Smart glasses are not automatically illegal to wear, but using them to record can raise separate legal and venue-policy issues. The rules depend on where you are, whether you capture audio or video, whether a conversation is confidential or a person is in a place where they reasonably expect privacy, and what you do with the recording afterward. The federal and state examples below are not a complete survey of U.S. law.
Wearing smart glasses and recording with them are different questions
Simply wearing glasses with a camera or microphone does not, by itself, determine whether a recording is lawful. The legal questions arise from what the device captures and how the recording is handled. Audio recording can implicate interception or eavesdropping laws; video recording can raise privacy concerns, especially in places where people reasonably expect privacy. A venue may also set its own rules about recording devices.

There is no universal rule in the cited sources that makes every recording in a public place lawful. The location, the conversation, the purpose, applicable state law, and the rules of the property or institution can all matter.

Federal law provides a limited one-party-consent rule
Under 18 U.S.C. § 2511(d), a non-government actor generally does not violate that chapter by intercepting a communication when they are a party to it or one party has given prior consent. The provision excludes an interception made to commit a criminal or tortious act in violation of federal or state law. This is a federal rule about interception; it does not grant blanket permission to record anywhere or override potentially stricter state law, privacy rules, or venue policies.

California is an example of an all-party rule for confidential communications
California Penal Code § 632 addresses intentionally recording or eavesdropping on a confidential communication without the consent of all parties. The statute’s definition turns on whether the circumstances reasonably indicate that a party wants the communication confined to the participants. It excludes public gatherings and situations in which participants may reasonably expect to be overheard or recorded. This is a California example, not a nationwide rule.
The practical distinction is important: the question is not simply whether someone is nearby or whether the glasses are visible. Consider whether the conversation is confidential under the applicable law and whether you have the consent required where you are.

Video, privacy-sensitive places, and sharing recordings
The federal and California provisions described above concern interception or confidential communications; they do not settle every question about filming. Recording a person in a place where they reasonably expect privacy can raise separate legal or institutional issues. Sharing, publishing, or distributing a recording may also be restricted, even when the act of capturing it is not addressed by the same rule.

For example, Washington Administrative Code § 172-121-306 applies on Eastern Washington University premises. It treats certain recordings of private conversations or images made where a person reasonably expects privacy—and that are likely to cause injury or distress—as unauthorized recording, and also prohibits storing, sharing, publishing, or disseminating such recordings. The provision excludes images of people in areas reasonably considered open to public view. A separate University of Washington regulation likewise identifies recording without consent in a place where a person reasonably expects privacy, and storing or distributing such recordings, as unauthorized recording. These are institution-specific rules, not statewide rules for all public or private spaces in Washington.

Before you record with smart glasses
- Check the law where you are. Look up the applicable state rules, particularly for audio recording and consent. Do not assume the federal one-party-consent provision settles the state-law question.
- Consider what the glasses will capture. Audio from a conversation can raise different issues from video alone. Ask whether the conversation is confidential or the person is in a place where privacy is reasonably expected.
- Check the venue’s policy. A school, university, workplace, business, or other property may restrict recording devices or recordings independently of general law.
- Think about purpose and handling. Do not assume that permission to make a recording also means you may store, share, publish, or distribute it. Some rules address those later actions separately.
- When the rule is unclear, pause. Get consent or refrain from recording until you can verify the applicable law and policy.
What to take away
Smart glasses are not automatically unlawful to wear, and their recording capabilities do not make every recording lawful. Whether a particular use is permitted depends on jurisdiction, the type and context of the recording, the location, the purpose, and any rules governing the venue or later sharing. The federal, California, and university examples above illustrate why checking the specific situation matters; they are not a complete state-by-state guide.
