There is not enough evidence to say that unelected officials in Scotland’s councils, as a class, have too much power. Councillors are elected to make political choices and scrutinise services; officers manage services, deliver council policy and may hold authority delegated to them. Some officers also have independent statutory duties. The practical question is whether each council’s arrangements make those powers clear and allow effective scrutiny by elected members.
Who makes decisions in a Scottish council?
Scottish councils are made up of councillors directly elected by local residents. The Scottish Government lists 1,226 elected councillors on its current policy page, accessed in 2026; that is the page’s reported figure, not a live independently verified count. Councillors make executive decisions, scrutinise policies and services, carry out regulatory functions such as planning and licensing, and represent their wards. Officers are responsible for managing services and delivering council policy. Their work is not limited to giving advice: a council may assign them decision-making authority through its scheme of delegation, and legislation can give particular officers defined duties. The division between members and officers therefore depends partly on the law and partly on the council’s local governance arrangements.
What are statutory officers’ powers and responsibilities?
Audit Scotland’s 2019 report identifies four statutory officer roles: head of paid service, chief financial officer, monitoring officer and chief social work officer. Their respective responsibilities include staffing and coordination, the council’s financial affairs, legal and constitutional compliance, and professional social-work advice. These responsibilities can require an officer to raise concerns independently; that is not, by itself, evidence of an improper transfer of political power. Audit Scotland’s 2016 report also discusses a chief education officer role under the Education (Scotland) Act 2016. Because its 2019 report lists four roles without that post, those reports should not be treated as establishing an identical or exhaustive current list of statutory officers. What safeguards are meant to keep authority accountable?
A council’s scheme of delegation should explain which functions officers may exercise and how their roles fit within the council’s arrangements. Audit Scotland says councillors should understand statutory officers’ roles through clear schemes of delegation and member induction. It also says the chief executive is responsible for ensuring statutory officers have sufficient access and influence to do their work. Those safeguards matter in both directions: elected members need to understand where authority sits, and statutory officers need room to fulfil their duties.

Audit Scotland has identified governance risks, including cases where statutory officers lack sufficient influence, councillors do not understand their roles, or poor trust and respect between councillors and officers undermines a monitoring officer’s work. Its 2016 report describes statutory officers as having an independent role in promoting good governance and ensuring legal compliance. The issue is not whether officers should be influential at all, but whether their responsibilities, reporting lines and member oversight are clear and functioning.

Elected members are also subject to a code of conduct. The councillors’ code effective from 7 December 2021 was issued by Scottish Ministers with Scottish Parliament approval under the Ethical Standards in Public Life etc. (Scotland) Act 2000. The Act provides the framework for councillor codes and handling alleged breaches; the code also applies to certain co-opted committee members. National audit and policy sources explain the formal division of responsibilities and identify governance risks, but they do not compare current delegation practices across all 32 councils. They cannot establish that officials have excessive power in every council—or that every council’s arrangements work well. To assess a particular council, examine its current rules and the decisions actually made under them.

- Find the rules: read the current scheme of delegation, standing orders, committee remits and annual governance statement.
- Trace decisions: review officer decision records and identify which decisions are delegated, the legal or local authority for them, and any financial thresholds or exceptions.
- Check member oversight: establish what is published, whether councillors can call in or review decisions, and which committees scrutinise the relevant work. Routes to reverse a decision depend on the law and the council’s rules.
- Test how the system works in practice: compare accounts from councillors in the administration and opposition, relevant statutory officers, audit committee members and residents affected by decisions.
- When comparing councils, use the same measures: delegated decision scope; legal and financial thresholds; transparency; member review or appeal routes; scrutiny committee oversight; and whether statutory officers can act independently while reporting through clear arrangements.
For a specific controversy, the key questions are whether the officer acted within the authority assigned, whether a statutory duty required the action, what information elected members received, and what scrutiny or review was available. Without that council-specific evidence, the existence of delegated powers is not enough to settle whether those powers are excessive.
