Are Personalized Sports Betting Promotions Legal? How to Opt Out

Personalized sports betting promotions are not categorically legal or illegal across the United States. The rules depend on your state, whether you are self-excluded or otherwise barred, how the promotion reaches you, and what the offer says. You can usually start by changing the sportsbook’s marketing settings and opting out through the message itself, but those steps may not stop advertising on every channel. Self-exclusion is a separate process that restricts gambling access.

When can a sportsbook send personalized promotions?

There is no single nationwide rule that answers this for every sportsbook and every kind of promotion. State gaming rules may restrict marketing to people who are self-excluded or otherwise prohibited from betting; other laws address direct-ad opt-outs, targeted advertising, or the terms an offer must disclose. A rule applying to one channel or one state should not be treated as a nationwide ban or a universal right to stop all targeted ads.

Offer content also matters. Missouri’s constitution, for example, requires sports betting ads not to target minors or be false, misleading, or deceptive, and requires material offer terms to be clearly and conspicuously disclosed. That requirement concerns the ad and its terms; it does not establish that every personalized offer is unlawful.

Which opt-out applies to the promotion you received?

Choose a route based on the channel and what you want stopped. An email unsubscribe does not necessarily turn off texts, in-app offers, or ads personalized across other services. An account preference is not the same as a legal privacy request, and neither is the same as self-exclusion.

Route What it can address Scope and effect
Sportsbook marketing settings or a written request Promotional communications and personalization options the operator makes available Typically concerns that operator’s communications; available controls and channels vary by operator. This is a practical first step, not a claim that every state requires the same account controls.
Email unsubscribe Commercial promotional email Federal CAN-SPAM guidance requires a clear opt-out method and says senders generally must honor requests within 10 business days. It does not create a universal opt-out for every kind of targeted advertising.
State privacy-law opt-out Targeted advertising or other covered data uses Availability, eligibility, and scope depend on the state law and your circumstances; it may reach beyond one sportsbook’s email list.
Self-exclusion Access to gambling, with related marketing restrictions under some state rules A formal gambling restriction, not just an advertising preference. Follow the state regulator’s enrollment process and terms.

How to stop sportsbook promotions

  1. Identify the sender and channel. Save the operator’s name, the date, the message or ad, and any offer terms. This helps distinguish an operator’s direct marketing from an ad served by another platform.
  2. Review the account controls. In the sportsbook app or website, look for marketing, communication, privacy, or advertising preferences. Turn off promotional messages and personalized-ad options that are offered. Labels and available controls differ by operator.
  3. Unsubscribe from promotional email. Use the email’s unsubscribe or opt-out mechanism. The FTC’s CAN-SPAM guidance says commercial email opt-outs generally must be honored within 10 business days. Keep the confirmation or a copy of your request.
  4. Request that texts, calls, or direct mail stop. Use a stated preference control if available, then contact the sportsbook through its official support or privacy channel. Ask it to suppress the relevant phone number, email address, mailing address, or account from direct-marketing lists. Keep a copy of the request and any reply.
  5. For ads beyond the sportsbook’s messages, check privacy options. Review your state privacy regulator’s instructions and relevant browser or device advertising settings. Some state laws provide a targeted-ad opt-out that is distinct from an operator’s marketing preferences.
  6. If you want to stop betting, use self-exclusion. Find your state gambling regulator’s official process and check its terms. Turning off marketing does not itself block access to betting.

If a message looks suspicious, do not use its links to reach the operator. Open the official app or type the sportsbook’s known website address yourself before contacting support.

What do state rules say about self-excluded bettors and direct marketing?

The examples below illustrate different state-specific rules; they are not a survey of every state or a determination of which laws apply to a particular reader.

Virginia

Virginia sports betting rules provide self-exclusion and limit options and require operators to publish how to use them. The cited regulation requires operators to stop specified targeted marketing to a self-excluded person through direct messages, texts, email, or other collected contact details. The rule concerns people who have self-excluded, not every customer who wants fewer promotions.

Colorado

Colorado rules revised January 14, 2026 require reasonable efforts to prevent people on the exclusion list from receiving direct marketing, including direct mail, calls, texts, and email. This describes a restriction tied to the exclusion list, not a general opt-out from all advertising.

Missouri

Missouri’s constitution requires commercially and technologically reasonable means to avoid purposely targeting self-excluded bettors. It also sets the advertising and offer-disclosure requirements described above.

New York and Louisiana

The cited New York regulation requires each direct sports wagering advertisement to clearly and conspicuously describe a way to opt out of future direct ads. The cited Louisiana regulation prohibits individually targeted sports betting marketing to a person who has self-restricted, is excluded, or is otherwise barred. Because the cited texts are reproductions rather than verified current official codifications, check the current official state rules before relying on either provision.

Can you opt out of targeted ads under state privacy law?

Possibly. A state privacy-law right can address targeted advertising as a data-use issue, separately from a sportsbook’s email and text preferences. Its availability and scope depend on the state law and whether it covers your circumstances; it is not a universal nationwide right.

Connecticut’s attorney general says that, as of January 1, 2025, consumers can use an opt-out preference signal to communicate an intent to opt out of targeted advertising and the sale of personal data. That is one state example, not a rule for every state. Check the relevant state authority’s current instructions to see whether a signal or other request is available to you.

What if promotions continue after you opt out?

Keep the original message or ad, your opt-out request, any confirmation, and the date of later contact. If you believe an operator is continuing direct marketing in violation of an applicable opt-out or self-exclusion rule, contact the gaming regulator or privacy authority for your state. The correct regulator and complaint process vary by jurisdiction. For commercial email, allow the FTC guidance’s general 10-business-day period before treating an unsubscribe as unhonored.

If you need a definitive answer about legality, identify your state, the sportsbook, your self-exclusion or barred status if any, and the channel used. Then check the current official gaming rule, privacy law, and regulator complaint instructions for that state; the examples here do not establish a 50-state rule.
