Are Delivery Charges Taxable When an Online Order Is Returned or Refunded?

There is no universal rule. Whether an online delivery charge is taxable depends on the jurisdiction governing the sale, whether the goods are taxable, how delivery is arranged and shown on the invoice, and sometimes whether the charge exceeds the seller’s actual delivery cost. The tax treatment of the original delivery charge is also separate from whether tax must be refunded after the goods are returned.

To determine what should happen on a particular order, identify the delivery destination and governing tax jurisdiction, check the product’s tax status, read the delivery terms and invoice, and compare the original tax and refund lines. A return does not automatically mean that every amount labeled “shipping,” “delivery” or “handling” must be refunded in every jurisdiction.

Start by separating two different tax questions

“Is delivery taxable?” and “Must delivery tax be refunded after a return?” are related but distinct questions.

Question 1: Was tax on the delivery charge correct when the order was placed?

Tax authorities may treat delivery as part of the selling price, as a separate nontaxable service, or as a mixed charge. The answer can change with the product, destination, contract terms, invoice wording and carrier arrangement. A charge called “shipping” is not automatically taxable or exempt merely because of its label.

Question 2: What happens when the customer returns the goods?

A valid return may require correction of tax charged on the goods. Whether the original delivery charge, and tax collected on it, is also refundable depends on the jurisdiction’s return and delivery rules and on the seller’s terms. Official guidance reviewed for this topic does not establish one rule requiring tax on every original delivery charge to be refunded after every return.

California provides a specific example: when delivery is nontaxable under California’s conditions but the seller calculated tax as though it were taxable, the seller must refund the tax collected on that delivery amount or pay it to the California Department of Tax and Fee Administration (CDTFA). That guidance corrects an incorrectly taxed nontaxable charge; it is not a general rule for all returned orders or all locations.

Identify the jurisdiction that governs the sale

Sales-tax and VAT rules generally depend on the place of taxation, which may involve the customer’s delivery address, the seller’s location, the type of transaction and special distance-selling rules. The same delivery arrangement can therefore produce different results in different states or countries.

United States state rules

For a U.S. order, start with the state and, where relevant, the local jurisdiction associated with the delivery destination. A seller may have obligations in more than one state, but the invoice should identify the tax collected and the ship-to address used for the calculation.

United Kingdom and European Union VAT

UK VAT Notice 700/24 explains that treatment depends on the circumstances. If delivery is free or included in the ordinary selling price, VAT is accounted for on the full price according to the goods’ liability. The notice distinguishes delivered goods, separate delivery arrangements and goods supplied on approval. The broader UK VAT guide also explains that a delivery amount can form part of a single supply of delivered goods when the contract requires delivery, even if the amount is shown separately.

Those are UK examples, not a worldwide rule. In the European Union, the European Commission explains that place-of-taxation rules vary by transaction type and that qualifying distance sales can be taxed in the destination country. Establishing the correct country is therefore a prerequisite to analyzing a returned-order refund.

Canada

The Canada Revenue Agency (CRA) states that GST/HST treatment depends on the supply and place-of-supply rules. Rates can also change by province and date. For example, the CRA page lists a 14% HST rate in Nova Scotia on or after April 1, 2025; that rate is time-sensitive and must be verified for the transaction date. The rate alone does not determine whether a particular delivery amount is refunded after a return.

Check whether the goods themselves are taxable

Delivery charges often follow the tax status of the underlying goods, but the exact mechanism differs by jurisdiction.

  • Taxable goods: Some jurisdictions include seller-billed delivery, shipping or handling in the taxable receipt.
  • Exempt or zero-rated goods: Delivery may be exempt, excluded or otherwise treated differently when the sale of the goods is exempt or zero-rated.
  • Mixed baskets: A single delivery charge may need to be allocated between taxable and nontaxable items rather than assigned entirely to one category.
  • Services and special products: Rules can differ for services, digital products, food, medical items and other specially classified supplies.

