Are Cryptocurrency Political Donations Legal? Federal Bitcoin Rules and 2025–2026 Limits

For U.S. federal elections, bitcoin donations are legal, but they are regulated like other political contributions. An individual may give up to $3,500 to a federal candidate committee per election in the 2025–2026 cycle. The campaign must identify the donor, check source and limit rules, value the bitcoin in U.S. dollars when received, report it as an in-kind contribution, and generally sell it before using the proceeds for campaign spending.

That answer is narrower than the word “cryptocurrency” suggests. Federal Election Commission Advisory Opinion 2014-02 addresses bitcoin in a specific federal-committee proposal; it does not automatically approve every token, stablecoin, state race or local race.

What the federal rule actually permits

The Federal Election Commission (FEC) concluded in Advisory Opinion 2014-02, issued May 8, 2014, that bitcoin can be accepted as a contribution by a federal political committee. The opinion treated bitcoin as “money or anything of value” under the Federal Election Campaign Act and Commission rules. In the opinion’s words: “The Commission concluded that bitcoins may be accepted as contributions under the Act.”

Bitcoin’s digital form does not create a special exemption from contribution limits, donor-source prohibitions, treasurer screening or reporting duties. A contribution made through a wallet or exchange is still a contribution from a particular donor, for a particular amount, to a particular committee.

Bitkey Bitcoin Hardware Wallet, No Screen - Self-Custody, No Seed Phrase
  • BITCOIN EXCLUSIVE, PHONE VERIFICATION: Bitkey is designed from the ground up exclusively for bitcoin — a dedicated hardware wallet for secure bitcoin storage. Approve transactions with a tap using your phone and NFC. No device screen is required.
  • SELF-CUSTODY, NO EXCHANGE OR CUSTODIAN REQUIRED: You hold two of the three keys in the Bitkey system – one on your phone and one on your Bitkey device. The third is stored on Bitkey’s server and cannot move your bitcoin on its own.
  • NO SEED PHRASE: Set up and use Bitkey without creating or storing a seed phrase.
  • 2-of-3 MULTISIG: Three keys are stored separately across your phone, Bitkey device, and Bitkey’s server. Any two keys are required to move your bitcoin.
  • BUILT-IN RECOVERY: Encrypted backup and recovery tools can help you regain access if you lose your phone or Bitkey device. You can also designate a Recovery Contact.

The ruling is about federal political committees and the facts presented to the Commission. It is not a blanket federal approval for every digital asset, and it is not a ruling on state or municipal election law.

Federal contribution limits for 2025–2026

The applicable limit depends on the recipient. The figure most individual donors need is $3,500 per election to a federal candidate committee during the 2025–2026 cycle. The FEC’s table lists these other individual limits for the same cycle:

Recipient Individual limit Time period What the limit means
Federal candidate committee $3,500 Per election A separate limit generally applies to each election in which the candidate participates.
Political action committee (PAC) $5,000 Per year This is a different recipient category; the candidate limit does not apply.
State, district or local party committee $10,000 Per year, combined The FEC table describes a combined annual limit for these party committees.
National party committee $44,300 Per year This separate party-committee figure should not be used for candidate contributions.

“Per election” is not the same as “per calendar year.” If a candidate participates in a primary and a general election, each is ordinarily a separate election for limit purposes. A runoff or special election can create another separate limit when the candidate participates in it. The committee must allocate a contribution to the correct election rather than treating the entire cycle as one undifferentiated bucket.

Limits apply to the dollar value of the contribution, not to the number of coins or tokens transferred. Because cryptocurrency prices move continuously, the same quantity of bitcoin can represent different contribution amounts at different times.

How a campaign must handle a bitcoin contribution

1. Determine the value when the contribution arrives

The campaign should value bitcoin at its market value at the time the contribution is received. The FEC says the committee should first use a contemporaneous exchange-rate determination from the processing entity, if one is supplied. If there is no processor rate, or no processor, the committee may use another reasonable bitcoin-to-dollar exchange rate.

The valuation timestamp matters. A later sale price is not automatically the contribution value, and a donor’s estimate is not a substitute for a reasonable contemporaneous market rate. The committee should preserve the rate, time, platform or other basis used so the reported amount can be explained later.

