Usually, no—not automatically. An AI wellbeing service used through work is confidential only to the extent that its actual data flows, access controls, contracts, settings and applicable law make it so. An employer may receive participation records, identifiable answers, usage metadata, aggregate reports or recommendations about individuals. The words “private,” “secure” or “AI-powered” do not prove that HR cannot see what you enter.
The answer depends on the arrangement (who provides the service and for what purpose), the data collected, the people who can access it, and the jurisdiction. This guide explains the UK rules covered by the Information Commissioner’s Office (ICO), the US distinction made by the Department of Health and Human Services (HHS), and the questions to ask before sharing sensitive information.

What “confidential” should mean in a workplace AI tool
Confidentiality is not a single switch. It is a set of practical limits on collection, access, use, retention and disclosure. A service can encrypt a conversation while still allowing an employer administrator to see participation data or a provider to use identifiable records for another purpose.

- Recipients: the app provider, employer administrators, HR, a group health plan, a clinician or subcontractors.
- Uses: coaching and support, service evaluation, operational analytics, health and safety, absence management, insurance or employment decisions.
- Lifecycle: retention period, deletion options, backups and what happens when employment or participation ends.
An employer might receive only a de-identified, statistical report, or it might be able to connect responses to a named account. Those are materially different arrangements. You cannot determine which one applies from an app’s label or an employer’s general statement that the program is “confidential.”
The ICO states: “workers can legitimately expect that employers will respect their privacy when handling their health information.” That expectation does not eliminate the need to inspect the specific notice, configuration and contracts governing a particular service.
Can my employer see what I tell an AI wellbeing app?
Possibly. The decisive question is whether identifiable information, or information that can reasonably be linked back to you, is sent to an employer-controlled system or made available to an administrator. Some services separate individual conversations from employer reporting; others expose participation, responses or risk flags. The employer’s staff privacy notice and the provider’s current privacy notice should say what is shared, but you should also check the program’s settings and terms.

Questions to answer before entering sensitive information
- What exact information is collected: chat text, mood scores, screening answers, account details, usage metadata or device data?
- Can the provider, employer administrators, HR staff, a health plan or a clinician see identifiable entries?
- Does the employer receive individual records, participation information, aggregate statistics or recommendations about particular workers?
- Is the service limited to support and coaching, or can information be used for analytics, performance, absence, safety, insurance or employment decisions?
- How long is each category retained, and can you access or delete it?
- What happens to records when you stop using the service or leave the employer?
- Which outside providers or subcontractors receive the data?
- Is participation genuinely optional, with no disadvantage for declining or leaving?
If any answer is unclear, do not assume the most protective interpretation. Ask the employer’s privacy contact or the provider for a written explanation of the exact data flow.

UK: health information is special category data
Under the UK GDPR and the Data Protection Act 2018, information about a worker’s physical or mental health is personal data concerning health and therefore special category data. An employer needs both a lawful basis under Article 6 and an additional special category condition under Article 9. The appropriate choices depend on the purpose and circumstances; there is no blanket “workplace wellbeing” permission.
The ICO’s guidance on data protection and workers’ health information says employers should explain why information is collected, how it is used, who can access it and the circumstances in which it may be disclosed. A new use generally needs to be compatible with the original purpose, supported by specific consent or required by a clear legal obligation or function.
Monitoring must be necessary and proportionate
The ICO’s health-monitoring guidance covers workplace wellbeing, including an example in which exercise logged in an office fitness app is provided to an employer. That example illustrates that an app can share personal activity information; the presence of an app or an AI feature does not establish confidentiality.
Recommended Free Tools
Before monitoring workers’ health, an employer should consider less intrusive alternatives and demonstrate that the proposed collection is necessary and proportionate. Processing must not be unfair or discriminatory. A data protection impact assessment (DPIA) should be considered for sensitive health-information processing and is required before processing likely to result in a high risk to people’s rights and freedoms.

Why consent is rarely a simple answer
Because of the power imbalance in employment, the ICO says consent is rarely an appropriate basis for processing workers’ health data. The analysis can differ for a genuinely optional program in which a worker can decline or leave without negative consequences. Calling a program “voluntary” is not enough if access to work, benefits or opportunities is affected in practice.
Employer and provider responsibilities
The ICO’s worker-monitoring guidance says the employer remains responsible for deciding why and how monitoring occurs, even when a third-party platform performs the processing. Buying software does not transfer that responsibility. The employer must assess the particular system, define the provider’s role, put necessary contracts in place and address any AI or automated-decision-making use. The ICO page on workers’ health information was noted as under review following the Data (Use and Access) Act, so employers should verify the current guidance and legal position for the date and circumstances involved.
US: HIPAA depends on the wellness-program structure
HHS draws an important line between programs offered through a group health plan and programs offered directly by an employer. The same type of AI questionnaire can have different HIPAA treatment depending on that structure.
| Arrangement | HIPAA treatment described by HHS | Practical implication |
|---|---|---|
| Wellness program offered as part of a group health plan | Individually identifiable health information collected from or created about participants is protected health information (PHI) under HIPAA. | Access, use and disclosure are governed by the plan’s HIPAA obligations and related safeguards. |
| Program offered directly by an employer and not as part of a group health plan | Information collected from employees by the employer is not protected by HIPAA. | Other federal or state privacy, employment and consumer-protection laws may still apply. |
HIPAA therefore is not a universal shield for every workplace wellness app. If a group health plan allows the employer as plan sponsor to access PHI for plan administration without each person’s written authorization, HHS describes conditions such as plan-document changes, certification and safeguards that separate plan administration from employment functions. That is a specific arrangement, not a general rule that an employer can see plan data.

