Apple and OpenAI-related defendants are disputing what evidence and arguments should be considered at a reported October 14, 2026, hearing on Apple’s request for a preliminary injunction. Apple says the defendants’ objections to evidence in its reply went further, adding arguments and evidence of their own. The court’s decision on that procedural dispute—and the underlying trade-secret allegations—has not been established in the reporting reviewed.
What is the October 14 hearing about?
Current reporting says the U.S. District Court for the Northern District of California is scheduled to hear Apple’s motion for a preliminary injunction on October 14, 2026. Apple is seeking interim restrictions related to the use or disclosure of information it alleges is protected trade-secret material while the lawsuit proceeds. A request for an injunction is not a ruling that the requested restrictions are justified. Current reporting on the hearing

Apple filed a reply in support of its injunction request that included expert declarations. Defendants objected to material they characterized as new evidence. In a response dated October 5, Apple argued that the defendants did more than object: according to Apple, they introduced additional arguments and evidence themselves. These are competing descriptions of the briefing, not findings by the judge. Reporting on the exchange does not establish which disputed materials the court will consider. Apple filed the case on July 10, 2026, in the Northern District of California. The docket mirror identifies it as Apple Inc. v. Liu et al., case number 5:26-cv-07078, and lists OpenAI-related entities, io Products, and former Apple employees Chang Liu and Tang Yew Tan among the defendants. Apple’s complaint asserts trade-secret misappropriation and breach-of-contract claims. Case docket listing
Apple alleges that former employees accessed or took confidential information and that it was used in OpenAI hardware work. In its filing, Apple characterized the case as being about former employees stealing its trade secrets for OpenAI’s benefit; that is Apple’s allegation, not an established fact. OpenAI, in its public response when the suit was filed, denied interest in other companies’ trade secrets. The claims and denial remain party positions. What has the court decided?
The reviewed reporting does not identify a court decision resolving Apple’s October 5 accusation, determining whether the disputed evidence or arguments may be considered, or deciding the merits of the trade-secret claims. The hearing is reported as upcoming; do not treat Apple’s allegations, defendants’ objections, or either side’s account of the filings as a judicial finding.
