Some synthetic cells are alive in the biological sense; others are engineered, cell-like systems that perform one or two life-like functions without autonomous metabolism, homeostasis or reproduction. “Synthetic cell” describes a continuum rather than a single technology. A non-replicating vesicle and a genome-containing bacterium can both receive that label while occupying opposite ends of the biological spectrum.
The scientific question is which properties of life a construct actually performs. The legal question is different: which biosafety, biosecurity, environmental, chemical-safety or biotechnology rules apply to the construct, its use and its location. No universal legal label settles either question.

What scientists mean by “synthetic cell”
The 2026 National Academies framework treats synthetic cells as an umbrella category arranged on a continuum. At one end are simple, non-replicating systems with no genetic material. At the other are genome-containing systems that replicate. Between those endpoints are many hybrids: membrane-bound compartments that run reactions, cell-free systems that express genes, and engineered organisms that use a natural cellular chassis but carry a chemically synthesized genome.
The framework uses two initial classification questions:

- [Deep Bass with Clear Vocals] High-performance drivers produce punchy bass while keeping vocals clean and detailed for everyday listening.
- Does the system contain genetic material?
- Does it replicate?
A second layer considers what the system is intended to do and where it will operate. Relevant characteristics include its deployment environment, novel substances it makes, persistence, interaction with living organisms, evolvability, gene transfer and potential for misuse. This approach avoids treating every membrane vesicle as alive or every engineered bacterium as merely a machine.
The core definition also has boundaries. Purely chemical systems without cellular characteristics, conventional genetically engineered organisms and cells with synthetic genomes that are otherwise identical to natural organisms are outside the framework’s central category, although some may sit in gray areas. “Synthetic cell” therefore describes a practical class for analysis, not a universally agreed taxonomic rank.
Which properties make a cell biologically alive?
There is no single, universally accepted test for life. A useful working test asks whether a construct can perform several linked functions rather than one isolated reaction.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problems- Organized metabolism: it captures and transforms energy and materials through coordinated chemical pathways.
- Homeostasis: it maintains internal conditions, such as chemical balance or membrane integrity, despite external changes.
- Information processing: it stores, reads and uses heritable information to regulate activities.
- Growth: it builds additional cellular material in an organized way.
- Reproduction: it makes new entities of the same general type, using an internally controlled process.
- Evolution: heritable variation can be acted on by selection over generations.
These properties form a continuum. A vesicle that runs an enzymatic reaction is functioning, but that fact alone does not establish that it is alive. A system that maintains itself, copies its information and reproduces under its own control is much closer to ordinary biological life. Researchers may still disagree about borderline cases because the criteria overlap and can be supplied partly by the environment.
Why replication is such a strong dividing line
Replication links information, chemistry and continuity across generations. A non-replicating compartment may grow when supplied with additional ingredients, but it does not independently produce descendants. A replicating cell must coordinate genome copying, construction of cellular components, energy use and division. That coordination is why replication is one of the first practical questions in the National Academies framework.
Why a genome is not enough by itself
DNA or another genetic polymer can encode instructions without being a living system. Cell-free gene-expression mixtures, for example, can read genetic information and make proteins while lacking the integrated boundary, metabolism and self-maintenance of a cell. Genetic material is therefore an important axis, not a complete definition of life.

The continuum in practice
| System type | Genetic material | Replication | Metabolic autonomy | Homeostasis and growth | Evolvability | Typical context |
|---|---|---|---|---|---|---|
| Non-replicating vesicle or protocell | None, or externally supplied molecules | No autonomous replication | Usually limited to encapsulated or supplied reactions | Partial or transient | Usually absent | Laboratory research, materials or drug-delivery studies |
| Cell-free genetic system | Yes, in a reaction mixture | Copies or expresses components only when supplied with resources | Not a complete autonomous metabolism | Limited and externally maintained | Usually not sustained across generations | Gene-expression, diagnostics and biomanufacturing research |
| Minimal bacterium with a synthetic genome | Yes | Yes, in a cellular chassis | Integrated biological metabolism | Maintains a cell, grows and divides | Yes, subject to mutation and selection | Contained synthetic-biology research |
| Fully bottom-up autonomous cell | Expected to be designed or assembled from nonliving components | Would replicate under its own control | Would need integrated, self-maintaining metabolism | Would need durable internal regulation | Would require heritable variation | A research goal; claims depend on demonstrated capabilities |
The table shows why “alive” cannot be inferred from one feature. A vesicle can have a membrane but no heredity. A cell-free system can have genetic material but no autonomous boundary. A minimal bacterium can satisfy the ordinary biological criteria even though its genome was designed and synthesized by people.

