Are ROMs You Own Legal to Download? U.S. Copyright and Backup Rules

In the United States, owning a game cartridge or disc does not automatically make it legal to download a ROM of that game from an unauthorized website. Copyright law generally reserves copying and distribution rights to the copyright owner. A limited computer-program exception allows certain copies in specific circumstances, but it is not blanket permission to download any ROM. Rules differ outside the U.S.

Why owning the cartridge is not the same as owning the copyright

A cartridge or disc is a copy of a game, not ownership of the copyright in the game. Under 17 U.S.C. § 106, the copyright owner has exclusive rights that include reproducing the work and distributing copies, subject to statutory limitations. Owning one lawful copy does not, by itself, authorize making or obtaining another.

That distinction matters when a ROM comes from a third-party site. The download creates a separate copy; whether the source is authorized and whether a specific legal exception applies are relevant. Simply showing that you own the original does not resolve those questions.

What the computer-program backup rule allows

17 U.S.C. § 117 gives the owner of a copy of a computer program limited permission to make or authorize another copy or adaptation in defined circumstances. It covers a copy that is an essential step in using the program with a machine, when used in no other manner, and an archival copy made solely for preservation. If continued possession of the program ceases to be rightful, an archival copy must be destroyed.

The statute also limits transfer: an exact copy prepared under § 117 may be transferred only with all rights in the program. An adaptation has an additional authorization condition. The text does not say that every personal copy, every cartridge dump, or every ROM obtained online qualifies. Whether a particular console game, license, copying method, and purpose fits the statute depends on its circumstances; § 117 is not a blanket “I own it, so any download is legal” rule.

How common ROM situations differ

Situation What the U.S. rules establish
Download a ROM from an unknown or unauthorized site while owning the original Ownership alone does not establish authorization for the separate copy. The reproduction right and any applicable exception must be considered.
Make a copy from a program copy you own Section 117 allows only defined essential-use and archival copies, subject to its conditions; it does not declare all personal copying lawful.
Bypass a game’s access control This raises a separate anti-circumvention question under § 1201. A copying exception does not automatically answer it.
Preserve a game through an eligible institution Specific regulatory permissions apply to eligible libraries, archives, or museums under institutional, purpose, and access conditions.
Download a game because it is old, abandoned, or out of print Those circumstances alone do not make a game free to download. The preservation rules are limited, not a general consumer permission.

ROM copying and bypassing access controls are separate issues

Section 1201 generally prohibits circumventing technological measures that control access to copyrighted works. The Copyright Office adopts limited, temporary exemptions through periodic rulemaking; an exemption for a particular circumvention purpose does not create a general right to copy or distribute the game.

The current rule, 37 C.F.R. § 201.40, includes a narrow allowance for certain lawfully acquired complete games when external authentication-server support has ceased, for restoring personal local gameplay. The regulation defines server access as ceased when the owner or authorized representative affirmatively says support has ended and is unavailable, or when support has been discontinued for at least six months and has not since been restored. “Local gameplay” means play on a personal computer or console, or locally connected computers or consoles, rather than through an online service or facility.

Other provisions cover preservation by eligible libraries, archives, or museums, with restrictions on purpose and access. A separate institutional provision concerns certain games that no longer require an external server and are no longer reasonably available commercially. These narrowly defined exemptions do not authorize consumers generally to download any ROM or share one online.

The Copyright Office records the final rule for the 2024 proceeding as dated October 28, 2024, on its Ninth Triennial Section 1201 Proceeding page. The Office’s Tenth Triennial Section 1201 Proceeding page says the current exemptions, if renewed, would continue from October 2027 to October 2030; the renewal proceeding is active as of October 4, 2026. Because these exemptions are temporary and specific, check the current rule for the relevant activity and date.

What to take away if you own the game

  • Owning the physical game is not the same as owning its copyright. It does not automatically authorize a ROM download from another source.
  • Section 117 is conditional. It covers defined essential-use and archival copies, not every backup method or third-party download.
  • Access-control circumvention is a distinct legal question. Limited exemptions do not amount to general permission to copy or distribute games.
  • Jurisdiction matters. This explanation covers U.S. federal law; other countries may apply different rules.

This is general information about U.S. law, not legal advice for a particular game or situation.
