Official Indian advance-ruling and appellate-index materials support the view that this recovery is generally not a separate taxable supply by the employer. The result depends on the actual arrangement, however; it should not be assumed for every employer-run canteen or full-cost recovery model.
What the GST question is—and what it is not
In a common arrangement, a provider supplies canteen services to the employer, the employer pays the provider, and employees contribute a subsidized amount through payroll. The issue addressed here is whether the employer’s recovery from employees is itself a taxable supply under India’s CGST framework. It is separate from the provider’s GST treatment of its service to the employer.

For the employee recovery, an earlier GST Council appellate-index summary reports that GST was not payable on a nominal canteen amount recovered by the employer. A Gujarat AAR excerpt similarly states that a subsidized deduction from employees using the canteen was not a supply and that the applicant was not liable to GST on that recovery. The employer’s role is central: it may contract for and purchase the canteen service, or it may only facilitate a transaction between employees and a provider. The recovery could be nominal, subsidized, part of the provider’s charge, or the full cost. Those differences can affect how the transaction is characterized. A ruling about one applicant’s facts should not be treated as deciding a different structure.

- Employer contracts and pays; nominal or subsidized payroll recovery: the cited materials support the view that the recovery is generally not a taxable employer supply.
- No employee recovery: the cited indexed materials do not establish a general outcome for this model.
- Part or full cost recovered: do not assume that a ruling involving nominal or subsidized recovery settles the treatment.
- Employer-operated canteen or direct employee-provider arrangement: the available outcomes should not be transferred automatically; identify who provides the meal and who contracts with whom.
The GST Council’s Maharashtra index shows that these questions continue to be considered in state-specific matters. Its KSB Limited entry, dated 28 November 2025, asks about a third-party canteen and employee recovery ranging from none to part or all of the provider’s charge, but the indexed information does not state the operative answer. Employee recovery and input tax credit are separate decisions
Whether GST applies to an employee deduction does not by itself determine whether the employer can claim input tax credit on the provider’s invoice. The appellate-index summary reports credit as available in the case where the employer was legally obliged to provide the canteen. That is a fact-specific outcome, not blanket permission for all workplace meal costs. Check the applicable statutory restriction and any relevant exception against the employer’s circumstances before claiming credit. GST Council appellate-index material.

The Maharashtra index lists a Mukand Limited AAR order dated 24 March 2026. The questions include whether nominal recovery for factory canteen use is taxable and whether input tax credit is available on canteen services. The index entry identifies the issues but does not provide the ruling’s answer. It also lists March 2025 employer canteen matters for Bridgestone India, Ferrero India, Lear Automotive, and Spicer India; their presence shows recurring, fact-specific adjudication, not uniform outcomes. Accordingly, the established practical position for a nominal or subsidized recovery should be distinguished from questions the available summaries leave open. Before relying on a newer state ruling, read the full order and confirm its facts and operative findings. An AAR result concerning a particular applicant should not be generalized beyond the reach of that decision.

Employer checklist before applying the position
- Read the service agreement. Identify who contracts with the canteen provider and whether the employer buys the service or merely arranges access.
- Match invoices and payments. Confirm who receives the provider’s invoice and who pays it.
- Document the recovery model. Keep the canteen policy and payroll records showing whether the contribution is nil, nominal, subsidized, partial, or full-cost.
- Assess input tax credit independently. Document any legal obligation to provide the facility and evaluate the applicable credit restriction and exception on the employer’s facts.
- Reconcile the accounting treatment. Ensure the provider invoice, employee deductions, and any credit claimed are recorded consistently.
- Check the relevant ruling in full. Confirm the state, applicant facts, date, and operative conclusion rather than relying only on an index question or summary.