FTC expectations for health apps
The Federal Trade Commission’s Mobile Health App Interactive Tool addresses apps that collect or handle wellness and other health information. Its core warning is that an app’s privacy statements must match its actual data practices. A discrepancy between the notice and the way information is shared can create consumer-protection problems. The FTC also notes that exposure of health information can affect employment, insurance and reputation and can cause emotional distress or embarrassment.
For a US worker, the absence of HIPAA coverage does not mean the information is unregulated. The applicable protections may come from state privacy or health-data laws, federal employment rules, consumer-protection law, contractual promises and the employer’s own policies. Which rules apply requires examining the actual program and location.
Compare the arrangement, not the marketing label
Two services both called “AI wellbeing tools” can create very different privacy risks. Use the following axes when evaluating an employer’s offer.
| Comparison axis | What to establish | Why it matters |
|---|---|---|
| Who provides it | Employer directly, a group health plan, an independent clinician or an outside app provider | Determines roles, contracts and which legal framework may govern the data. |
| What is collected | Identifiable conversations or health information, participation data, device data or aggregate statistics | Content that reveals health status is more sensitive than a count of program participants. |
| Who receives it | Provider, employer administrator, plan sponsor, HR, clinician or subcontractor | Each recipient may have different access rights and duties. |
| How it is used | Support and care, program evaluation, operational analytics, health and safety or employment decisions | A use unrelated to support can change the privacy and fairness analysis. |
| Whether use is optional | Genuine choice with no consequences, or expected/required participation | Voluntariness affects the validity of consent and the risk of coercion. |
| Protections and governance | Jurisdiction, controller/processor roles, contracts, settings and retention rules | Legal protection depends on the complete data flow, not a product slogan. |
How to check a specific workplace tool
- Find the current notices. Read the provider’s privacy notice, the employer’s staff privacy notice and any program-specific FAQ. Look for categories of data, purposes, recipients, international transfers, retention and deletion.
- Identify the account model. Determine whether you create an account controlled by the provider, the employer or a health plan. Ask whether an administrator can reset your account, export records or view individual activity.
- Separate content from participation. Ask explicitly whether administrators can read conversation text or screening answers, and whether they can see login, completion or risk-status information even when content is hidden.
- Check onward sharing. Request the names or categories of subprocessors and any clinician, analytics or cloud service that receives the information. Confirm whether data is used to train or improve an AI system, if that use is described in the notice.
- Check retention and exit. Ask how long records and backups remain, whether you can delete them, and what happens after you leave the employer or stop participating.
- Check decision uses. Ask whether an automated score, recommendation or alert can influence absence management, safety action, performance processes, insurance or other employment decisions.
- Verify voluntariness. Ask what happens if you decline, pause or withdraw. A consequence-free choice is materially different from a program that managers expect everyone to use.
- Keep the answer in writing. Save the notice and the employer’s response, including the date and version, because settings and policies can change.
Warning signs that require clarification
- The only assurance is a marketing word such as “private,” “secure” or “confidential,” with no description of recipients or retention.
- The privacy notice lists broad purposes such as “business operations” without explaining whether individual records reach HR.
- The employer cannot say whether reports are aggregate or identifiable.
- Participation is called voluntary, but managers track completion or workers fear a disadvantage for declining.
- The provider’s notice and the employer’s staff notice describe different purposes or retention periods.
- An AI score or flag is used without explaining human review, appeal or the consequences of an error.
- The tool requests device permissions unrelated to the stated wellbeing service.
What employers should do before deployment
A responsible employer should map every data flow before inviting workers to use an AI wellbeing service. That includes the information entered in chat, generated in screening, inferred by an algorithm, stored in logs and sent to subcontractors. The employer should document its purpose, choose an appropriate lawful basis and special category condition where UK law applies, and complete a DPIA when the risk threshold requires one.

Procurement should verify the provider’s role, security measures, retention, deletion, incident handling, subprocessor controls and restrictions on secondary use. Contracts should match the actual configuration. If the system performs monitoring or automated decision-making, the employer should assess necessity, proportionality, fairness, discrimination risks and human oversight rather than treating the AI component as a black box.
Workers should receive a clear notice before collection begins. It should distinguish individual support from employer reporting, identify who can access each data type, explain optionality and provide a contact for questions or complaints. A less intrusive alternative should be considered where the same wellbeing objective can be achieved without identifiable monitoring.
If you are uncomfortable sharing information
Pause before entering details that could affect your privacy, employment or reputation. Ask the employer’s data-protection contact, HR privacy lead or the provider for the missing answers in writing. If the explanation still does not match the service’s behavior, use the organization’s complaint route and retain copies of the notices and responses.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteFor a legal dispute, the relevant regulator and available remedies depend on your location, the program structure and the type of data involved. UK workers may need to consider the employer’s data-protection obligations under the UK GDPR and Data Protection Act 2018. US workers may need to distinguish a group-health-plan program from an employer-direct program and then examine applicable federal or state law. This article cannot determine the legality of an individual employer’s configuration.
Bottom line for workers and employers
Treat workplace AI wellbeing conversations as potentially accessible unless the specific program proves otherwise. Confidentiality requires a documented data flow, limited access, a defined purpose, appropriate retention and protections that fit the jurisdiction and arrangement. Before using the tool, establish exactly what is collected, who receives it, how it can affect you and whether you can leave without disadvantage.
