In the United States, endorsements and claims must not mislead consumers, and material connections may need clear disclosure. In Great Britain, gambling ads also face restrictions aimed at preventing strong appeal to under-18s. A synthetic-media label or sponsorship disclosure does not fix a misleading claim, an unauthorized endorsement, or creative that breaches gambling-advertising rules.
The answer depends on where the ad runs, whom it targets, and what it depicts or claims. The rules below cover the U.S. Federal Trade Commission (FTC) baseline and selected Great Britain requirements and examples; they do not establish the law for every country, U.S. state, or territory.

What rules apply to an AI-generated casino ad?
Start with the same questions you would ask about a conventional ad: Is it truthful and supported by evidence? Does it create a misleading impression about who is speaking or what they have experienced? Does it comply with gambling-specific requirements in the markets and on the platforms where it appears?

Its guidance also recognizes that some services face additional requirements. AI production does not create a general exemption from those standards. The FTC’s advertising and marketing guidance is a useful U.S. starting point.

The FTC’s 2023 revision of its Endorsement Guides discusses virtual influencers, clear and conspicuous disclosures, platform disclosure tools, and potential liability for advertisers, endorsers, and intermediaries. The Guides are agency guidance about practices that may violate Section 5 of the FTC Act; they are not themselves regulations. They do not establish a blanket rule that every AI-generated ad must carry an AI label. A separate state law or platform policy may impose additional requirements, which need to be checked for the relevant market and service. See the FTC’s announcement of the revised Endorsement Guides.
When can a synthetic character or voice count as an endorsement?
The key issue is the impression the ad creates. A fictional, clearly fictional character is different from a synthetic person presented as a real player, customer, expert, or celebrity. Do not invent personal experience—such as claiming a character won money, tried a casino, or recommends a service based on firsthand use—when that experience did not happen. Nor should an ad attribute a real person’s opinion or endorsement without an appropriate factual basis and authorization.

These are practical applications of truthfulness and endorsement principles, not a separate blanket statutory rule specific to every AI character. A disclosure that an image or voice is AI-generated does not make a false testimonial true or establish permission to use a real person’s identity.
| Creative approach | What to check |
|---|---|
| Clearly fictional AI character | Whether the ad still implies real gambling experience, expertise, winnings, or results; whether the character or setting is likely to appeal strongly to young people where that restriction applies. |
| AI likeness or voice of a recognizable person | Whether the person’s identity and endorsement are authorized and accurately represented; whether the person or depiction triggers gambling-ad restrictions, including youth-appeal rules in Great Britain. |
| Synthetic customer testimonial or review | Whether the stated experience actually occurred and whether performance, odds, bonus, or winnings claims are supported. Do not imply an actual customer’s experience where none exists. |
When should an endorsement disclose a material connection?
In the U.S. endorsement context, the FTC says a connection that could affect how consumers evaluate an endorsement may be material. Examples include payment, free or discounted products or services, employment, and personal or family relationships. The disclosure should be easy to notice and understand, and placed with the endorsement rather than buried elsewhere.

- Use plain language such as “ad” or “sponsored” near the endorsement.
- For video, the FTC recommends putting the disclosure in the video; using both audio and visual disclosure increases the chance viewers notice it.
- Do not rely only on a profile bio, a disclosure hidden behind “more,” or a platform’s paid-partnership tool. A platform label may not be sufficient on its own.
- An endorser should not claim to have tried a service they have not tried, or repeat a claim the advertiser cannot substantiate.
The FTC’s Disclosures 101 for Social Media Influencers explains these principles. It also says U.S. law may apply to a post made abroad when effects on U.S. consumers are reasonably foreseeable; another country’s law may apply as well.
What additional restrictions apply in Great Britain?
Great Britain’s gambling-advertising rules add an audience and content test. CAP/ASA guidance says gambling ads must be socially responsible and must not be likely to have strong appeal to under-18s. That assessment can include the person or character featured, their social-media following, the sport or other context, and the ad’s overall presentation. The CAP/ASA guidance updated 14 October 2025 says a total of 100,000 social-media follower accounts registered to under-18s across platforms is an indicative rule of thumb for a personality’s strong appeal—not an automatic safe harbor or a universal bright line. Other factors can matter, and a personality may be judged strongly appealing below that figure or not strongly appealing above it.

An AI depiction does not prevent regulators from considering who the depicted person is or how the creative may appeal to children. In a 16 September 2026 ruling involving Dribble Media Ltd t/a Midnite, the ASA considered an ad with an AI-generated depiction of footballer Trent Alexander-Arnold. It found consumers would clearly recognize him and that the ad was likely to have strong appeal to under-18s, so it ruled the ad irresponsible under the gambling advertising code. This is an example concerning a particular gambling ad and recognizable footballer, not a finding that every AI-generated gambling ad is unlawful. Read the ASA ruling.

Does an “AI-generated” or “sponsored” label make the ad compliant?
No. These labels address different questions. “AI-generated” describes how content was made; it does not prove the ad is truthful, authorized, or suitable for its audience. “Sponsored” or “ad” signals a commercial relationship; it does not cure an unsupported claim or override gambling-specific audience restrictions. Whether an AI label is separately required depends on the applicable law and platform rules; the sources here do not establish a universal U.S. AI-label mandate for every ad format.
What to check before publishing
- Map the audience and markets. Identify the countries and, in the U.S., states the campaign targets or may reach. Check the gambling license, local advertising requirements, and relevant platform policies for each market.
- Review every claim. Verify statements about odds, bonuses, winnings, safety, or user experience. Make sure evidence supports the claim and the ad does not imply results or personal experience that are not real.
- Check identity and permission. Decide whether a character is wholly fictional or recognizably represents a real person. Confirm the basis and authorization for any actual endorsement, likeness, or voice.
- Place disclosures with the message. Where an endorsement has a material connection, use clear language close to it. For video, make the disclosure visible and consider making it audible too; do not assume a platform tool is enough.
- Assess gambling audience and presentation. In Great Britain, review the character, following, context, and creative for likely strong appeal to under-18s. Consider both paid placements and operator-owned social content.
- Assign review and removal responsibility. Make clear who checks the creative before publication and who can amend or take it down if a regulator, platform, or new information raises a compliance concern.
Because the relevant gambling license, state or national rules, and platform policies depend on where an ad runs, this U.S. and Great Britain overview cannot establish legality for every campaign. A campaign intended for a specific market needs a review against that market’s current requirements.
