Whether a Flock Safety camera deployment is lawful depends on the state, the agency operating it, its policies and settings, and how officials access, retain, and share the data. The camera’s presence alone does not establish that every use of its records is lawful—or unlawful.
What Flock cameras collect
Flock describes its license plate reader (LPR) data as including images of a license plate and vehicle, the plate number and state, vehicle characteristics such as color and make, the date and time, and the camera location. The company says its automatic license plate reader system does not collect biometric data, driver information, or facial-recognition data. Those are Flock’s descriptions of its system, not an independent audit of every camera, setting, or deployment.

An automated plate read is not proof that a driver committed an offense. Flock’s policy acknowledges that a plate translation may be incomplete or inaccurate and says users should confirm the computer’s translation before acting on an alert or search. Some agency portals likewise say that a human must verify a hotlist hit. The cited materials do not establish a general accuracy percentage that can be applied to all Flock systems.
How long the data is kept
Flock states that its default LPR retention is a rolling seven days, unless law or the customer’s policy requires a different schedule. The company’s evidence policy also discusses customer-approved extensions of up to one year when a longer period is not already legally required. Neither figure guarantees the setting used by a particular agency.

| Source and deployment | Reported retention | What the figure means |
|---|---|---|
| Flock Safety’s stated default | Rolling seven days | Company-stated default, subject to a different schedule required by law or customer policy. |
| Flock Safety’s San Francisco Police Department transparency portal | 365 days | Portal-reported local setting, not a national rule. |
| Flock Safety’s Oakland Police Department transparency portal | 30 days | Portal-reported local setting, not a national rule. |
To find the period that applies where you live, check the operating agency’s current policy and transparency portal rather than relying on the company default or another city’s setting.
Who can search or receive the data
Flock says customer administrators control authorized end-user access and that searches are logged for audits. Its policy describes logs that can include the user, date, time, stated purpose, and query details. The local agency’s rules determine who is authorized, what reason is needed, how the logs are reviewed, and which other agencies may receive access.

For example, a Flock police-department portal describes an agency-specific use policy, says a valid reason is required for access, and says access records are stored indefinitely. That example is not evidence that every customer follows the same policy or uses the same audit practices.
Why legality depends on the state and the agency
Legal questions include whether public observations of license plates may be recorded and retained, whether searches of historical location records receive additional constitutional protection, what state statutes require for retention and access, and whether sharing data across agencies or state lines is permitted. The Congressional Research Service’s July 2025 overview describes legal issues and differing court approaches; it does not determine whether a particular local deployment complies with the law.

- 140dB True WDR & Imaging: 140dB true WDR balances intense backlight, vehicle headlight glare, and dark shadows, minimizing overexposure and shadow detail loss at dawn, dusk, and busy roadways.
State-specific terms matter too. Flock’s state contract provisions, last updated September 17, 2026, set out jurisdiction-specific conditions and state that those terms prevail over conflicting agreement provisions. The applicable terms depend on the state and agency; a general statement about Flock’s contracts cannot establish the rules for every customer.
Recent examples are not final answers for every deployment
- In August 2025, the Illinois Secretary of State reported that an audit found Flock had allowed Border Patrol access to Illinois ALPR data contrary to state law.
- In October 2025, California’s attorney general filed a lawsuit alleging that El Cajon unlawfully shared data with out-of-state agencies. That is an allegation in ongoing litigation, not a final court ruling.
- In August 2026, Arizona’s attorney general announced a review. An announced review is not itself a finding that a deployment is illegal.
These examples show why the actual policy, data-sharing arrangement, state law, and procedural status of any dispute matter. They do not decide whether a different city’s system is lawful.

Can police search Flock data without a warrant?
There is no warrant rule in the available materials that resolves every Flock search nationwide. The legal analysis can depend on the jurisdiction, the type and duration of the data collected, the search being conducted, and applicable state law and court decisions. The CRS overview describes differing legal approaches rather than a single nationwide conclusion. For a specific search, stop, or disclosure, ask a lawyer licensed in that jurisdiction to assess the facts and current law.
How to check the rules where you live
- Identify the operator. Find the city, police department, sheriff’s office, or other agency responsible for the camera. Look for its current ALPR policy and public transparency portal.
- Read the policy and portal disclosures. Check the retention period, who may search, what purpose is required, what gets logged, how audits work, and which agencies may receive access.
- Compare those rules with state requirements. Check current state statutes and any state-specific contract terms that apply to the agency. Do not assume the company’s default retention period is the local setting.
- Keep records if a particular incident concerns you. Preserve relevant dates and documents about a search, stop, citation, or disclosure. Consult a lawyer licensed in the jurisdiction for advice about your situation.
What to compare between local systems
If you are evaluating two deployments, compare the rules and safeguards that shape how each system is used—not just the camera hardware:
Best Value
- Power Supply : 12 VDC/PoE
- 2-MP 1/2.8" CMOS image sensor, low luminance, and high definitionimage. Outputs max. 2MP (1920×1080) @25/30 fps.
- 5 mm–60 mm motorized lens, Built-in IR LED, and the max. illumination distance is 150 m (492.13 ft) (IR) . For 50ft-170ft , use as LPR or long distance monitoring.
- How long records are retained.
- Which users may search and what purpose they must provide.
- What search details are logged and how often logs are reviewed.
- Which agencies may access or receive shared data.
- Whether a person must verify a match before action is taken.
- What transparency and complaint channels are available.
- Which state law governs the agency.
These are practical points for assessing a local system; none alone proves that a deployment is lawful or unlawful.
