There is no reliable nationwide yes-or-no answer for every prediction market. The U.S. Commodity Futures Trading Commission (CFTC) says federally regulated prediction markets can operate in all 50 states, while state authorities dispute federal authority over some contracts, especially sports-related ones. The disagreement is playing out in litigation, so legality can depend on where you are, which platform you use, and what event contract you want to trade.

Why the answer depends on your location, platform, and contract

Prediction markets offer event contracts: financial contracts whose value or payout depends on whether a specified event happens. The federal framework does not make every possible contract automatically permissible. Under the Commodity Exchange Act, the CFTC can prohibit certain event contracts after determining that they are contrary to the public interest.

For contracts listed on designated contract markets (DCMs), the CFTC describes requirements that include exchange listing procedures, monitoring, and measures to guard against manipulation. Its March 12, 2026 staff advisory reminded DCMs of their obligations under the Commodity Exchange Act and Commission regulations. A platform’s description of its own regulatory status is a starting point, not a complete answer about a particular contract or state-law challenge.

Contract categories can raise different questions. Sports-related contracts are at the center of a prominent federal-state dispute; election and other event contracts can also face legal or regulatory scrutiny. Check the rules and settlement criteria for the specific contract, not just the platform’s general description of its markets.

What federal and state authorities say

The federal-state disagreement is not settled by either side’s public statements. These are the positions and actions described in the relevant sources—not a final nationwide ruling on every platform and contract.

Authority or source What it says or has done What that does not establish
CFTC consumer guidance The CFTC says federally regulated prediction markets can operate in all 50 states. That statement does not resolve every state-law dispute or determine the status of every operator and contract.
CFTC litigation, April 9, 2026 The CFTC said it filed complaints against Arizona, Connecticut, and Illinois, seeking declarations that federal law gives it exclusive authority and injunctions against state enforcement. A complaint records the agency’s position; it is not a final judgment that state laws are preempted.
State attorneys general, as described by Maryland’s Attorney General A coalition of 41 attorneys general urged the CFTC to recognize state authority over sports-related event contracts. The coalition’s comment is an advocacy position, not a court ruling.

The CFTC’s Federal Register notice on “Prediction Markets; Public Interest Determinations” describes the listing framework and the Commission’s authority over certain event contracts. It also recounts that the CFTC withdrew its 2024 proposed event-contract rules in February 2026 and sought information about significant issues and possible future agency action. Proposals and requests for information are not final regulations.

What the state-policy snapshot does—and does not—show

Pew Research Center reported on June 23, 2026, that at least 16 states had attempted to regulate prediction markets in 2026. Its account describes bills and other activity through June; it does not mean that 16 states enacted bans. Pew also reported at least 12 states had related bills pending and at least four had such bills fail as of that snapshot. Its map omits executive actions, and the article notes that states may have additional pending or failed bills.

The same Pew roundup discusses legislation in Kentucky and Tennessee and executive orders in Maryland and New York addressing state employees’ use of prediction markets. Those examples are a dated account, not a complete or current directory of state rules. To determine what applies today, check the enacted text and any later executive action, regulator notice, or court order in the relevant jurisdiction.

How to check the rules where you live

  1. Pin down the jurisdiction. Identify your country, state, and, where relevant, locality. Do not assume a neighboring state has the same rules. The federal and state discussion here concerns the United States; it does not establish rules for U.S. territories, tribal jurisdictions, or other countries.
  2. Identify the exact operator and exchange. Find the platform’s legal entity and the exchange listing the contracts. Check official CFTC materials to see whether the relevant exchange is registered as a DCM. CFTC educational guidance explains the framework. Registration does not settle every state-law question.
  3. Read the exact contract terms. Note the event category, what counts as the outcome, how and when the contract settles, and any restrictions in the platform’s rules. Do not assume that one contract’s treatment applies to all markets on the same platform.
  4. Check primary state sources. Search the state gaming regulator and attorney general for current notices, enforcement actions, or guidance. Read the official statute and regulations for enacted language; a bill, headline, or proposal alone is not proof that a rule is in force.
  5. Check the status of relevant cases. Look for official court opinions, docket entries, and orders. Distinguish a complaint or agency announcement from a temporary injunction, a final judgment, or an appeal. A court order may be limited to particular parties or circumstances.
  6. Recheck before opening an account or trading. Agency actions, legislation, court decisions, and platform location policies can change. A platform’s decision to allow or block access is useful operational information, but it is not itself a definitive ruling on local law.

What you can conclude from a general answer

A broad claim that prediction markets are simply “legal everywhere” or “illegal in your state” may obscure the relevant distinctions. The CFTC’s all-50-states statement is its position on federally regulated markets; state authorities have challenged that position for some contracts, and the CFTC’s complaints do not themselves settle those disputes. A specific answer requires current sources for the reader’s jurisdiction, operator, and contract.

If you are outside the United States, or need an answer for a territory, tribal jurisdiction, or a particular locality not covered by the sources above, this account does not establish the applicable rule. Consult the relevant regulator’s official materials or a qualified local lawyer.
