Are seeds for sowing GST-exempt in India? Common questions answered

Yes—qualifying seeds supplied for sowing are nil-rated under India’s GST rate entry for HSN 1209. The classification is use-specific, however. The CBIC entry covers “seeds, fruit and spores, of a kind used for sowing” and expressly excludes seeds intended for any other use. A product marketed simply as a “seed” does not automatically receive the nil rate.

The direct answer: sowing seeds under HSN 1209 are nil-rated

CBIC’s GST goods-and-services rate table lists “Seeds, fruit and spores, of a kind used for sowing” under HSN 1209 at a nil rate. In practical terms, a supply that meets that description is charged at 0% GST under the listed entry. This is why people commonly describe qualifying sowing seed as GST-exempt.

The decisive condition is the seed’s intended use. The same entry does not cover seeds meant for any use other than sowing. Food, oil extraction, processing, animal-feed, decorative or other commercial uses cannot be placed in the HSN 1209 sowing category merely because the goods are botanically seeds.

This answer is based on the CBIC rate table and the wording of the relevant notifications available as of 13 October 2026. For an actual invoice, classification should be checked against the product specification, stated purpose and the schedule in force on the transaction date.

What the official HSN 1209 entry says

The operative description

The entry uses the wording “Seeds, fruit and spores, of a kind used for sowing.” The phrase “of a kind used for sowing” is not decorative language: it defines the scope of the nil-rate line. It points to the nature and intended application of the goods rather than to the word printed on a packet or marketplace listing.

The express exclusion

The explanation attached to the entry states: “This entry does not cover seeds meant for any use other than sowing.” That sentence prevents a blanket claim that all seeds are GST-free. Where the commercial purpose is not sowing, another tariff line may apply, and the rate must be determined from the product’s own classification.

When the wording took effect

Notification No. 9/2021-Central Tax (Rate), dated 30 September 2021, substituted the HSN 1209 entry with this sowing-use wording and made the change effective from 1 October 2021. The corresponding Union Territory tax notification carries the same date and effective date. A transaction from an earlier period should therefore not be evaluated automatically using the post-1 October 2021 wording; historical invoices require the schedule applicable at that time.

Intended use is the key distinction

Two seeds can look identical and still fall into different GST treatments because the supply is for a different purpose. The classification exercise should begin with what the buyer is acquiring the goods to do, supported by product documents and the applicable tariff description.

Supply situation How the HSN 1209 rule applies What to verify
Seed sold for planting or crop, vegetable, herb or flower sowing Falls within the described nil-rate entry when the goods and documentation support sowing use. Seed label, catalogue, technical specification, purchase order and invoice description.
Seed sold for food, oil, processing, feed or another non-sowing purpose Excluded from the HSN 1209 sowing entry. The actual end use and the tariff line applicable to that product.
Tamarind seeds expressly described by CBIC as meant for a use other than sowing The CBIC table shows a separate 5% line, displayed as 2.5% central tax plus 2.5% state or Union Territory tax. That the goods match the table’s tamarind and non-sowing description; this is an example, not a universal rate for every non-sowing seed.
Mixed-use lot, bundle or seed with an unclear purpose Not automatically covered by the nil-rate sowing entry. Composition of the lot, separate prices, packaging, intended use and classification advice.

The tamarind example demonstrates the boundary without creating a general rule. A 5% rate shown for the specifically described tamarind item cannot be transferred to every seed used for a non-sowing purpose. Non-sowing products can have different classifications and rates.

Is “nil-rated” the same as “GST-exempt”?

In everyday conversation, buyers and sellers often call a zero-rate supply “GST-exempt.” The official rate table uses the more precise term nil rate for the HSN 1209 sowing-seed line. Both descriptions communicate that no GST is charged at that listed rate, but “nil-rated under HSN 1209” is the clearest wording for an invoice, accounting record or classification discussion.

Do not infer other tax consequences from the 0% figure alone. Registration, invoicing, input-tax-credit treatment, returns and record-keeping can depend on the supplier’s status and the wider transaction. The rate entry answers the output-rate question; it does not decide every compliance issue connected with a business.

Examples of products that need careful checking

Vegetable, flower and field-crop packets

A packet labelled for planting—such as vegetable, flower, herb or field-crop seed—is the kind of physical product that commonly fits the sowing description. The label should identify the crop and planting purpose, and the invoice should describe the goods consistently. A retailer should retain catalogue or supplier information that supports that purpose rather than relying only on a short product name.

Treated, coated or processed seed

Treatment, coating, pelleting or other processing can raise a classification question that the general HSN 1209 wording does not resolve by itself. The fact that a product began as seed does not prove that every processed formulation remains within the same entry. Review the technical specification, treatment purpose, packaging and tariff schedule before applying the nil rate.

