In the United States, downloading a copyrighted game ROM or console BIOS from an unauthorized source is generally legally risky and may infringe copyright. Owning the original cartridge, disc, or console does not automatically authorize downloading someone else’s copy. U.S. law has limited rules for certain owner-made archival copies and specific preservation or access-control exemptions, but none creates a general public right to download or share ROMs or BIOS files.
How the answer changes by situation
The key questions are who made and supplied the copy, whether the source was authorized, what the user owns, what the copy is for, and whether access controls are bypassed. These U.S. scenarios are not interchangeable:
As an Amazon Associate I earn from qualifying purchases.
| Situation | Who supplies or makes the copy? | What the U.S. sources establish | Important limit |
|---|---|---|---|
| Download from an unauthorized ROM or BIOS site | A third party supplies a copy to the downloader. | Copying copyrighted software may infringe the reproduction right; making it available to others may also implicate distribution or communication rights. The U.S. Copyright Office treats unauthorized downloads as potential infringement. | Owning a matching game or console does not by itself authorize the site’s copy or the download. |
| Make an archival copy of a computer program you legally own | The qualifying owner makes the copy. | Copyright Act section 117 provides a limited archival-copy privilege for a legal owner of a computer program, subject to conditions. | It is not a public distribution right. If the original is transferred, the archival copy must be destroyed or transferred with it; software terms may also matter. |
| Develop an interoperable emulator | A developer makes intermediate copies while reverse-engineering software. | The Copyright Office describes a Ninth Circuit fair-use ruling involving intermediate copying of the PlayStation operating system to develop an interoperable emulator. | This specific litigation outcome does not authorize ordinary users to download commercial game ROMs or BIOS files from unauthorized sources. |
| Preserve or restore certain games under a narrow exemption | An eligible institution, or in limited cases a lawful owner restoring local play, acts under a defined rule. | Current 37 C.F.R. § 201.40 contains limited exemptions concerning certain lawfully acquired complete games after required external-server support ceases, and preservation by eligible libraries, archives, or museums subject to conditions. | These provisions do not create a general public download or sharing exemption. Institutional rules include limits on making preserved games available beyond the institution’s physical premises. |
Why a ROM or BIOS download raises copyright questions
A game ROM is a copy of the game
A ROM file contains a copy of game code and content. The World Intellectual Property Organization’s 2022 paper explains that creating a ROM generally involves duplicating the video game, which implicates the reproduction right; uploading it for others can raise distribution or communication-right issues as well. Whether a particular copy is authorized depends on the facts and applicable law.

A console BIOS consists of software code. An unauthorized download of a copyrighted BIOS raises the same basic reproduction and distribution concerns as other copyrighted software. The official sources cited here do not establish a general BIOS-download exception; this conclusion applies general software-copyright guidance rather than a BIOS-specific agency ruling.

Being called a “backup” does not make a download authorized
The U.S. Copyright Office describes section 117 as a limited privilege for a legal owner of a computer program to make an archival copy for archival purposes. The provision does not generally allow a website or another person to distribute a backup copy to the public. Making your own qualifying archival copy and downloading a third party’s copy are different acts.
The Copyright Office also says section 117 applies to computer programs, not other kinds of works, and recommends checking the original software’s terms. If the original program is transferred, the archival copy must be destroyed or transferred with it. The rule is narrower than the common idea of a general “backup law” for any digital media.
Copyright and anti-circumvention are separate questions
Copyright infringement and bypassing a technological access control are distinct legal issues. Section 1201 of the Digital Millennium Copyright Act generally restricts circumventing technological measures that control access to copyrighted works, while allowing limited statutory exceptions and rulemaking exemptions. A person’s ownership of a game, or an argument that a use is fair, does not by itself resolve the anti-circumvention question.

Current game-related exemptions are tied to particular circumstances and actors. Under 37 C.F.R. § 201.40, limited provisions address certain lawfully acquired complete games when required external-server support has ceased, including restoration for local play, and preservation activity by eligible institutions under specified conditions. These are not blanket permissions for abandoned games, public ROM libraries, or general downloading.

The Copyright Office recounts a Ninth Circuit fair-use decision involving intermediate copying of the PlayStation operating system during reverse engineering for an interoperable emulator. That narrow holding concerns particular copying in emulator development; it does not establish that every emulator, its distribution method, or the ROM and BIOS files used with it are lawful.
Fair use depends on the circumstances. The Copyright Office’s Fair Use FAQ cautions that there is no fixed number of words, musical notes, or percentage of a work that automatically makes copying lawful. The legality of emulator software and the legality of obtaining or using a copyrighted game or BIOS file are separate questions.

Possible financial consequences in the United States
The U.S. Copyright Office’s Copyright and Digital Files FAQ says statutory damages for copyright infringement may reach $30,000 per work, or $150,000 per work if the copyright owner proves willful infringement; it also notes that attorney’s fees may be available.
