Anthropic is urging Congress to strengthen federal rules for testing frontier AI systems for catastrophic risks. The proposal described in a Politico report would put primary duties on developers: test their own models, report identified risks and mitigation plans to the Commerce Department, and face possible court action if safeguards are judged inadequate.
That is not the same as giving the government an instant “kill switch.” The reported framework would rely on a duty of care and a government lawsuit seeking an injunction, while a separate 2026 bill would require developers to maintain technical means to suspend or shut down systems capable of catastrophic harm. The proposal’s formal bill number, sponsors and legislative status have not been established in the public account, so it should not be treated as enacted law.

What Anthropic is asking lawmakers to change
The Washington Post reported on Aug. 3, 2026, that Anthropic was working with lawmakers to strengthen the testing regime in the Thune-Klobuchar frontier-AI proposal. An Anthropic spokesperson told the newspaper, “We continue to work with the committee to make the bill stronger in how it addresses catastrophic risk.”

Anthropic also raised concerns about federal language that could preempt state AI laws. That places the company in a complicated position: it is seeking stronger national oversight for the most capable models while resisting a federal framework that might remove states’ ability to impose additional requirements.

How the reported duty-of-care model would work
The account attributed to Politico describes a sequence that resembles a legal duty of care rather than a standing government off-switch:
- Developer testing: A frontier-AI developer would assess its own model for catastrophic risks before or around deployment.
- Risk and mitigation reports: The developer would report identified risks and the steps taken to reduce them to the Commerce Department.
- Government review and enforcement: If mitigation were inadequate, the government could bring a lawsuit.
- Possible injunction: A court could be asked to order the model shut down until the developer addresses the danger.
The distinction matters. A court-ordered injunction would require a legal case and a finding that the developer’s safeguards were insufficient. It would not necessarily allow an agency to disable any model immediately, and the public account does not specify the exact evidentiary threshold, timetable or appeal process.

Who would test frontier models?
Testing authority is one of the proposal’s central unresolved questions. A developer-led system could use the company’s technical access and specialized knowledge, but it also creates an obvious conflict: the company that benefits from releasing a model would be assessing its own safety.
Independent auditors or government-linked evaluators could provide more separation from commercial incentives. They would, however, need access to model weights, confidential security information and expensive computing resources. The available accounts do not establish whether the proposal would require independent testing, certify outside auditors, or create a federal evaluation body.

The Associated Press reported on Sept. 27, 2026, that Anthropic and OpenAI were arguing that advanced AI systems are dangerous and should be regulated and independently tested. AP summarized the companies’ position this way: “The CEOs of Anthropic and OpenAI recently declared America’s cutting-edge models are so powerful, they’re dangerous, and need to be regulated and independently tested before being released.” That statement supports independent evaluation as a policy goal, but it does not settle how such a requirement would be written or funded.
Would the proposal let the government shut down an AI model?
Potentially, but through the courts and only after an alleged failure to mitigate a serious risk. In the reported duty-of-care architecture, the government could seek an injunction to stop operation of a model when the developer’s mitigation was inadequate. The account does not describe an automatic shutdown power triggered by a single test result.

That approach differs from the AI Kill Switch Act. An official House release said that bill would require developers of advanced AI systems capable of catastrophic harm to maintain ways to suspend or shut down those systems. The requirement concerns the technical ability to stop a system; it is separate from the legal question of when the government may order that capability to be used.

How it fits with other 2026 AI bills
Congress is considering several different ways to address increasingly capable systems. PolitiFact’s Sept. 14, 2026 overview identified the Frontier Act, the AI Kill Switch Act, a proposed ban on superintelligent AI and a bill aimed at rogue AI agents. They target different objects and use different intervention theories.

The federal-versus-state dispute
Anthropic’s concern about preemption could determine whether the federal bill becomes a ceiling or a floor. A preemption clause could prevent states from enforcing stricter rules on testing, disclosures or liability. Preserving state authority would allow additional safeguards, but companies could face different obligations in different jurisdictions.
The public reporting does not establish which approach the draft ultimately takes. That omission is consequential because a national testing and reporting system would interact with existing state privacy, consumer-protection and safety laws even if those laws are not aimed specifically at frontier models.
