Sometimes, but not automatically. In the United States, the answer depends on what the files contain, which permissions the copyright owner and other creators have granted, the game’s current terms and mod policy, how the files are distributed, and where the users are located. A mod made entirely from your own code and original assets presents a different issue from a download that contains extracted game music, maps, models, or another creator’s mod.
Giving a file away, labeling it “free,” or changing a work by a particular percentage does not by itself make downloading or sharing lawful. Copyright law, contracts and platform rules can each affect the result. The examples below use U.S. law and official policies for particular games; they are general information, not an individualized legal determination.

The short answer: check the files, permissions and rules
Copyright owners generally control three rights that matter most here: making copies, preparing derivative works and distributing copies. A custom level or mod may exercise one or more of those rights when it includes or changes protected game material. The fact that a mod is an add-on rather than a complete game does not answer the copyright question.
- Downloading: saving a protected file can implicate the reproduction right. A download is safer when the copyright owner, the game’s license or an authorized platform has actually permitted that distribution.
- Sharing: uploading a mod, repackaging it in a mod pack or sending it to others can implicate reproduction and distribution rights, especially when the upload includes game assets or someone else’s work.
- Making: your own code, level design, textures, sounds and documentation may be original, but combining them with protected game content can create a derivative-work issue.
- Using a service: a publisher or platform may allow certain mods while banning monetization, redistribution or particular content. A rule violation can lead to removal or account action even when no court has decided that copyright infringement occurred.
For an unnamed game, there is no reliable universal yes-or-no answer. You need to identify the game, the files, the distribution channel and the governing country before drawing a conclusion.

What copyright law covers in a mod
Game code and assets can remain protected
Title 17 gives copyright owners exclusive rights to reproduce protected works, prepare derivative works and distribute copies, subject to statutory limitations and exceptions. Those rights can cover software code, artwork, character models, maps, dialogue, music, sound effects, cinematics and other expressive elements. A mod that contains copied or extracted material therefore raises different questions from a separately authored file that merely interacts with an installed game.
For example, a creator might write an original script that changes how non-player characters behave while requiring the player’s authorized copy of the game to supply all models and sounds. That arrangement is not automatically lawful or unlawful; the policy and license for that game still matter. By contrast, uploading a package that includes the game’s original executable, a large collection of extracted textures or a soundtrack copied from the game is more clearly using material owned by someone else.
Your original contribution does not erase other rights
You can own copyright in genuinely original parts of a level or mod while lacking permission to redistribute the game material on which it depends. Ownership is not an all-or-nothing status. A custom mission with original dialogue may contain both your protected expression and protected character art supplied by the game. The fact that you made the new dialogue does not grant you the right to repackage the character art.

Downloading and uploading are separate decisions
The U.S. Copyright Office explains that uploading or downloading protected works without the copyright owner’s authority can infringe reproduction and/or distribution rights. Whether a particular file is authorized is a factual question. A community site, a working download button or a “free” label is not proof that the uploader had permission.
Questions to ask before downloading
- Does the publisher provide an official mod service or expressly permit this type of file?
- Does the listing require an authorized copy of the game rather than supplying game files itself?
- Does the creator identify the license and any limits on personal use, redistribution or commercial use?
- Does the package contain only the creator’s files, or does it include extracted executables, assets, music or another mod?
A download that supplies only an original patch, script or level description may be treated differently from a download that substitutes for buying the game or transfers a bundle of game content. The label “mod” does not determine which category applies.
Questions to ask before sharing
- Are you the author of every file you are uploading, or do you have written permission from each rights holder?
- Are you distributing a game asset, an entire game file, or another creator’s mod rather than a file you authored?
- Does the game’s policy allow sharing through your chosen host, mod pack, marketplace or in-game browser?
- Are you charging, accepting donations, placing the file behind a paywall or bundling it with a paid service?
Sharing a link to an authorized publisher-hosted download is not the same as mirroring the file yourself. The latter creates a new copy and distribution event that may not be covered by the original permission.

Fair use is possible, but it is not an automatic mod exemption
Fair use is a fact-specific analysis under four statutory factors. The Copyright Office states that there is no fixed number of words, musical notes or percentage that guarantees fair use. Noncommercial use can help under one factor, but “free” does not end the analysis.

- This includes three classic DOOM games preserved on one cartridge - DOOM, DOOM II, and DOOM 3! No game downloads required.
- Includes a full-color manual and reversible cover art.
| Fair-use factor | What it asks about a mod or level |
|---|---|
| Purpose and character | Is the use commercial, nonprofit or educational, and does it add a new purpose or expression? Monetization, advertising and paid access can weigh against fair use, while a genuinely transformative purpose may help. |
| Nature of the copyrighted work | Is the material highly creative, such as music, art or story content, or more factual? Games usually contain substantial creative expression. |
| Amount and substantiality | How much was copied, and did the use take the most important or recognizable parts? A small file can still be qualitatively significant. |
| Effect on the potential market | Could the distribution substitute for the game, an official expansion, licensed add-on or another market for the original work? |
Courts balance all four factors based on the particular facts. A parody, criticism, accessibility project or educational demonstration might present a stronger argument than a commercial package that reproduces a game’s core assets. Even a strong fair-use argument does not guarantee that a platform will leave a file online while a dispute is pending.
Publisher and platform policies can change the practical answer
Bethesda’s Skyrim and Fallout 4 guidance
Bethesda’s official modding guidance for Skyrim and Fallout 4 says: Do not upload mods or mods taking content from other mods unless you have permission from the creator.
That instruction addresses both re-uploading another person’s mod and taking content from it. It is a policy example for the named Bethesda games and services, not a rule that automatically governs every title.
Bethesda’s community standards also state that crowdfunding or monetization of mods is not allowed under the referenced Creation Kit EULA. A creator considering subscriptions, paid downloads, crowdfunding rewards or a commercial mod pack must read the current terms rather than assume that a donation option is acceptable.