The J. Craig Venter Institute reports that researchers designed and constructed JCVI-syn3.0, a minimal synthetic bacterial cell. Its reported genome contains about 531,000 base pairs and 473 genes. JCVI described it as the smallest genome of any self-replicating organism at the time of publication.
JCVI-syn3.0 is alive under the ordinary biological criteria: it has a cellular membrane and metabolism, maintains itself, grows and divides, and carries heritable information. Its genome was chemically synthesized and designed through a design-build-test process, with genes derived from earlier JCVI-syn1.0 work.
What JCVI-syn3.0 did not prove
JCVI-syn3.0 was not assembled entirely from nonliving molecules. Researchers installed the synthetic genome in a pre-existing cellular chassis. The resulting organism demonstrates synthetic genomic construction and minimal-cell biology, but it does not settle the stronger philosophical claim that scientists created life wholly from non-life.
This distinction matters. “A living cell with a chemically synthesized genome” and “a cell assembled from nonliving ingredients that becomes autonomous” are different achievements. The first has been demonstrated by JCVI’s work; the second remains a more demanding bottom-up objective.

JCVI describes synthetic genomics as two linked processes: synthesizing complete genomes or chromosomes, then booting those nucleic acids to make viruses or living cells. Its milestone history identifies the first bacterium with a synthetic genome in 2010 and the minimal bacterial cell in 2016. Those milestones show increasing control over biological information and cellular dependence, not a single moment when a legal or philosophical boundary was crossed.

Are protocells alive?
“Protocell” usually refers to a model of an early or simplified cell: often a membrane-bound compartment containing chemical reactions, informational molecules or both. Protocells are valuable because they let researchers test how membranes, metabolism and information might become coupled. They are not automatically living cells.
When a protocell is life-like but not alive
A protocell may form a membrane, concentrate molecules, carry out an enzymatic reaction or change shape. Those are meaningful life-like behaviors, but they may depend on externally supplied fuel, enzymes or building blocks. If the compartment cannot maintain itself, reproduce its information and produce descendants without continuous outside assembly, many biologists would classify it as a model or nonliving system rather than an organism.
What would move a protocell toward life?
A stronger claim would require several functions to operate as one system:
- an internally maintained boundary;
- a metabolism that supplies energy and raw materials;
- information storage and expression;
- growth by acquiring or making components;
- division that produces viable descendants; and
- heritable variation that can support evolution.
Even then, researchers should state which criteria were demonstrated and which were supplied by the environment. “Protocell” identifies an experimental architecture; it does not answer the life question by itself.
Is “Synthia” a living organism?
If “Synthia” refers to the organism associated with JCVI’s synthetic-genome work, the relevant answer is that the resulting bacterium is a living, self-replicating organism. Its genome was chemically synthesized, but it operated in a cellular chassis and therefore was not a cell built entirely from nonliving parts.
The nickname can obscure two separate facts: the organism is biologically alive, while the origin of its genome is synthetic. Designing or synthesizing a genome does not make the cell nonliving, just as breeding or editing a genome does not remove an organism from biology. The decisive issue is what the resulting system can do autonomously.

How synthetic cells differ from GMOs
A genetically modified organism is generally a living organism whose genetic material has been altered using biotechnology. A synthetic cell may also be a living organism, but the term emphasizes the extent and method of construction rather than a single regulatory category.

| Must it be alive? | Yes, because “organism” implies a living system. | No. The term includes non-replicating and cell-free systems as well as living cells. |
| What may be changed? | One or more genes, regulatory regions or chromosomes in an existing organism. | Anything from a membrane compartment to a substantially redesigned or synthesized genome. |
| Is a natural cellular chassis required? | Usually an existing organism is modified. | Sometimes. JCVI-syn3.0 used a pre-existing cellular chassis; a bottom-up system would not. |
| Does the label determine oversight? | No. Rules depend on organism, trait, use, containment and jurisdiction. | No. Oversight depends on genetic material, replication, deployment and risk characteristics. |
| Can the categories overlap? | Yes. A living synthetic-genome bacterium can also fit broad descriptions of a genetically modified organism. | Yes. A replicating synthetic cell may be regulated under frameworks used for engineered organisms. |
The European Commission’s 2014 expert opinion defines synthetic biology operationally as “the application of science, technology and engineering to facilitate and accelerate the design, manufacture and/or modification of genetic materials in living organisms.” The Commission also says the boundary between synthetic biology and genetic modification cannot be made fully quantifiable or unambiguous. That is a risk-assessment definition, not a universal definition of life and not a grant of legal personhood.
Can a cell be alive if humans designed its genome?
Yes. Biological life is assessed by the system’s organization and activities, not by whether every sequence arose through natural selection. If a cell uses genetic information, maintains metabolism, preserves internal conditions, grows and reproduces, it meets ordinary biological descriptions of life even when humans designed or synthesized much of its genome.
Human design does affect how scientists describe the organism. They may call it engineered, synthetic-genome or minimal, and they must document its construction and containment. Those descriptors explain provenance and risk; they do not negate the cell’s biological status.

