occurs and the object is not legally retained, it may be returned subject to notification and objections by the landowner and occupier.

Because reward eligibility is separate from possession, be accurate from the beginning. State where you searched, who gave permission, when you found the object, and when you realized it might be protected. Concealment or unauthorized searching can affect both the outcome and any reward.

Bottom line for a beach finder

Do not treat a potentially historic or wreck-related object as a “finders keepers” prize. Leave it as undisturbed as possible, document its location, identify the beach’s land manager, and use the jurisdiction’s official reporting route. In England and Wales that means contacting a Finds Liaison Officer within 14 days for potential treasure; for UK wreck material it means the Receiver of Wreck. On US National Park Service land, leave artifacts where found and do not dig, collect, or metal-detect.