Washington guidance, for example, says delivery charges on exempt sales are exempt and describes allocating one delivery charge between taxable and nontaxable goods. California says charges related to a nontaxable transaction are not taxable under its rules. New York generally ties delivery tax to whether the product or service sold is taxable.

Read the delivery arrangement and invoice

Before deciding whether tax was charged correctly, record the following facts from the order confirmation, invoice and carrier information:

  • Is delivery separately itemized, or bundled into one price with the goods?
  • Does the invoice combine “shipping,” “handling,” insurance or other service fees?
  • Did the seller contract with the carrier, or did the customer arrange and pay a carrier directly?
  • Was delivery required by the sales contract, or offered as an optional service?
  • Does the delivery charge exceed the seller’s actual delivery cost, where the jurisdiction uses that test?
  • Was one charge allocated across taxable and nontaxable products?
  • Does the refund statement separately reverse merchandise tax, delivery charges and tax on each line?

Separate itemization is important in some jurisdictions, but it is not a universal exemption. A separately stated amount can still be taxable, while a bundled amount can be treated as part of the taxable selling price.

How selected jurisdictions treat delivery charges

Jurisdiction General treatment described by official guidance Important qualification
California Separately stated delivery for a taxable sale may be nontaxable when all specified conditions are met. Direct shipment by carrier or mail, separate statement, and a charge no greater than actual delivery cost are among the conditions. Any excess over actual cost is taxable; handling associated with a taxable sale is taxable.
New York Seller-billed shipping, handling or delivery for a taxable product is generally taxable as part of the taxable receipt. A customer who separately arranges and pays a third-party carrier may receive different treatment. The cited shipping bulletin is dated May 14, 2012; verify current rules before relying on it.
Washington Seller delivery charges are part of the selling price, and delivery for taxable products is subject to retail sales tax. A single delivery charge may need allocation between taxable and nontaxable goods; delivery on exempt sales is treated as exempt in the cited guidance.
Louisiana Seller-billed transportation charges are included in the sales price. The guidance distinguishes some charges paid directly to a third-party carrier.
Virginia The cited ruling describes an exemption for separately stated transportation or delivery charges on a taxable sale. If the charge is not separately stated, it becomes part of the sales price under that ruling.
United Kingdom VAT can apply to the full price of delivered goods when delivery is included or required as part of one supply. HMRC distinguishes free or included delivery, separate arrangements and approval transactions; the result depends on the contract and circumstances.

The table illustrates why a generic “shipping is taxable” or “shipping is always exempt” answer is unreliable. It summarizes the cited official examples, not a substitute for the current rule in the jurisdiction handling your order.

California: when a delivery-tax correction is required

California CDTFA Publication 100 says delivery-related charges for a taxable sale may be nontaxable when all specified conditions are satisfied. The cited conditions include shipment directly by a carrier or mail, a separately stated charge, and a charge no greater than the actual delivery cost. If the charge exceeds actual cost, the excess is taxable. Publication 109 likewise treats the portion above actual delivery cost as taxable and says handling is taxable when related to a taxable sale.

California’s refund instruction addresses an incorrect calculation: “If the tax amount calculated for the sale was based on the cost of the item plus the nontaxable delivery charge, you must refund the tax amount collected on the delivery or pay that amount to the CDTFA.” In practice, a customer should compare the invoice’s delivery amount, actual-cost documentation if available, tax calculation and refund credit. This instruction does not say that tax on every delivery charge must be refunded merely because merchandise was returned.

New York: seller-billed delivery usually follows taxable merchandise

New York guidance generally treats charges to the customer for shipping, handling or delivery as taxable when the product or service sold is taxable. The state’s shipping bulletin says seller-billed shipping or delivery on a taxable product generally becomes part of the taxable receipt. A different result can apply when the customer separately arranges and pays a third party for delivery.