Scientific classification asks a property question: what can the construct do? Law and regulation ask a governance question: which requirements apply to this work, product or release? A system can be biologically alive without having any special legal rights, and a nonliving construct can still trigger strict controls because of what it contains or could do.

The practical questions regulators need answered
- Does it contain genetic material? This affects genetic-material handling, sequence review and potential information hazards.
- Can it replicate? Replication raises questions about exposure, persistence, spread and control.
- What is its intended function? A diagnostic reagent, therapeutic delivery system, industrial production platform and environmental application present different hazards.
- Where will it operate? A sealed laboratory, manufacturing facility, patient, agricultural setting and open environment create different exposure pathways.
- Can it persist or evolve? Survival, mutation, adaptation and gene exchange affect the duration and reversibility of risk.
- Can it interact with organisms? Host range, toxicity, immune effects and ecological relationships may matter even when replication is limited.
- Could the work lower barriers to harmful biological construction? Biosecurity review may consider misuse potential in addition to direct organismal hazards.
These questions produce a proportionate oversight path rather than a single legal label. The same physical construct can face different requirements when moved from contained research to a product, clinical use or environmental deployment.
Why existing frameworks may not fit every synthetic cell
The National Academies notes that existing biosafety and related institutional oversight frameworks were not designed for the full diversity of synthetic-cell systems, particularly nonliving or hybrid constructs and applications beyond contained laboratory research. A non-replicating chemical compartment may fall outside rules written for organisms while still presenting chemical, environmental or delivery risks. Conversely, a replicating synthetic bacterium may fit established biosafety processes but raise new questions about genome design, persistence or gene transfer.
Do synthetic cells have legal rights or personhood?
There is no general legal rule that grants synthetic cells rights or personhood merely because they are biologically alive. In ordinary regulatory practice, a living engineered cell is treated as biological material or an organism subject to applicable controls, not as a legal person.
“Legal status” usually means the obligations attached to research, manufacture, transport, use or release: permits, containment, institutional review, environmental assessment, worker protection, waste handling and reporting. Those obligations can apply to living and nonliving systems for different reasons. A system’s status must therefore be checked under the law of the relevant country, state or institution and for the specific proposed use.
A decision framework for classifying a new construct
Researchers, reviewers and readers can use the following sequence to avoid category errors.
- Describe the physical system. State whether it has a membrane or other boundary, what materials it contains and whether it is a whole cell, cell-free mixture or hybrid.
- Inventory information. Identify DNA, RNA or other heritable information, its source and whether it can be copied or expressed.
- Test autonomous functions. Document metabolism, internal regulation, growth, division and dependence on externally supplied components.
- Test reproduction and inheritance. Ask whether descendants arise without manual reassembly and whether traits pass to those descendants.
- Assess evolution and exchange. Consider mutation, selection, adaptation, horizontal gene transfer and interaction with natural organisms.
- Define the deployment context. Record containment, duration, host or environmental exposure, persistence and reversibility.
- Map oversight. Consult biosafety, biosecurity, chemical, environmental and biotechnology requirements that match the characteristics and use.
This procedure keeps two conclusions separate: “the construct performs enough integrated functions to be called alive” and “the proposed activity is permitted under a particular legal framework.” They may point in different directions.
Quick Recap
Common mistakes and how to avoid them
- “It has DNA, so it is alive.” Genetic material can function in a cell-free reaction. Check for integrated self-maintenance and reproduction.
- “It was made synthetically, so it is not an organism.” A chemically synthesized genome can operate in a living cell. Evaluate the resulting system, not only its manufacturing method.
- “Minimal means primitive and harmless.” A small genome can still support replication, persistence or interaction with other organisms. Risk depends on traits and context.
- “Synthetic cell” is a legal category everywhere. The term is scientifically useful but regulatory systems divide responsibilities by characteristic, use and jurisdiction.
- “A protocell that performs one life function is alive.” One function does not demonstrate a complete, autonomous life cycle.
- “A living synthetic cell automatically has rights.” Biological life and legal personhood are separate concepts.
What the strongest evidence supports
Six conclusions are well supported:
- Synthetic cell describes a continuum, not one technology.
- Genetic material and replication are the first practical dividing lines.
- JCVI-syn3.0 is a living, self-replicating bacterium with a chemically synthesized minimal genome, but it used a pre-existing cellular chassis.
- Bottom-up protocells can perform life-like functions without meeting every criterion for life.
- Regulators classify systems by characteristics, intended use and context; there is no universal legal “alive” label.
- Oversight is distributed and may require adaptive, case-specific tools as constructs move beyond contained laboratory research.
