Are Esports Tournaments Considered Gambling in Canada? Rules Event Organizers Should Know

Not automatically. A Canadian esports tournament whose result is determined by player skill, without wagering on matches or chance-based prize mechanics, is generally treated differently from gambling. Legal exposure rises when an entry payment buys a chance to win, random or mixed-chance features determine prizes, or an organizer records, advertises or facilitates bets.

The answer depends on the exact format and the provinces involved. Federal Criminal Code provisions, provincial gaming statutes and contest rules can apply at the same time. Treat this as a planning guide, not a legal opinion; obtain province-specific advice before launching an unusual format or any betting service.

What makes an esports tournament gambling or not?

Canadian law does not label every competition with an entry fee and a cash prize as gambling. The decisive facts are usually how the winner is determined, what participants pay for, and whether anyone is wagering on the outcome.

Skill-determined competition

When match results are produced by competitors’ performance—such as decisions, aim, strategy, teamwork and execution—rather than a draw or random selection, the event is generally a skill contest. The Alcohol and Gaming Commission of Ontario (AGCO) describes a game of skill as one in which “the element of chance is virtually non-existent.” Its examples include checkers, chess, bowling, tennis, golf and all sports contests. That classification supports treating a conventional esports bracket as a competition rather than a lottery, provided the rules do not add material chance.

Chance and mixed-chance mechanics

Random seeding, a draw that awards the prize, loot-style prize selection, shuffled outcomes or a game mechanic that materially determines who wins can change the analysis. Ontario guidance distinguishes games of skill from games containing both chance and skill. A tournament can therefore become legally riskier even when players demonstrate substantial skill if a random element controls advancement or the prize.

Wagering on the event

A separate issue is betting. A skill-based tournament may still be surrounded by illegal or regulated betting if spectators, players or third parties stake money on matches. Organizers that register bets, sell a pool, make a book, provide betting information or advertise an inducement to bet can engage the federal Criminal Code rules in section 202.

Federal Criminal Code provisions organizers must understand

Section 202: recording, registering or facilitating bets

Section 202 identifies offences connected with betting on contests. The provisions address conduct such as recording or registering bets, selling a pool, book-making and providing information intended to support betting. They also address advertising an inducement to bet on a contest.

This means an organizer can create risk without placing a wager personally. A tournament website that accepts match bets, a staff member who keeps a betting ledger, or a promotion that invites viewers to wager can all require a different legal and licensing analysis from ordinary event registration. Do not assume that calling the activity a “prediction,” “pool” or “fan game” removes it from the rule.

Section 206(1)(f): payment tied to chance or mixed chance and skill

Section 206(1)(f) concerns disposing of goods by a game of chance or a game that combines chance and skill when a contestant pays money or other valuable consideration. For an esports organizer, the key question is whether the participant’s payment merely covers administration of a genuine skill competition or instead buys a chance to obtain the prize.

That distinction is fact-sensitive. A fee that is pooled into the prize and returned according to an outcome influenced by chance presents more risk than a clearly disclosed administration charge for a skill-only event. Have counsel review the entry terms, prize funding, refunds and any deductions before relying on the distinction.

Can you charge an entry fee and pay a cash prize?

Often, a paid-entry skill tournament can be structured outside gambling, but the fee and prize design must be examined together. The safer question is not “Is there a fee?” but “What does the fee purchase, and how is the winner selected?”

Lower-risk characteristics

  • The competitive result is determined entirely by documented player performance.
  • The fee is described and used as event administration, production, venue, staffing or technology cost rather than as a wager.
  • The prize formula is fixed in advance and awarded according to the published bracket or scoring rules.
  • No random draw, loot-style selection or chance event controls advancement or prize allocation.
  • Participants are not required to make side bets, and the organizer does not pool wagers.

Higher-risk characteristics

  • Entrants pay for a chance to be selected for a prize or for a random prize outcome.
  • A portion of entry payments is treated as a wagering pool, with winners determined by chance or mixed chance and skill.
  • Random events decide who advances, which prize is received or whether a participant receives anything.
  • Rules are changed after payment, or the organizer retains discretion to select winners outside the stated skill criteria.

A free alternative entry route can matter in promotional contests, but it is not a universal solution. The complete structure—including how the alternative works, how prizes are allocated and whether chance remains—should be reviewed under federal and provincial law.

Do esports bets need a licence?

If spectators or participants can wager on matches, use only an authorized framework and obtain advice for every jurisdiction in which the betting service operates. A tournament organizer should not assume that a skill contest exemption authorizes a betting market around it.

Ontario’s sports and event betting standards apply to sports, esports, novelty events and betting exchanges, according to AGCO reporting. Those standards are distinct from simply running an esports competition. Whether the organizer, a betting operator or another licensed entity must hold approval depends on the service, contracts, technology and locations involved.

Do not accept bets through an event website, chat channel, staff-operated spreadsheet or sponsor activation until counsel has confirmed the legal route. Recording bets or promoting an inducement to bet can be problematic even when the organizer does not set the odds.

How provincial rules change the answer

Ontario

Ontario’s 2025 Lottery Licensing Policy Manual treats sports contests as games of skill when chance is virtually absent, while separately regulating sports and esports event betting. The manual notes that an organization may wish to obtain a legal opinion before running a contest that could be a lottery scheme.

For an Ontario event, document why the competitive result is skill-based, remove unnecessary random prize mechanics, and examine whether any payment or promotional feature could bring the format within lottery or gaming rules. A betting arrangement requires a separate review under the applicable sports and event betting standards.

British Columbia

British Columbia’s Gaming Control Act gives the provincial gaming authority power to establish rules for gaming events, licensing classes, security, prizes and the use of gaming-event funds. A format that is acceptable as a skill competition in one province may still need a different analysis in British Columbia if it includes gaming-event characteristics, regulated betting or chance-based prizes.