2. Screen the donor and the amount

The treasurer must examine the contribution for compliance with the ordinary federal rules. Screening includes confirming that the donor is eligible to contribute, identifying the true source, checking the dollar value against the applicable limit and considering the donor’s other contributions to that committee and election.

A blockchain address alone is not a complete donor record. The campaign needs the contributor information required for federal reporting and must be able to associate the transfer with the person or entity making the contribution. Anonymous or inadequately identified transfers create a compliance problem even when the transaction is technically visible on a public ledger.

3. Report the receipt as an in-kind contribution

Bitcoin is reported like an in-kind contribution, using its market value at receipt. The committee should report the gross contribution value rather than silently reducing it by a processing charge. The FEC’s guidance says processor fees are reported separately as operating expenditures.

That separation preserves two distinct records: the amount the donor contributed and the expense the committee incurred to process or liquidate it. Netting the fee against the contribution can understate the receipt and obscure whether the donor exceeded a limit.

4. Hold the bitcoin only within the permitted framework

Advisory Opinion 2014-02 allowed a committee to retain received bitcoin in a wallet pending liquidation. The Commission treated the asset similarly to certain property contributions that may be held before being converted to dollars, even though ordinary campaign-depository rules generally require campaign funds to be deposited promptly.

Holding the asset does not suspend any other obligation. The committee still has to track its value, maintain donor records, report the contribution and deal with an unlawful or excessive receipt. A wallet balance is not a way to postpone compliance.

5. Sell before using the proceeds for campaign spending

The FEC did not approve the portion of the 2014 request asking whether the committee could directly buy goods or services with received bitcoin. The request did not obtain the required four affirmative votes on that question.

For practical compliance, the FEC’s later bitcoin-investment guidance says a committee must sell bitcoin and deposit the proceeds in its campaign depository before using those funds for disbursements. In other words, a committee should not pay a vendor directly from received bitcoin under the unresolved portion of the earlier opinion. The sale and deposit should be documented as part of the committee’s financial records.

6. Correct excessive or prohibited contributions

A campaign may not keep a contribution merely because it arrived through a digital wallet. If the contribution is from a prohibited source, exceeds the applicable limit or is otherwise unlawful, the committee must take the same corrective steps that would apply to a conventional contribution. Depending on the circumstances, those steps can include a refund, redesignation or reattribution within the FEC’s rules.

The obligation continues while the bitcoin is held. If the asset’s price rises or falls, the committee must still address the original compliance issue; price movement does not cure an impermissible source or excessive contribution.

A donor’s practical checklist

Before sending bitcoin to a federal committee, an individual can reduce avoidable errors by following this sequence:

  1. Confirm the race and committee. Make sure the recipient is a federal candidate committee rather than a state, local or nonfederal organization. The applicable law depends on that classification.
  2. Identify the asset. Confirm whether the committee is accepting bitcoin specifically. Do not assume that acceptance of bitcoin means the committee accepts another token or a stablecoin.
  3. Calculate the contribution in dollars. Use the committee’s stated valuation method and the market value at the time the committee receives the transfer, not simply the amount originally purchased.
  4. Check the election allocation. For a candidate, determine whether the contribution is designated for a primary, general, runoff or special election and review other contributions already made for that election.
  5. Provide complete donor information. Use the committee’s official contribution process and supply the identifying information required for federal reporting. Do not rely on an unhosted, anonymous transfer.
  6. Keep transaction records. Retain the transaction hash, date and time, asset amount, dollar valuation, processor confirmation and any receipt issued by the committee.
  7. Review the confirmation. Check that the committee recorded the intended donor, amount and election. Contact its treasurer promptly if the receipt is wrong or exceeds the permitted amount.

Splitting a transfer into multiple wallet transactions does not increase the legal limit. The relevant question is the aggregate contribution from the donor to the recipient and election, not how many blockchain transactions were used.

Bitcoin is not automatically every cryptocurrency

The federal determination identified in this guidance is bitcoin-specific. The FEC has not, on the basis of this determination alone, established an identical rule for every token, stablecoin, wrapped asset, governance token or other cryptoasset.

