Usually, you should not treat a consumer AI chat as confidential. A conversation can be stored, reviewed for limited purposes, used to improve models depending on your settings, or retained longer for safety or legal reasons. Those are separate questions, and the answers vary by provider, account type, workspace, settings, and applicable law. OpenAI and Anthropic publish specific consumer-service rules; those examples do not establish the rules for every chatbot.
What does “confidential” mean for an AI chat?
People use “confidential” to mean several different things: that a conversation is not saved, is not used to improve models, cannot be seen by a person, is erased immediately when deleted, or cannot be disclosed in response to a legal request. A provider’s answer to one of those questions does not answer the others.

For example, turning off model improvement does not necessarily turn off storage or safety review. A temporary-chat setting does not necessarily mean the service keeps no copy. And deleting a chat from the screen does not necessarily erase it from backend systems at that moment.
Consumer services and managed business or API products can also have different terms. A paid account is not automatically a confidential or legally privileged channel; check the specific service terms, workspace configuration, and any agreement that governs your use.

How long are AI chats stored?
The rules below are provider policy statements for the named services, not measurements of how long every user’s data actually remains accessible. They apply to the specified consumer products and can be subject to exceptions.

Temporary Chat is not the same as no storage
OpenAI says Temporary Chats do not appear in history unless saved, and it may keep a copy for up to 30 days for safety. If a Temporary Chat is saved, it becomes a regular chat. OpenAI also says a temporary conversation does not create or update memories and is not used to improve models while it remains temporary. Existing memories, custom instructions, or plugins can still affect how a temporary conversation is used, so check those personalization controls before sharing sensitive material. These Temporary Chat details come from OpenAI’s consumer data guidance and are policy periods, not measured deletion statistics.
Deleting a chat may not delete every related item
OpenAI says files saved to Library can be stored separately from a conversation. If you want a file removed, check and delete it separately rather than assuming that deleting the chat also removes the Library copy. Workspace retention rules may also affect what happens to chats in managed accounts.

Can a human read my AI chats?
OpenAI says a limited number of authorized employees and trusted service providers may access content when needed for abuse or security investigations, customer support or troubleshooting, legal matters, or model improvement unless the user has opted out of that use. It describes access as controlled and need-to-know, and says access is monitored and logged. OpenAI also says it does not sell user data or share ChatGPT conversations with advertisers. These statements describe limits and purposes; they are not a guarantee that no person could ever see a chat.
OpenAI’s consumer-services data guidance puts the caution plainly: “Please do not enter sensitive information that you would not want reviewed or used.”
Anthropic’s consumer retention information establishes deletion and training-retention rules, but does not provide a basis here for a matching, comprehensive claim about all circumstances in which people may access consumer Claude conversations. Do not assume a consumer chat is unreadable by staff simply because a policy page does not describe every access scenario.

Are my chats used to train or improve AI?
Model improvement and data storage are different controls. A chat might not be used to improve a model but still be kept for the service’s other stated purposes; conversely, a setting that permits improvement can affect how long some data is retained.

ChatGPT
For ChatGPT consumer content, OpenAI says use for model improvement depends on the user’s settings. For ChatGPT Business, Enterprise, Edu, and Healthcare workspaces, and the API Platform, OpenAI says data is not used to improve models by default, although organizations may choose to share data where that option is available. OpenAI’s privacy policy says its consumer privacy policy does not govern business-offering content such as API data; customer agreements govern that data.
Claude
Anthropic says that if a consumer allows chats or coding sessions to improve Claude, it may retain the relevant data in de-identified form for up to five years in model-training pipelines. In its July 1, 2026 article, Anthropic says this applies to new or resumed chats after the model-improvement setting is enabled.

Anthropic says switching the setting off stops previous or new chats from being used for future training, but it does not undo training runs already underway or remove information from models already trained. Turning off future use should therefore not be understood as reversing processing that has already happened.

No. On both services described above, removal from the visible chat history happens before the stated backend deletion period ends. OpenAI says it schedules deleted saved chats for deletion within 30 days, with the exceptions listed in its retention guidance. Anthropic says deleted consumer conversations are deleted from backend storage within 30 days. These are policy timelines, not a promise of instantaneous erasure from every system or backup.
OpenAI’s Temporary Chat has a different purpose and its own safety-copy policy: it may be retained for up to 30 days even though it does not appear in history unless saved. “Temporary” therefore should not be read as “never stored.”

Can an AI company give chats to law enforcement?
Provider terms and applicable law govern what can be retained or disclosed; there is no universal answer for every provider, request, or jurisdiction. OpenAI’s documentation says content may be retained longer when security or legal obligations require it, and its privacy policy lists compliance with legal obligations as a purpose for processing personal data. That establishes an exception to routine deletion, but it does not establish that every request is honored, what legal instrument is required in every case, or how the rules work in every country.
The Anthropic materials described here distinguish consumer and commercial retention and mention legal-retention exceptions in a covered-model context. They do not establish a single legal-request standard for all Claude chats and jurisdictions. Avoid treating a general policy statement as a guarantee about a particular request or legal proceeding.
Do business and API chats follow the same rules?
Not necessarily. Consumer accounts, managed workspaces, and API products can be governed by different defaults and agreements. OpenAI says its Business, Enterprise, Edu, and Healthcare workspaces and API Platform are not used for model improvement by default; its privacy policy points business-offering content to customer agreements. That does not make every business configuration identical or eliminate other retention and access terms.

Anthropic likewise directs commercial products and API users to separate policies. Its covered-model retention page, effective June 9, 2026, concerns specified organizational configurations using zero data retention, including certain API and cloud-provider arrangements. For those covered organizational uses, designated model prompts and outputs are retained for 30 days for safety work. The page says ordinary consumer Free, Pro, and Max plans are unaffected by that update because those surfaces already retain inputs and outputs. It also describes controlled access for covered organizational data, with human review possible through a controlled path, for example when safety systems flag content. Those special organizational terms should not be applied to all consumer Claude conversations.
Anthropic’s platform documentation describes zero data retention as an organization-level arrangement for eligible API endpoints and features, with exclusions. It is not a general consumer incognito setting. For a work use case, verify the exact endpoint, feature, account configuration, exclusions, and contract rather than relying on the label alone.
How to reduce exposure before sharing information
- Keep high-risk details out of consumer chats. Avoid entering passwords, authentication codes, trade secrets, identifying medical records, financial account details, or another person’s sensitive information unless you have checked the relevant policy and have a sound reason.
- Review model-improvement controls before sharing. Turning off improvement is not the same as turning off storage or guaranteeing that no safety review can occur.
- Use temporary modes with their stated limits. For OpenAI Temporary Chat, for example, the service says it may retain a safety copy for up to 30 days.
- Delete related material separately where needed. Delete the conversation and check for separately stored files, projects, or workspace copies; OpenAI specifically says Library files can be stored separately from chats.
- For contractual confidentiality, verify the actual arrangement. Use a business service or local/on-device workflow only after confirming the terms, configuration, and applicable law meet the requirement. A paid tier by itself does not establish professional privilege or legal confidentiality.
For other chatbots, check the service’s own current privacy, retention, model-improvement, and legal-request terms. The OpenAI and Anthropic policies summarized here cannot establish current rules for Gemini, Copilot, Meta AI, Grok, DeepSeek, or other services.
