Are Prediction Markets Gambling? U.S. Legal Status and Consumer Risks

Sometimes they can look and feel like gambling, but there is no settled, nationwide legal answer for every prediction market. A contract that pays based on an uncertain event can resemble a wager. The CFTC treats event contracts on registered markets as derivatives within its regulatory remit, while states and some courts argue that particular contracts—especially those tied to sports—are subject to state gambling laws. The answer depends on the contract, operator, jurisdiction and status of litigation.

This article focuses on the United States. The court developments below reflect reporting through October 8, 2026; the dispute is active, so the legal position may change.

How do prediction markets work?

A prediction-market event contract is a financial contract whose value depends on the outcome of an event. A user typically buys a “yes” or “no” position. The market price can reflect traders’ perceived probability of the outcome, and users may be able to sell or otherwise exit a position before the event is settled. The contract rules—not the price alone—determine the payout and how the outcome is established.

The CFTC describes two possible uses. A business or individual might use a contract to hedge a real-world risk: its example is a citrus farmer using a weather contract to offset losses from a freeze. A trader might instead speculate, taking a position in hopes of profiting from a price change or event outcome. Those uses can differ, but neither by itself settles whether a particular consumer-facing contract is gambling under state law.

A market price is not a promise that an event will happen. It reflects the market’s perceived probability at that time, and it can change as people trade or new information emerges.

Are prediction markets gambling?

There are two separate questions behind that phrase:

  • Does the transaction resemble betting? If a person risks money on a yes-or-no outcome and receives a payout only if the position is correct, the experience can resemble a wager.
  • Which laws and regulator apply? That is contested. The CFTC describes event contracts on registered markets as derivatives and asserts federal authority over those markets. States have argued that some contracts, particularly sports-related ones, are gambling regulated by state law.

So “it feels like betting” and “it is legally classified as gambling” are not interchangeable conclusions. Classification can depend on the specific contract and operator as well as the state and the current legal proceedings. The CFTC’s position is an agency position; it is not a final nationwide court ruling resolving the dispute.

Are prediction markets legal in the U.S.?

There is no single answer that covers every U.S. platform and contract. The CFTC claims exclusive authority over registered event-contract markets, while states have challenged that position for some products. Courts have reached different outcomes, and the dispute remains unsettled.

What the CFTC has argued

In a February 17, 2026 appellate filing, the CFTC asserted that it has exclusive jurisdiction over U.S. commodity derivatives markets, including event-contract markets. On April 24, 2026, it sued New York seeking a declaration of exclusive federal authority and an injunction against state gambling-law enforcement against CFTC-registered markets. The lawsuit requested relief; it was not itself a final ruling in the CFTC’s favor.

What courts had decided by October 8, 2026

On April 10, 2026, the Associated Press reported that a federal judge temporarily barred Arizona from enforcing gambling laws against prediction-market operators and paused the state’s criminal case against Kalshi. The preliminary ruling found that the CFTC had sufficiently shown that event contracts came within the Commodity Exchange Act’s definition of swaps and had a reasonable chance of establishing preemption. It was temporary and did not establish a nationwide rule.

In an October 8, 2026 report, the Associated Press described a split among appeals courts: the 6th and 9th Circuits had ruled for states seeking to regulate prediction markets, while the 3rd Circuit had agreed with Kalshi. The report also said the NFL urged the Supreme Court to resolve the issue. These are developments reported as of that date, not a final nationwide resolution.

A proposed CFTC review process is not a final rule

A 2026 Federal Register publication described a CFTC proposal on how the Commission would decide whether event contracts are contrary to the public interest under the Commodity Exchange Act. Proposed elements included definitions related to whether an event “involves” an enumerated activity and “gaming,” factors for public-interest review, and a proposed 90-day review period for self-certified contracts. Because this was a proposal, readers should not treat those proposed procedures as operative law unless and until they are finalized.

Are prediction markets the same as sports betting?

Not necessarily. Prediction markets commonly present trades as event contracts, while sports betting is generally offered as a wager through a licensed sportsbook under applicable state rules. But terminology alone does not resolve the legal question: states and federal regulators dispute how some sports-related event contracts should be classified.

Rules and protections can vary by operator and jurisdiction. The available legal developments do not establish a comprehensive, platform-by-platform comparison of age limits, access rules, fees, consumer recourse or responsible-gambling safeguards. It would be misleading to assume that one category is always safer or more protective than the other. Check the actual operator, contract and rules that apply where you live.

Can you lose money on prediction markets?

Yes. A position can lose value before settlement, and an outcome that goes against the contract position can result in a loss under the contract rules. Fees and other costs can also affect the result. The CFTC cautions: “As is the case in all kinds of markets, participating carries some financial risk.” Do not treat an implied probability, a displayed price or a possible payout as a guaranteed forecast or profit.

How do prediction-market contracts settle?

Settlement depends on the contract’s written terms. Before taking a position, identify the exact event and outcome covered, the source or process used to determine the result, and what the rules say if the event is postponed, disputed or ambiguous. Also check whether you can exit before settlement and how the price at that time affects your proceeds. A market price may change; the contract’s settlement criteria determine the final outcome.

Are prediction markets regulated?

The CFTC says registered event-contract markets fall within its regulatory remit and claims exclusive authority over them. It describes regulated exchange duties to monitor trading for manipulation and insider trading, as well as customer-protection rules for futures commission merchants. These are described regulatory requirements, not a guarantee that misconduct cannot occur or that every consumer risk is covered. State authority over some sports-related contracts is being contested in court.

For consumers, the operator’s registration and the legal entity behind the service are important facts to verify. Registration does not guarantee a profit or settle the broader dispute about how a particular contract is classified under state law.

What to check before trading

The CFTC advises customers to understand risks, obligations, commissions, fees, penalties and other costs; the contract terms and payout; and how, and by whom, settlement is determined. Use this checklist before funding an account:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • What precise event and outcome does the contract cover?
  • Which source or process determines settlement? What happens if the event is postponed, disputed or unclear?
  • What is the payout, and what fees or other costs apply?
  • Can you exit before settlement, and how is the then-current market price used?
  • Which legal entity operates the market, and is it registered with the relevant regulator?
  • What do the account agreement and withdrawal rules say? Can you access your funds under those terms?
  • Do you understand the amount you could lose?
  • Are you using the operator’s authentic website or app? The CFTC advises following links from the trading website and checking registration.

Keep readable copies of the account agreement and statements. These checks can clarify the product and its terms; they cannot guarantee an outcome or resolve unsettled law.
