Are Prediction Market Contracts Legal Where You Live? What to Check Before Trading

It depends on where you are, what the contract asks, and which legal entity operates the platform. A platform’s use of “prediction market” or “event contract” does not settle whether local authorities treat a product as a financial derivative, a bet, or both. Check the rules for your country and state or province, the exact contract, and the operator’s authorization before funding an account.

Why there is no single yes-or-no answer

Prediction market contracts do not have one legal status worldwide. Depending on the jurisdiction and contract, financial-market rules, gambling laws, or both may apply. Even contracts on the same platform can raise different classification questions because the event and settlement terms differ.

Three questions matter: where you are trading, what the contract concerns, and which legal entity is offering it. Authorization in one country—or a platform’s own description of its product—does not automatically establish permission to offer every contract to every customer elsewhere.

The examples below illustrate how regulators and governments have approached the issue; they are not a complete survey of every country. They also reflect statements and actions on the dates given, not a personal legal determination or a guarantee that a rule or case has not since changed.

What do current jurisdiction examples show?

Jurisdiction What the cited authority says What that means for a trader
United States The CFTC consumer page says prediction markets are federally regulated and, under federal law, can operate in all 50 states. The agency recommends using registered entities and checking the rules for the specific market and contract. This is the CFTC’s position, not a final court ruling resolving every state-law dispute. Check the operator’s registration, your state’s current notices and restrictions, the exact contract, and the status of relevant litigation. Do not assume every contract is lawful in every state.
European Union On July 3, 2026, ESMA said classification depends on the event question: a contract may be a financial instrument and may also qualify as a bet under national gambling law. If it is a financial instrument, ESMA says it is a derivative and, because of its binary outcome, falls within existing national measures prohibiting the marketing, distribution, or sale of binary options to retail clients. Distribution of event contracts that qualify as financial instruments requires investment-firm authorization, including distribution only to non-retail clients. Check the rules and competent authority in the particular member state, including whether a national binary-options measure covers the contract and whether the distributor is authorized.
Great Britain A UK Parliament answer dated September 8, 2026 says a prediction market would need a Gambling Commission licence to operate in Great Britain. If approved, it would be classified as a “Betting Intermediary” and regulated under the Gambling Act 2005. Check the operator’s Gambling Commission licensing status for Great Britain. This statement is specifically about Great Britain; it should not be extended to Northern Ireland.
Canada On August 27, 2026, the Canadian Securities Administrators and CIRO said sports- and entertainment-based event contracts should not be regulated under securities and derivatives legislation; they were still assessing other types. Their notice also said two CIRO dealer members had authorization to facilitate a limited set of event contracts, subject to terms and possible future restrictions. Do not read the securities regulators’ statement as a country-wide finding that sports or entertainment contracts are lawful under every other applicable law. Check the relevant provincial or territorial authorities and the specific product.
British Columbia Separately, the province’s Independent Gambling Control Office said sports- and entertainment-outcome products are gambling under current provincial legislation and must be regulated under the Criminal Code of Canada and provincial gaming legislation. It identified BCLC’s PlayNow.com as the only permitted commercial online gambling site in BC and said other online gambling websites accessible to BC players, including sites offering sports or entertainment event contracts, operate illegally in the province. This is a British Columbia-specific gambling regulator statement, not a conclusion about every province or every event contract in Canada.

The U.S. federal-state dispute is not settled by a registration label

The CFTC says it has jurisdiction over registered markets. In February 2026, it filed an amicus brief in a Ninth Circuit case asserting exclusive jurisdiction over CFTC-registered commodity derivative markets, including prediction markets. In April 2026, it filed lawsuits challenging actions by Arizona, Connecticut, and Illinois against CFTC-registered designated contract markets. Those filings describe the agency’s position and ongoing litigation; they are not a final nationwide resolution of all state-law disputes. Check current case status and state regulator notices before relying on a past statement or platform access.

The CFTC’s March 16, 2026 advance notice of proposed rulemaking says event contracts may fall within Commodity Exchange Act definitions of swaps or futures, and that a market offering swaps or futures to the general public must register with the CFTC as a designated contract market. This is an advance notice requesting comment, not a final rule. It also describes shared CFTC and SEC jurisdiction over mixed swaps and security futures, and sole SEC jurisdiction over security-based swaps. The applicable category depends on the product; not all event contracts fall into one category.

