AI agents are not automatically safe for public services. A city can use one responsibly only when it can show that the proposed use has a clear public benefit, bounded autonomy, appropriate data controls, meaningful human oversight, resident redress, vendor accountability, and continuous monitoring. The stricter the consequence—loss of a benefit, a safety risk, an enforcement action, or a decision about a person’s rights—the stronger those controls must be.
This guide gives city leaders, procurement teams, service owners, legal staff, and community advocates a practical review framework. It treats an agent as a sociotechnical system, not merely a chatbot, and explains what to ask before approving deployment.

What an AI agent can—and cannot—safely do in government
An AI agent is software that can interpret inputs, reason over information, use tools, and take one or more actions toward a goal. In a public-service setting, that might mean answering questions from a knowledge base, drafting a permit response, routing a case, scheduling an inspection, or writing to a case-management system. Some agents only suggest text; others can independently call APIs, change records, send messages, or trigger transactions.
The label itself does not settle the legal or safety question. The European Commission AI Act Service Desk says that “AI agents are not a separate category of AI under the AI Act.” The definitions of an AI system and a general-purpose AI model cover agents; obligations depend on what the system does and its risk classification. For agents that interact with people or generate content, transparency rules apply from 2 August 2026. High-risk obligations apply on later dates when the system meets the relevant classification.

Risk rises when an agent can affect access to essential services or benefits, health, safety, money, legal status, enforcement, or critical infrastructure. The European Commission lists access to essential public services and benefits among high-risk use cases. Deployers of applicable high-risk systems must complete a fundamental-rights impact assessment before first use and assign enabled human oversight.
The OECD/UNESCO G7 Toolkit describes potential gains: AI can improve internal efficiency, policymaking, public-service responsiveness, transparency, and accountability. Those gains are possibilities, not a safety certificate. NIST’s AI Risk Management Framework treats trustworthy AI as a lifecycle activity spanning design, development, deployment, use, and evaluation.
Start with the public problem, not the model
Define the outcome and the baseline
Write down the specific problem in operational terms. “Use an agent” is not a problem statement. A defensible statement might be “reduce the time residents wait for an answer about recycling rules while preserving a phone and in-person option.” Record the current response time, error rate, staffing burden, accessibility gaps, and cost. Specify the measurable outcome that would justify deployment.

Test whether a simpler tool is safer
Compare an agent with a searchable, curated website; a rules-based workflow; a form with validation; or additional staff training. A retrieval tool that quotes approved documents is usually easier to constrain than an agent that invents answers and calls external systems. If a simpler design delivers the benefit with fewer failure modes, choose it.
Document whole-of-life consequences
The UK government’s procurement guidance says an impact assessment should cover user needs and public benefit, effects on the existing technical and procedural environment, and whole-of-life costs. Include integration, accessibility work, testing, monitoring, support, model or prompt changes, retraining, incident response, and eventual exit—not just the subscription or implementation price.

Map who could be harmed
Make a written map of everyone touched by the system: applicants, residents, employees, contractors, children, people with disabilities, language communities, people without reliable internet access, and bystanders whose data may appear in a record. Include staff who must correct the agent’s work.
For each group, ask what an error would do. Could it deny or delay a benefit, expose private information, produce an incorrect bill, trigger an inspection or penalty, misroute an emergency request, or give unsafe health information? New York City legislative text uses “public-impacting artificial intelligence” for systems reasonably expected to materially affect rights, liberties, benefits, safety, interests, or access to city services. That is a useful screening concept even where the text is not the governing law.
Recommended Free Tools
Do not average away severe harms because most interactions are harmless. A low-risk information bot and a benefits-eligibility recommender may use similar language models but require very different approval thresholds.
Inventory the data and every connected system
Record what enters the agent
- Source and legal authority for each dataset.
- Retention period, deletion method, and who can access prompts, files, logs, and outputs.
- Whether data is used for vendor training, fine-tuning, evaluation, or product improvement.
- Presence of health, financial, biometric, immigration, criminal-justice, or other protected information.
- Language, disability, age, and geographic coverage, including missing or outdated records.
Test data quality, representativeness, inaccuracy, bias, privacy leakage, and unintended consequences. The UK guidance specifically calls for these assessments and documented mitigations.
Record what the agent can change
Draw a data-flow and tool-permission diagram. Distinguish reading a public FAQ from writing to a benefits database, changing an address, scheduling an inspection, issuing a notice, or initiating a payment. Apply least privilege: separate read, draft, recommend, approve, and execute permissions. Use transaction limits, allow-lists for tools and destinations, approval gates, immutable logs, rollback procedures, and a tested kill switch.

