Short answer: A retro handheld’s preloaded ROMs are not automatically legal merely because they came with the device. In the United States, the answer depends on the particular game, who made and supplied the file, whether the rights holder authorized that distribution, how the copy was obtained, whether any access-control circumvention was involved, and which jurisdiction’s law applies. Owning the hardware does not by itself prove that every included game file was lawfully distributed.
This is a U.S. federal-law baseline, not a country-neutral answer or a legal opinion about a particular listing. The federal sources discussed here do not establish that any specific seller’s collection is authorized.

Why the handheld and its ROMs are legally separate
A retro handheld is a physical computer. The games stored on its internal memory or microSD card are separate copies of software and other copyrighted expression. The Copyright Act says copyright subsists in original works fixed in a tangible medium and covers categories that commonly appear in games, including computer-program code, audiovisual artwork, music and written elements. The statutory framework is in the U.S. Copyright Office’s text of Title 17, including sections 102 and 117: https://www.copyright.gov/title17/92chap1.html.

That separation matters. A seller can own or lawfully sell a shell, screen and circuit board without having permission to reproduce and distribute every game on the storage card. A product description saying “thousands of games included” is a marketing statement, not evidence of a license. To evaluate the files, you need evidence about the titles, the source of each copy and the distributor’s authority.

What U.S. copyright law actually allows for program copies
Section 117 is often cited in ROM discussions, but it is narrower than the slogan “if you own the game, you can download any ROM.” The Copyright Office’s statutory text states:
“Notwithstanding the provisions of section 106, it is not an infringement for the owner of a copy of a computer program to make or authorize the making of another copy or adaptation of that computer program provided:”
The conditions immediately following that sentence limit the exception to two situations:
- A copy or adaptation is an essential step in using the program with a machine and is used in no other manner; or
- The copy is made solely for archival purposes, with all archival copies destroyed if possession of the program ceases to be rightful.
The statute also restricts transfers. An exact additional copy made under section 117 may be transferred only with the original copy and as part of transferring all rights in the program. An adaptation may be transferred only with authorization from the copyright owner. Those rules appear in the same Title 17 text: https://www.copyright.gov/title17/92chap1.html.
Section 117 therefore does not create a general commercial exception for a vendor to copy a library of games onto every handheld it sells. It also does not automatically authorize downloading a ROM made by an unrelated website. Whether a person’s own copy-making activity fits the statute is fact-specific: the source copy, the purpose, the way the copy is used and whether possession remains rightful all matter.
Does owning the original cartridge or disc make a downloaded ROM legal?
Ownership of an original game can be relevant to a person’s individual archival or essential-use analysis, but it is not a universal pass for obtaining a file from an unconnected source. Section 117 speaks about the “owner of a copy” making or authorizing another copy under stated conditions. It does not say that buying one cartridge gives a person permission to receive a vendor’s pre-made image, nor does it erase restrictions on distribution.

There are two separate questions:
- Copying: Did the person who created the ROM have a qualifying copy and a purpose covered by section 117?
- Distribution: Was the file supplied to the buyer with the copyright owner’s authorization, or under a specific legal exception?
A buyer usually cannot verify those facts merely by possessing the same title on an old cartridge. The safest conclusion is qualified: owning an original may support a particular personal-copy argument, but it does not establish that a bundled file from an unknown source was lawfully made or distributed.

Copyright and anti-circumvention are related but distinct. Section 1201 of the Digital Millennium Copyright Act generally prohibits circumventing a technological measure that controls access to a copyrighted work, including games and computer software. The Copyright Office explains the rule and its triennial exemption process in its 2024 proceeding: https://copyright.gov/1201/2024/.
A limited exemption does not automatically grant every other right. An exemption might address circumvention in a particular situation while leaving reproduction, distribution or public performance questions governed by ordinary copyright rules. Conversely, a person might have a copyright-based reason to make a copy but still face a separate anti-circumvention issue if an access control had to be bypassed.
The current regulation contains narrow video-game provisions, including preservation circumstances for eligible libraries, archives and museums. The regulation imposes conditions such as lawful acquisition, institutional eligibility, noncommercial purpose and restrictions on access or distribution. The text is at https://www.copyright.gov/title37/201/37cfr201-40.html. Those institution-specific provisions should not be presented as a general entitlement for a consumer who buys a handheld.
Does using an emulator change the answer?
An emulator is software that imitates a console or computer platform. The legality of that emulator and the legality of a particular game file are separate questions. The sources here establish copyright and anti-circumvention principles; they do not classify every emulator, firmware package or ROM distribution service.