Other provinces and local requirements

Federal contest guidance warns that provincial statutes and local bylaws also apply. Check the rules where the organizer is established, where the event is physically held, where players and spectators participate, and where any betting service operates. An online event can touch several jurisdictions at once.

Organizer checklist: classify and document the format

Complete this review before taking registrations or announcing prizes. Keep the answers with the rulebook and contracts so you can show how the format was designed.

  1. Map the competitive result. Write down every input that can affect advancement or the final score. Identify random seeding, draws, item drops, shuffled teams, automated outcomes and discretionary selections. Remove chance elements that are not essential, or obtain a written opinion on them.
  2. Describe every payment. List registration fees, deposits, memberships, add-ons, donations and sponsor-funded benefits. State what each payment buys and whether any amount is pooled or contingent on an outcome.
  3. Trace prize funding. Record who supplies cash, equipment, credits or other valuable prizes, when the prize is fixed, and whether the amount or recipient can change after entries are sold.
  4. Separate betting from registration. Confirm that the registration system cannot accept match wagers. If a third party will provide betting, identify its authorization, territory, technical role and responsibility for compliance.
  5. Check every jurisdiction. List the provinces and countries reached by the event, online platform, players, spectators and betting partners. Obtain local advice where rules differ.
  6. Preserve evidence. Keep the published rules, version history, match records, payment records, prize calculations, complaints and dispute decisions. These records help demonstrate that results followed the advertised skill criteria.

Contest disclosures your promotion should include

Competition Bureau guidance describes promotional contests as involving chance, skill or both and calls for clear disclosure of material conditions. Your landing page and rulebook should state:

  • the number of prizes and each prize’s approximate value;
  • regional allocations, if prizes or eligibility differ by province or territory;
  • eligibility requirements, age limits, residency rules and excluded participants;
  • opening and closing dates, entry methods, deadlines and any entry limits;
  • how winners are determined, including the scoring, tie-break and verification process;
  • all fees, required purchases, refund terms and conditions for withdrawing;
  • prize delivery, taxes or other winner obligations that materially affect value; and
  • the procedure for disputes, disqualifications, outages and rule changes.

Federal guidance emphasizes that a contest must also be lawful under other federal and provincial statutes and local bylaws. Disclosure cannot cure an unlawful betting or lottery structure, but incomplete terms can create an additional compliance problem.

Integrity controls that protect the event

Anti-betting and provincial gaming frameworks make integrity controls prudent even when the tournament itself is skill-based. Put the controls in the rules and enforce them consistently.

  • Prohibit players, coaches, officials, contractors and staff from betting on the event or sharing non-public information for betting.
  • Require conflict and sponsor disclosures, including any relationship with a betting operator or data provider.
  • Publish a complete rulebook, prize formula, eligibility standard and refund policy before entries open.
  • Use auditable match logs, replay retention and access controls for administrative systems.
  • Define protest deadlines, evidence standards, tie-breakers, technical-pause procedures and final-decision authority.
  • Document investigations and preserve communications when a participant raises match-fixing, collusion or wagering concerns.

These measures do not replace a licence or legal opinion. They make the event’s skill basis and decision process more transparent and easier to defend.

Format comparison for planning

Format feature Primary legal question Why it matters
Skill-only bracket with fixed prizes Are outcomes determined entirely by player performance? AGCO guidance treats sports contests as skill games when chance is virtually absent.
Paid entry for event administration Does payment cover administration, or buy a chance to win? Section 206(1)(f) focuses on money or valuable consideration tied to chance or mixed chance and skill.
Random prize draw attached to a tournament Does chance determine receipt or value of the prize? A random or mixed-chance feature can change the classification even when matches require skill.
Spectator betting market Who records, registers, advertises or facilitates bets? Criminal Code section 202 addresses betting-related conduct; provincial sports and event betting rules may also apply.
Online event spanning provinces Which provincial statutes, licences and local rules apply? Federal guidance states that provincial statutes and local bylaws must also be satisfied.

When to obtain a written legal opinion

Get province-specific advice before launch when any of these facts apply:

  • the prize or advancement depends partly on a random process;
  • entry money, deposits or purchases are connected to the prize pool;
  • the event includes a pool, prediction product, odds, picks or other wagering feature;
  • a sponsor, platform or partner wants to advertise or operate betting;
  • the event is online and reaches participants or bettors in multiple provinces;
  • you are unsure whether the format could be a lottery scheme or gaming event; or
  • the event uses an unfamiliar prize, token, credit or digital item whose value may count as consideration.

Ask counsel to analyze the final rules, payment flow, marketing, technology roles and jurisdictions—not just the tournament title. Recheck the current Criminal Code text, provincial policies and regulator standards because they can change.

Practical scenarios

Eight-team strategy tournament with a registration charge

If the charge is disclosed as an administration fee, the bracket and tie-breakers rely on player performance, prizes are fixed before registration and no wagers are accepted, the structure is generally closer to a skill contest. Keep records showing how the fee is calculated and how prizes are funded.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Free-entry tournament with a random hardware giveaway

The matches may be skill-based, but the giveaway is a separate chance-based promotion. Publish the number and approximate value of prizes, eligibility, entry conditions and regional allocations, and obtain advice on the promotion’s provincial requirements.

Paid tournament with a random “mystery” prize tier

Payment combined with a random prize outcome creates a material section 206(1)(f) question. Do not rely on the skill of the matches to eliminate that risk; redesign the prize mechanic or obtain a written opinion.

Organizer-hosted viewer betting

Accepting picks, keeping a pool, posting odds or directing viewers to wager can engage section 202 and provincial betting standards. Stop the feature until an authorized structure and responsibilities are confirmed.