| Design | Typical action | Relative risk | Minimum control emphasis |
|---|---|---|---|
| Informational | Answers from an approved public knowledge base | Lower, if no personal data or transaction is involved | Source citations, freshness checks, accessibility, clear AI disclosure, human contact option |
| Drafting | Prepares a letter or case summary for an employee | Moderate | Human review, visible provenance, confidentiality controls, correction workflow |
| Recommendation | Ranks cases or suggests eligibility or inspection priority | High | Impact assessment, disparate-error testing, reasons a reviewer can inspect, override authority, audit trail |
| Approval-gated action | Creates a payment, appointment, or notice after an authorized person confirms | High | Two-step authorization where appropriate, transaction limits, confirmation details, rollback, trained reviewer |
| Independent action | Changes records, communicates a decision, or invokes external systems without case-by-case approval | Highest | Exceptional justification, narrow scope, continuous monitoring, emergency stop, tested fallback, executive accountability |
Compare alternatives on impact, autonomy, data sensitivity, reversibility, accountability, operational resilience, equity and accessibility, and lifecycle cost. A design that is easy to reverse and limited to public information is materially different from one that makes durable decisions about a person.
Make human oversight real
“Human in the loop” is not a safety control if the reviewer lacks time, context, authority, or a practical way to disagree. Name the responsible official or team. Give them the input data, the agent’s sources and confidence limitations, relevant policy, and a clear explanation of what the system did. Train reviewers to recognize hallucinations, automation bias, discriminatory patterns, and prompt-injection effects.
The reviewer must be able to edit, reject, reverse, or stop an action without asking the vendor for permission. Set service-level targets for review so a queue does not turn nominal oversight into an automatic approval. Portland’s BTS-4.04 rule, effective 6 March 2026, requires review proportionate to impacts on health, safety, rights, or financial well-being. For applicable EU high-risk systems, the deployer must assign a person or persons sufficiently equipped and enabled for oversight.
Tell residents and provide a route to redress
Use plain-language disclosure
Tell people when an AI system is involved, what role it plays, what information it uses, whether a person reviews the result, and which office remains accountable. Disclosure should be placed where the interaction occurs, not hidden in a general privacy policy. Australia’s Policy for the responsible use of AI in government, Version 2.0, effective 15 December 2025, requires transparency statements and internal use-case registers. Portland requires communication when AI interacts with the public or influences public-facing services.