How to assess a specific handheld listing
Before buying or using a bundled collection, look for evidence rather than relying on the number of games advertised. This checklist separates the issues that can be investigated from conclusions that require legal advice.
| Question | Evidence to look for | Why it matters |
|---|---|---|
| Authorization | A named licence, rights-holder statement or other documentation covering each included title | Distribution permission is title-specific; a generic “licensed games” claim may not identify the rights granted. |
| Copy source | Who created the files, from which media, and under what authority | A buyer’s ownership of hardware does not establish the provenance of a preloaded file. |
| Jurisdiction | The buyer’s country, seller’s country and terms governing the transaction | Copyright exceptions and anti-circumvention rules differ by country; this article describes U.S. federal law. |
| Circumvention | Whether obtaining or running the files requires bypassing an access control | Section 1201 can apply independently of ordinary copying and distribution analysis. |
| Exception scope | Whether the activity fits a specific personal-copy rule or an institutional preservation provision | Narrow exceptions have conditions and do not become broad consumer permissions. |
If the seller will not identify the rights holder or licence for the included commercial titles, you have no reliable basis to treat the collection as authorized. That is an evidence problem, not proof of infringement in every individual case.

A handheld arrives with commercial games already installed
Preinstallation changes convenience, not the underlying rights analysis. The seller still needs authority to reproduce and distribute the files. Treat the games as legally unresolved unless the seller provides credible title-by-title authorization or the games are clearly released under terms permitting that distribution.
You own the cartridge and download an image from a forum
Your ownership may be relevant to a personal archival-copy argument, but the forum’s file may have been made and distributed by someone who lacked authority. Section 117 does not automatically bless an unrelated download, and any circumvention needed to extract or use the data can raise a separate section 1201 issue.
You dump your own cartridge for personal use
This is closer to the type of fact pattern section 117 addresses, but the statute’s conditions still matter. The copy must fit the essential-step or archival language, and archival copies must be destroyed when continued possession of the program ceases to be rightful. The statute should be read as written rather than reduced to “personal use is always legal.”
The games are homebrew, public-domain works or openly licensed releases
Those files may have different rights status, but the applicable licence or public-domain basis must actually cover copying and distribution. A seller’s label alone is not enough; check the release terms and whether the included version matches them.

A museum or archive preserves a game
The current regulation includes narrowly defined institutional preservation exemptions. Eligibility, lawful acquisition, noncommercial purpose and access restrictions all matter. A consumer cannot assume that an exemption written for a qualifying institution applies to a retail handheld.

Steps to reduce legal uncertainty before using the files
- Identify the titles. Save the product page, the included-game list and the seller’s legal or licensing statements. “Thousands” without a title list cannot be checked.
- Ask for authorization evidence. Request the rights holder, licence scope and territories for commercial titles. Keep the response and the date.
- Check the source of the storage card. Determine whether the seller supplied the files, whether a third party created the card, or whether the device merely supports user-supplied software.
- Separate authorized files from uncertain ones. Do not assume that one legitimate homebrew title makes the rest of the collection legitimate.
- Avoid circumvention unless a specific exemption clearly applies. Read the current regulation rather than relying on an old forum explanation; exemptions are limited and can change through the triennial process.
- Consider your jurisdiction. If you are outside the United States, consult the law and official guidance for your country. The U.S. rules summarized here may not control your conduct.
- Get qualified advice for a high-stakes situation. A lawyer who handles copyright or technology law can assess the exact titles, conduct and jurisdiction; a generic internet statement cannot.
What buyers should and should not infer from marketing language
- “Built-in games” describes a feature, not a licence.
- “No additional downloads needed” says nothing about who authorized the copies.
- “Works with thousands of ROMs” may refer to technical compatibility rather than permission to distribute or use particular files.
- “Backup included” is not a statutory conclusion; section 117’s archival language has specific conditions.
- “Legal in our country” should be treated cautiously unless the seller identifies the law, rights holder and scope of authorization. The buyer’s jurisdiction may differ.
Bottom line for a U.S. buyer
There is no blanket rule that ROMs included with a retro handheld are legal, and no blanket rule that every ROM used with an emulator is illegal. The decisive facts are authorization for each title, the provenance of the files, the copying and distribution conduct, any circumvention of access controls and the governing jurisdiction. Section 117 provides limited conditions for certain copies or adaptations owned by the copier; it is not a general commercial-ROM distribution licence. Section 1201 adds a separate anti-circumvention layer, while current exemptions remain narrow and conditional.
Frequently Asked Questions
If the seller says the ROMs are “free,” is that enough?
No. “Free” can describe price, not copyright permission. Look for a licence or rights-holder authorization covering the specific titles and the seller’s distribution.
Can I keep an archival copy after selling the original game?
Section 117 says an archival copy must be destroyed when continued possession of the program ceases to be rightful. Whether that condition is met in a particular transaction is fact-specific.
Are the rules the same outside the United States?
Not necessarily. This explanation uses U.S. federal sources. Other countries may define copying, private use and circumvention differently, so apply the law where the relevant conduct occurs.