Minecraft’s permission is conditional
Minecraft’s official content-creation guidance says: Players are free to create, build, and mod within Minecraft if the Minecraft Usage Guidelines are followed.
This is an example of a publisher expressly permitting modding within specified conditions. It does not grant a blanket license to copy Minecraft game files, bypass the guidelines or apply the same permission to another game.

Terms can matter even without a copyright lawsuit
Game terms may define what counts as a “Game Mod,” restrict access to a service to users who comply with the agreement, and control which uploads remain available. A breach can result in removal, loss of service access or account consequences even when no court has ruled on infringement. Treat copyright analysis and contract or platform compliance as related but separate checks.
A practical risk check for a specific mod
Use this sequence before downloading, creating a release or adding a file to a mod pack:
- Identify the jurisdiction. This guide explains U.S. law. Another country may apply different copyright exceptions, contract rules or notice procedures.
- Inventory the package. List code, scripts, maps, meshes, textures, fonts, music, voice files, executables and configuration files. Mark which items you created and which came from the game or another creator.
- Read the game’s current policy. Look for official mod tools, permitted distribution channels, restrictions on commercial use, requirements that users own the game, and rules on extracted assets.
- Read every third-party license. A creator may allow personal use but prohibit redistribution, commercial use, editing or inclusion in a larger pack. Keep permission records.
- Choose the least risky distribution method. An approved in-game service or publisher-hosted channel may have clearer authorization than a mirror containing copied game files. Follow any required attribution or account restrictions.
- Check the business model. Paid access, advertising, crowdfunding, subscriptions and bundled services can change both the fair-use analysis and the publisher’s contractual position.
- Remove material you cannot document. If you cannot establish that you made a file or received permission to redistribute it, do not include it merely because other uploads do.
Common situations and how to think about them
An original level that requires the player’s game
If you create the level layout and scripts but distribute no game assets, the central questions are whether the game’s tools and terms permit that kind of level and whether your upload channel is authorized. Requiring users to own the game is not, by itself, a complete license, but it can be an important condition in a publisher’s policy.

A texture or model extracted from the game
Extraction does not make an asset yours. Republishing the asset can implicate the owner’s reproduction and distribution rights and may violate the game’s terms. A mod that references an asset already installed on the user’s machine presents a different factual setup from one that includes a copy of the asset in the download.

A mod that incorporates another creator’s work
Ask for permission that covers the exact use: editing, redistribution, commercial use, inclusion in a mod pack and hosting on your chosen platform. “Credit” is valuable but is not the same as a license unless the creator’s stated terms make it so.
A paid or monetized mod
Payment can affect fair-use analysis and may directly conflict with a game’s terms. Check whether the policy permits sales, donations, crowdfunding, advertising or paid early access. A publisher’s prohibition can make the upload a service violation even if you believe the underlying use is transformative.
What to do after a copyright complaint
A takedown notice is a request to an online service provider, not a judicial ruling that the mod is infringing. If your material is removed, read the provider’s notice and preserve the files, permissions, licenses and correspondence that explain your position. Do not repost the same material on another service while ignoring the stated process.
Under the U.S. Copyright Office’s described DMCA procedure, a counter-notice must follow the provider’s required format and statements. After a valid counter-notice, the provider may repost the material no earlier than 10 and no later than 14 business days after receiving it, unless the claimant tells the provider that an infringement action has been filed. The exact result depends on the facts and the service’s process. Submitting a counter-notice can have legal consequences, so obtain advice from a qualified attorney if the dispute is significant.
How the answer changes outside the United States
Copyright exceptions, notice systems, consumer rules and enforceability of platform terms differ by country. A permission granted by a publisher may be global, regional or limited to a particular service. A creator in one country and a host in another can also create competing legal and contractual questions. If the users, host or rights holder are outside the United States, consult the law that actually governs that situation instead of treating this guide as a worldwide rule.
Bottom line for creators and players
Custom levels and mods are not automatically illegal, and they are not automatically authorized. The safest release contains files you created or are licensed to redistribute, uses an official tool or channel where available, follows the game’s current terms, and avoids republishing extracted game content or another creator’s mod. For downloading, prefer an authorized source, verify the license and confirm that the package does not contain game files that the uploader had no right to distribute. When those facts are unclear, pause and obtain permission or legal advice rather than relying on a “free mod” label.