Food, oil and processing seeds

Seeds sold as edible ingredients, oil-bearing material, processing inputs or feed are not covered merely because they could theoretically germinate. The commercial purpose described in the order and supported by the goods is relevant. Applying 0% to a non-sowing supply creates a classification risk.

Bundles and mixed-use lots

A gift set, agricultural kit or bundle may contain several products with different descriptions. A mixed lot that combines sowing seed with non-sowing goods should not be treated as a single nil-rated item without examining how the bundle is supplied and classified. Separate descriptions and prices may be necessary, and a professional review is sensible where the treatment is material.

  1. Identify the physical goods. Record the botanical or commercial name, variety, quantity, form, treatment, packaging and any accompanying material. Keep the manufacturer’s specification or catalogue entry.
  2. Document the intended use. Look at the purchase order, contract, label and customer communication. State plainly whether the goods are supplied for sowing. If the documents conflict, resolve that conflict before invoicing.
  3. Check the tariff description. Compare the facts with the HSN 1209 wording, including the limitation to seeds “of a kind used for sowing.” Do not select HSN 1209 solely because the item name contains the word “seed.”
  4. Test the exclusion. Ask whether the goods are meant for food, oil, processing, feed or another non-sowing use. If so, the sowing entry is excluded and another classification must be considered.
  5. Review the current schedule. Confirm the rate applicable on the supply date and in the relevant tax schedule. The post-1 October 2021 wording comes from Notification No. 9/2021-Central Tax (Rate) and the matching Union Territory notification.
  6. Align the invoice. Use a description that reflects the established use, include the chosen HSN where required, and show the GST rate consistently with the classification. Preserve the documents that support the decision.
  7. Escalate uncertainty. For treated seed, mixed-use lots, bundled supplies, disputed invoices or significant amounts, obtain advice from a qualified Indian tax professional or seek the appropriate advance-classification route. The generic word “seed” is not enough to settle a difficult case.

What sellers and buyers should do

For sellers

  • Maintain product sheets, labels and purchase orders showing sowing purpose.
  • Use the same purpose-based wording in catalogues, quotations and invoices.
  • Separate sowing products from food, oil or processing products in inventory and billing systems where their classifications differ.
  • Do not copy a competitor’s or marketplace’s tax label without checking your own goods and documentation.
  • Recheck the applicable schedule when the product, packaging, treatment or customer use changes.

For buyers

  • Ask the supplier to identify the HSN and describe the goods as intended for sowing when that is factually correct.
  • Compare the invoice with the packet label and purchase order; an inconsistent description can complicate a later review.
  • Request clarification if a seller applies 0% to a seed purchased for food, oil or another non-sowing purpose.
  • Keep the invoice and product documents together, especially for business purchases or agricultural records.

Frequent mistakes to avoid

“Every seed is GST-free”

This is the central error. The official entry is limited to sowing seed and expressly excludes other uses.

“The marketplace title decides the rate”

Online titles can be abbreviated, inconsistent or written for marketing. Classification should follow the actual goods, intended use and tariff wording.

“The tamarind rate applies to all other-use seeds”

The 5% figure in the CBIC table is attached to the specifically described tamarind-seed item. It is an illustration of a separate line, not a universal rate for every non-sowing seed.

“A zero rate settles every compliance question”

The nil rate answers the GST-rate classification for the qualifying entry. It does not, by itself, resolve registration, documentation, credit or return obligations.

“The 2021 wording can be ignored”

The wording and effective date matter when comparing old invoices or correcting a historical transaction. Use the schedule that applied to the relevant period.

Why the answer can differ for a specific product

The official material establishes the sowing-use rule but does not decide every variety, treatment, mixed-use lot or bundle. A product may require facts that are absent from a generic description: whether it is viable seed, how it is prepared, what the contract says, whether several goods are supplied together and which tariff heading best describes the finished product.

Accordingly, “HSN 1209, nil-rated” is a defensible answer for a qualifying sowing-seed supply, not a shortcut for every item sold under a seed-related name. When the facts are uncertain, record the uncertainty, obtain the missing specifications and check the current schedule before charging or reporting GST.

Historical and jurisdictional note

Notification No. 9/2021-Central Tax (Rate) is a Central Tax notification. Notification No. 9/2021-Union Territory Tax (Rate), also dated 30 September 2021, carries the corresponding Union Territory treatment and effective date of 1 October 2021. The CBIC rate table presents the HSN 1209 sowing entry in the GST schedule used for these supplies. The exact tax components shown on an invoice depend on the nature and location of the transaction, so the applicable schedule should be checked rather than inferred from a product label.

For a current invoice in India, the practical test remains straightforward: establish that the goods are seeds of a kind used for sowing, verify that the transaction is not for another use, and retain evidence supporting that conclusion. If either point cannot be demonstrated, the nil-rate entry should not be assumed.