Another asset may raise separate questions about valuation, liquidity, custody, whether it is property or another form of value, and how a committee can liquidate it. A campaign should obtain a fact-specific analysis before accepting an asset that is not covered by its compliance procedures. Donors should ask the committee whether it has an approved process for that exact asset rather than infer approval from a generic “crypto accepted” message.

The advisory opinion also does not decide questions under laws outside the FEC’s jurisdiction, including tax or securities laws. Those issues can affect the donor, the committee, an exchange or a token issuer independently of campaign-finance compliance.

Federal elections are different from state and local elections

Federal permission to accept bitcoin does not answer whether a state legislative, gubernatorial, county, city or school-board campaign may accept it. States can define contribution sources, digital-asset treatment, reporting forms, valuation methods and limits differently. Some jurisdictions may impose restrictions that do not appear in the federal rules.

For a nonfederal race, identify the election authority that administers that race and check its current statute, regulation, guidance or advisory opinions. Ask specifically about:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • whether cryptocurrency contributions are permitted at all;
  • which assets are covered;
  • the required dollar valuation time and source;
  • donor-identification and source-verification rules;
  • limits for the particular recipient and election; and
  • whether the campaign must liquidate and deposit the asset before spending.

Do not transfer a federal limit, such as $3,500 per election, into a state or local contest unless that jurisdiction independently uses the same figure and definition.

Common compliance mistakes and how to avoid them

Using the wrong limit

A donor gives the $3,500 candidate amount to a PAC or party committee, or treats a primary and general election as one combined limit. The fix is to classify the recipient first and allocate candidate contributions by election.

Valuing the transfer at the wrong time

A campaign records the donor’s purchase price or the eventual liquidation price instead of the market value when received. The committee should document a contemporaneous processor rate or another reasonable exchange rate tied to the receipt time.

Reporting only the net proceeds

The campaign sells bitcoin, subtracts the processor fee and reports only what reaches its bank account. The contribution should be recorded at its gross market value, with the processor fee reported separately as an operating expenditure.

Spending directly from the wallet

A committee assumes that a wallet balance can be used to pay a vendor because the asset was lawfully received. Current FEC guidance calls for selling the bitcoin and depositing the proceeds in the campaign depository before disbursement.

Assuming a blockchain address proves eligibility

Public transaction data shows movement of an asset, not necessarily the donor’s identity, eligibility or cumulative giving. The committee must obtain and retain the information needed for ordinary source and limit screening.

Treating the advisory opinion as universal

FEC advisory opinions answer specific factual situations. The Commission advises that its advisory-opinion archive does not replace the statute, regulations, other opinions or court decisions. Materially different facts—especially a different asset or a nonfederal race—require separate analysis.

What a campaign should document

A defensible file for each bitcoin receipt should connect the donor, transaction and compliance calculation. Useful records include:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • the donor’s name and required identifying information;
  • the committee, election and date to which the contribution was allocated;
  • the wallet address and transaction identifier;
  • the bitcoin quantity and receipt timestamp;
  • the exchange-rate source and dollar valuation;
  • the donor’s cumulative contributions for the applicable limit;
  • screening results for source and eligibility restrictions;
  • any processor fee shown separately as an operating expenditure;
  • the wallet custody record, if the asset was held; and
  • the sale confirmation and campaign-depository deposit before any spending.

These records help the treasurer reconcile the committee’s reports with exchange statements, wallet activity and bank deposits. They also make it possible to correct an excessive or prohibited contribution promptly instead of discovering the problem after a filing deadline.

Bottom line for donors and committees

Bitcoin contributions to federal political committees are permitted under the FEC’s federal framework, but they receive no special immunity from ordinary campaign-finance rules. For 2025–2026, the headline individual-to-candidate limit is $3,500 per election, with separate limits and time periods for PACs and party committees. The campaign must screen the donor, value the bitcoin when received, report the gross in-kind contribution, separate processor fees, handle unlawful receipts and sell the bitcoin into the campaign depository before using the proceeds.

For another token or any state or local race, stop at the classification question and obtain the relevant authority’s current rule. The 2014 bitcoin opinion is important federal guidance, not a universal answer for every asset or jurisdiction.