Because the cited bulletin is from May 14, 2012, treat it as an explanation of the referenced rule, not a guarantee that no later change applies. For a current order, confirm the treatment with the New York Department of Taxation and Finance or the seller’s tax department, using the transaction date and delivery address.

Washington, Louisiana and Virginia: three different patterns

Washington allocation

Washington treats seller delivery charges as part of the selling price and applies retail sales tax to delivery charges for taxable products. If one shipment contains taxable and nontaxable items, the seller may need to allocate the single delivery charge. A return can therefore require reversing only the taxable portion or recalculating the allocation, rather than applying one blanket percentage to the entire original charge.

Louisiana third-party distinction

Louisiana says seller-billed transportation charges are included in the sales price, while distinguishing some delivery charges paid directly to a third party. The invoice should show who billed the customer and who contracted with the carrier before the tax result is assessed.

Virginia separate statement

The cited Virginia ruling describes separately stated transportation or delivery charges on a taxable sale as exempt. When the amount is not separately stated, it becomes part of the sales price. This is a useful example of why invoice presentation can have legal significance, but it should not be exported to another state.

What to do after an order is returned

  1. Save the original records. Keep the order confirmation, invoice, payment receipt, shipping terms, tracking record and return authorization.
  2. Identify the governing location. Note the ship-to country, state or province, delivery date, seller location shown on the invoice and any tax jurisdiction listed.
  3. Classify the goods. Determine whether each returned item was taxable, exempt or zero-rated under that jurisdiction’s rule.
  4. Separate each charge. List merchandise price, delivery, handling, insurance, discounts, tax and any restocking or return fee. Do not assume a “shipping and handling” line is one legally uniform charge.
  5. Compare the refund statement. Check whether the seller reversed the merchandise tax, delivery amount and tax on delivery separately. Note any nonrefundable outbound or return-shipping term.
  6. Ask a targeted question. Provide the seller with the destination, product description, invoice, delivery terms and refund breakdown. Ask whether the original delivery charge was taxable and, if so, what rule governs its treatment after the return.
  7. Escalate with complete facts. If the seller cannot explain the calculation, contact the relevant tax authority or a qualified tax professional. Include the transaction date because rates and administrative guidance can change.

Common mistakes that produce wrong answers

  • Assuming a return automatically reverses every tax line. A merchandise return and a delivery-tax correction can be governed by different provisions.
  • Treating “shipping” as a legal category. Tax authorities may distinguish transportation, handling, insurance, bundled fulfillment and delivery required by contract.
  • Assuming separate itemization always makes delivery exempt. New York generally taxes seller-billed delivery on taxable products, while Virginia’s cited ruling describes an exemption for separately stated delivery. The contrast is jurisdiction-specific.
  • Ignoring actual delivery cost. California’s cited conditions use actual delivery cost; an amount above that cost can be taxable even when delivery is separately stated.
  • Using an old bulletin without checking the date. The New York shipping bulletin cited here is dated May 14, 2012. Confirm the current position for the transaction date.
  • Applying one rate to a mixed order. Washington’s guidance shows why taxable and nontaxable goods may require allocation of one delivery charge.
  • Confusing a carrier’s invoice with the seller’s charge. Customer-arranged, third-party delivery can receive different treatment from seller-billed delivery in several examples.

Information to include when requesting a definitive answer

A seller, tax authority or adviser can answer faster when the question includes:

  • Delivery destination and transaction date
  • Seller’s invoice and tax jurisdiction shown
  • Exact product descriptions and each item’s tax status
  • Whether delivery was required, optional or arranged independently by the customer
  • Separate delivery, handling and insurance amounts
  • Who contracted with and paid the carrier
  • Actual delivery cost, if the jurisdiction uses that comparison
  • Return authorization, refund date and line-by-line refund statement

With those facts, the issue becomes a jurisdiction-specific calculation instead of a guess based on the word “shipping.”