The CFTC’s 2026 notice reports that designated contract markets certified approximately 1,600 event contracts for listing in 2025, compared with an average of approximately five contracts annually from 2006 through 2020. These are certified listings, not trading volume, user numbers, or proof that each contract is approved in every jurisdiction.

How to check whether you can trade a specific contract

  1. Pin down your location. Identify your country and state, province, territory, or other relevant subnational jurisdiction. Check rules tied to where you are physically located as well as where you reside if the regulator or platform distinguishes them.
  2. Identify the exact event and contract. Note whether it concerns sports, elections, economics, politics, entertainment, or something else. Do not assume that every contract offered by one platform is classified the same way.
  3. Find the legal operator. Read the customer agreement to identify the entity actually providing the service. Search the relevant local financial-market and gambling regulator registers, and check current warning or enforcement notices. A brand name, app-store listing, or registration in another country is not a substitute. The CFTC advises users to use registered entities and verify that an app is linked from the platform’s official website.
  4. Confirm that both the product and customer are eligible. Check whether the exact contract may be offered to your customer type and through that method of distribution. In the EU, check national binary-options measures if the contract qualifies as a financial instrument; in Great Britain, check Gambling Commission licensing; in British Columbia, take account of the IGCO’s specific statement.
  5. Read the contract specification before placing an order. Check the question wording, resolution source, deadline, settlement process, who makes the determination, and what happens if information is delayed, disputed, or unavailable. The CFTC says customers are entitled to transparent information about contract rules and settlement.
  6. Check fees, account terms, and exit arrangements. Review trading fees, commissions, penalties, withdrawals, counterparty arrangements, and whether you can close an open position before settlement. Do not assume there will be enough liquidity for an easy exit.
  7. Verify protections and complaint routes. Find out how customer funds are held, how disputes are handled, and which regulator or exchange accepts complaints. For U.S. customers, the CFTC identifies the broker, designated contract market, NFA, and CFTC as possible complaint routes.
  8. Pause if the answer remains unclear. Ask the relevant regulator or a lawyer qualified in your jurisdiction before depositing money. Do not use a VPN or false location details to bypass a platform restriction; that is not an established lawful workaround.

What should you look for in settlement terms and risk disclosures?

A contract’s outcome can depend on details that are easy to miss in a headline. For example, “Will an event happen?” is not enough to tell you which source controls, what deadline applies, or how the platform handles conflicting reports. Read the specification for the precise condition that produces each payout and who decides whether it has been met.

“You are entitled to timely, transparent information about event contracts, including trading rules and contract terms (e.g., payout, prices, and how settlement determinations will be made, who decides, and how).”

That is the CFTC’s wording in its consumer guidance. Also check every stated cost and the possibility of losing the full amount at risk. The CFTC advises customers to trade only with risk capital and warns that users of unregistered entities operating outside the United States may have little or no protection. These are U.S. agency warnings; they do not determine the protections available under another jurisdiction’s law.

A separate CFTC staff advisory dated August 12, 2026 addresses “mention market” contracts—contracts settled on whether a person says or mentions particular words, attends or appears at an event, or otherwise interacts with another person. It says: “These contract types present a heightened risk of manipulation because their settlement turns on the discrete conduct of a person that may be neither independently generated nor externally verifiable.” The advisory concerns that specific contract type; it is not a blanket finding about all event contracts.

How does an event contract compare with a locally licensed alternative?

A locally licensed sportsbook or other regulated product may have a different regulator, legal classification, and customer-protection framework from an event contract. Compare the actual rules rather than assuming the products are legally or economically equivalent.

  • Authorization: Which regulator authorizes the operator, and does that authorization cover this product and location?
  • Product classification: Is the product treated as a derivative, a bet, or potentially both under different laws?
  • Eligibility: Are this event category and your type of customer permitted?
  • Settlement and disputes: What source determines the outcome, and what process applies if it is disputed?
  • Costs and exit: What fees apply, and can you close a position before settlement?
  • Customer recourse: What protections and complaint routes are available if there is a problem?
