Apple and the U.S. Department of Justice were in early settlement discussions in July 2026 over the DOJ’s smartphone antitrust lawsuit, but no final deal or trial date had been announced. Developers’ central concern is that Apple could settle without materially loosening its control over App Store distribution, payments, ranking and access to iPhone capabilities.
What Apple and the DOJ are negotiating
The talks concern the civil antitrust case the DOJ and state attorneys general filed on March 21, 2024. Apple’s third-quarter 2026 Form 10-Q says the government alleges monopolization or attempted monopolization in the “performance smartphones” and “smartphones” markets and seeks equitable relief.

The Information reported in July 2026 that Apple and the DOJ had entered early settlement discussions and that developers, including PayPal and Epic Games, had raised concerns with the department. MacRumors reported that Apple had made several offers, while stressing that an agreement was not guaranteed and that no trial had been scheduled.
Because no public term sheet exists, the talks do not establish that Apple has agreed to lower commissions, open particular iPhone features or change App Store rules. Those outcomes would depend on the final remedy and how it is enforced.

What the underlying lawsuit alleges
The DOJ’s case description identifies several practices the government considers exclusionary:
- Restricting “super apps” that combine multiple services in one application.
- Limiting cloud-gaming services.
- Favoring Apple’s Messages service over competing messaging products.
- Limiting third-party digital wallets and smartwatches from accessing functions available to Apple’s own products.
These allegations are broader than a dispute over the App Store’s commission rate. They address whether Apple can use control of iOS and the iPhone to disadvantage products that compete with Apple’s services or depend on access to platform capabilities.
Why developers fear a weak remedy
A settlement could preserve practical control
A settlement might prohibit specific conduct and require interoperability, or it might largely formalize changes Apple has already made while leaving the company with substantial discretion over distribution, review and platform access. Developers want remedies that change how the platform operates, not only promises that repeat existing policies.

Access to iPhone features is difficult to measure
For a competing wallet, smartwatch, messaging service or cloud-gaming provider, access can depend on technical interfaces, approval decisions and the terms attached to those interfaces. A remedy that does not define objective access standards could leave developers dependent on case-by-case negotiations with Apple.
Payment rules remain especially sensitive
Developers also want clarity about whether Apple can continue charging a commission when an app directs a customer to pay elsewhere. The DOJ settlement talks and the separate Epic litigation address related economic pressure, but they are not the same case and could produce different rules.
The separate Epic payment-link litigation
Apple’s SEC filing records that an injunction in the Epic case in 2025 barred Apple from imposing commissions or fees on certain purchases made outside an app and from restricting how developers guided users to those purchases.

On December 11, 2025, the Ninth Circuit allowed Apple to charge some commission on link-out purchases and sent the matter back for modification. Apple petitioned the Supreme Court, which granted review on June 30, 2026. The Supreme Court proceeding therefore remains a separate source of uncertainty for external-payment links, regardless of what the DOJ and Apple eventually agree.

What the UK’s approach shows
The UK Competition and Markets Authority announced commitments from Apple and Google on February 10, 2026. The package illustrates a more specific regulatory model, although it does not determine what a U.S. settlement will contain.

The CMA said Apple and Google’s mobile platforms cover around 90–100% of UK mobile devices. It associated the mobile ecosystem with 1.5% of UK GDP and around 400,000 UK jobs in figures published in 2026. Those figures explain why the UK regulator treated platform rules as an economy-wide issue, but they are not estimates of the effect of the U.S. case.

Developers’ concerns point to several questions that any final agreement would need to answer in enforceable language:

- Interoperability: Which iPhone and iOS functions must be available to rivals, on what technical terms and within what response time?
- Non-discrimination: How will the agreement prevent Apple from favoring its own apps or devices through access, performance or review decisions?
- Review and ranking: What objective standards, explanations and appeal rights will apply when Apple reviews or ranks competing apps?
- Developer data: May Apple use information collected during review or distribution to compete with the developer that supplied it?
- Payments: Can developers tell users about outside payment options, and can Apple charge a commission when a user follows such a link?
- Enforcement: Which monitor, court or agency will investigate violations, and what happens when Apple misses a deadline or repeats the conduct?
Without answers to those questions, a headline commitment to “fairness” would be difficult for developers to evaluate or enforce.
What developers should watch next
- A filed settlement or consent decree: This will reveal the covered conduct, definitions, exemptions and enforcement authority.
- Any public changes to Apple’s offers: Reports of proposals are not binding until the parties file an agreement.
- The Supreme Court’s treatment of the Epic case: Its review could affect commissions and link-out rules independently of the DOJ matter.
- Implementation details: Reporting duties, complaint procedures, deadlines and penalties will determine whether a remedy changes day-to-day platform decisions.
- Technical access terms: Developers should look for documentation and objective eligibility criteria, not only broad statements about interoperability.
Current outlook
As of July 2026, the DOJ-Apple matter remained an early, unsettled negotiation. The government’s case reaches beyond payment fees to control over smartphone functions and competitive services, while the Epic litigation separately addresses outside-app purchases and commissions. The UK commitments demonstrate that review transparency, limits on use of developer data and a formal interoperability process are possible remedy components, but they do not predict the terms of a U.S. deal.
Until a settlement is filed and its enforcement mechanism is clear, developers cannot assume lower fees, guaranteed access to iPhone features or an end to Apple’s ability to monetize outside-App-Store payments.