Preserve human alternatives
Provide a phone, in-person, accessible digital, or written route appropriate to the service. A resident should not have to persuade an automated system that it made a mistake before reaching a person.
Make appeals actionable
Explain how to request human review, correct inaccurate data, challenge an outcome, and obtain a response. Record the request, preserve the relevant prompt, model version, tools, data, and output, and provide a decision deadline. Do not let an agent close its own appeal or rewrite the evidence used to decide it.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Put enforceable requirements in the procurement contract
A city remains accountable for public decisions and service outcomes even when a vendor supplies the model or platform. Boston’s policy states: “City employees that choose to use Gen AI tools in their work maintain ultimate responsibility for their work product and its downstream impact on constituents and City operations.” Contract language must make that responsibility operational rather than symbolic.
| Contract area | Questions and requirements |
|---|---|
| Model behavior | What are known limitations, prohibited uses, adaptive components, update cadence, and evaluation results relevant to this use case? |
| Data handling | Is city data used for training, fine-tuning, evaluation, or improvement? Where is it stored, for how long, and how is deletion verified? |
| Security and privacy | Require access controls, encryption, tenant isolation, vulnerability reporting, incident notification deadlines, and cooperation with investigations. |
| Accessibility and language | Specify supported languages, disability access, testing with affected users, and performance thresholds by language and channel. |
| Audit and testing | Reserve rights to inspect documentation, test the system, reproduce outputs, review logs, and use an independent assessor. |
| Change control | Require advance notice and approval for model, prompt, tool, data, policy, or hosting changes; define regression testing before release. |
| Subcontractors | Disclose all subprocessors and bind them to equivalent confidentiality, security, audit, and deletion obligations. |
| Continuity and exit | Provide exportable records, migration help, fallback operation, service credits or remedies, suspension rights, and termination assistance. |
Portland requires a pre-procurement risk assessment and vendor disclosures about whether city data is used for training, fine-tuning, evaluation, or improvement. Treat those disclosures as contract commitments, not sales assurances.
Test before launch and monitor after it
Set acceptance tests and a go/no-go gate
Use representative, edge-case, adversarial, multilingual, and accessibility test sets. Define acceptable thresholds for factual accuracy, unsupported claims, privacy leakage, unauthorized tool calls, latency, and successful completion. For decisions or recommendations, measure error rates and false positives and negatives for affected groups. Document mitigations, the owner who accepts residual risk, and the authority that can say no.
Best Value
Monitor outcomes, not just uptime
- Accuracy and hallucination rates by service, language, and channel.
- Disparate error rates and differences in escalation or override rates.
- Privacy incidents, security events, prompt-injection attempts, and unauthorized actions.
- Model or data drift, response time, outages, and fallback usage.
- Resident complaints, appeals, corrections, accessibility failures, and final service outcomes.
Reassess after any model, prompt, tool, data, policy, or vendor change. NIST’s lifecycle approach and the UK guidance both support recurring evaluation rather than a one-time approval.
Prepare for failure, misuse, and retirement
Before launch, run tabletop exercises for a confidently wrong answer, exposed personal data, a discriminatory recommendation, an unauthorized transaction, a vendor outage, a malicious document, and a model update that changes behavior. Assign an incident commander, notification responsibilities, evidence-preservation rules, and a resident correction process.
Define stop conditions in advance: for example, a confirmed privacy breach, unexplained disparity above the approved threshold, repeated unauthorized actions, inability to provide required human review, or loss of reliable logs. The stop authority must be able to disable the agent immediately. Maintain a manual or alternate digital service so stopping the system does not stop access to the public service itself. Retirement should include data deletion, record retention required by law, resident notice where appropriate, and export of information needed for appeals.
A practical pre-deployment checklist
- Problem and benefit: State the public need, baseline, measurable outcome, and why a simpler tool is insufficient.
- Impact map: Identify affected residents, workers, bystanders, rights, benefits, safety, financial, and accessibility consequences.
- Risk classification: Determine applicable federal, state, local, and international requirements, including whether the use is high risk.
- Data inventory: Record sources, authority, sensitivity, quality, retention, access, and training use.
- Autonomy boundary: List every tool and action; apply least privilege, approval gates, limits, logs, rollback, and a kill switch.
- Oversight design: Name an accountable owner and equip trained reviewers with time, information, authority, and escalation paths.
- Resident rights: Publish disclosure, human-contact, correction, appeal, and response-time procedures.
- Contract controls: Bind the vendor on security, privacy, accessibility, audit, incidents, changes, subcontractors, and exit.
- Testing: Run representative and adversarial tests, measure subgroup outcomes, and document mitigations.
- Operations: Define metrics, monitoring, incident response, fallback service, stop conditions, and reassessment triggers.
- Approval: Record the go/no-go decision, residual risks, accountable official, review date, and retirement criteria.
What the evidence does not establish
There is no single cross-jurisdiction numeric safety score or universal failure-rate statistic for municipal AI agents in the reviewed official guidance. A city should not claim that an agent is “99% safe” or rely on a generic benchmark. Safety must be demonstrated for the particular workflow, population, data, permissions, and consequences, with outcome reporting that residents and oversight bodies can inspect.
The Bottom Line
An AI agent is appropriate for a public service only when the city can explain the problem it solves, limit what it can do, protect the data it touches, provide empowered human oversight, give residents disclosure and redress, hold the vendor to enforceable terms, and stop or replace the system when evidence shows unacceptable harm.
