An October 2026 policy action reported by Axios targets PERM labor certification at specified employers—not the H-1B visa program itself. It does not, on the available account, suspend H-1B status or cancel existing H-1B visas. Amazon’s reported layoffs and its H-1B approval totals have prompted questions about U.S. hiring, but those figures do not show that visa policy caused the cuts or that H-1B workers replaced laid-off employees. The phrase “Lay me off” has not been verified as a statement by a specific Amazon worker.
What the October 2026 action does—and does not—target
Axios reported in October 2026 that the announced action blocks a green-card sponsorship pathway for workers at specified employers by targeting PERM labor certifications. PERM is a labor-certification step in some employer-sponsored permanent-residency cases. It is not the H-1B visa program.
That distinction matters because an H-1B visa provides temporary work authorization, while PERM is part of certain routes toward permanent residence. Brookings describes H-1B as an employer-sponsored visa for specialty occupations, generally granted for three years with a possible three-year extension. A change affecting PERM therefore should not be described as a blanket suspension of H-1B employment.
| Question | H-1B | PERM |
|---|---|---|
| Purpose | Temporary work authorization for specialty occupations; Brookings describes a typical three-year period with a possible three-year extension. | Labor certification used in some employer-sponsored permanent-residency pathways. |
| What the October action targets | Axios reported that H-1B status is not suspended and existing H-1B visas are not canceled. | PERM sponsorship for workers at specified employers, according to Axios. |
| Who is covered | The action is not described as applying to every H-1B holder. | Workers connected to the specified employers, not all employment-based green-card applicants by default. |
The available Axios account does not establish that already-issued green cards are being revoked. Nor should the reported PERM restriction be treated as a decision on every worker’s immigration status: the effect depends on the person’s pathway and circumstances. Workers with an application in progress should get case-specific advice from their employer’s immigration counsel or a qualified immigration lawyer.

What Amazon’s H-1B numbers show
Brookings reported that Amazon had the highest company total of H-1B approvals in fiscal year 2025, with more than 13,000 approvals, and recorded more than 2,000 in the first quarter of fiscal year 2026. A 2025 release from the U.S. Senate Committee on the Judiciary gave a different FY2025 figure: 10,044 Amazon H-1B employee approvals. These numbers come from separate publishers and are not interchangeable; the figures should not be combined without reconciling their definitions.
Approval totals indicate the scale of a company’s H-1B activity as counted by the source. They do not, by themselves, tell readers how many people were hired in a particular job, how many remain employed, whether a role was newly created, or whether a visa holder took work from a U.S. worker. They also cannot establish what happened in any individual layoff.

How the reported layoffs fit into the story
The Associated Press reported that Amazon announced about 14,000 corporate job cuts in October 2025, followed by another 16,000 in January 2026. AP said affected U.S.-based staff would have 90 days to look for an internal role. These are announced cuts; the counts do not demonstrate that immigration policy caused them.

Layoff totals and visa approval counts measure different things. Treating their simultaneous presence as proof of replacement would go beyond what the figures establish.

Could the policy reshape the U.S. job market?
It could influence hiring and sponsorship decisions at the affected employers, but a wider labor-market effect is a forecast, not an established outcome. If employers cannot use PERM for workers covered by the action, some may reconsider how they recruit, retain or sponsor employees for permanent residence. The available reporting does not quantify how many jobs or workers would be affected, or show that employers will respond in a particular way.
There are competing policy concerns. Vice President JD Vance, quoted by Axios, said: “We want you to continue to grow and to employ a lot of people, but we want you to employ American workers.” At the same time, limits on an employer’s sponsorship options could affect workers seeking a permanent-residency route. Neither concern is evidence of a measured employment outcome.

Technology companies are also changing hiring strategies for reasons beyond immigration policy. Pareekh Jain, CEO of Pareekh Consulting, told Computerworld: “AI investments are changing company hiring strategy.” That observation supplies another possible factor in workforce decisions; it does not show that AI, visa rules or any one policy explains Amazon’s announced cuts.

The separate $100,000 H-1B fee development
The reported PERM action should not be conflated with the separate $100,000 H-1B fee. AP reported that a federal judge struck down the fee in June 2026. The available reporting does not establish the status of any subsequent appeal or stay as of October 2026, so the court ruling alone should not be treated as a complete statement of the fee’s current status.

What workers and job seekers can reasonably conclude
- For current H-1B workers: Axios’s October account says the PERM action does not suspend H-1B status or cancel existing visas. It does not replace advice about an individual visa, extension or sponsorship case.
- For workers pursuing permanent residence: Check whether the employer and PERM pathway are covered by the reported action; the effects are not established for every employer or green-card route.
- For Amazon employees and applicants: The reported layoff announcements and H-1B approval counts do not identify a causal link or prove that one group replaced another.
- For readers assessing broader job-market claims: Distinguish reported policy changes and announced cuts from predictions about future hiring. The cited reporting does not establish that the October action has reshaped the U.S. labor market.
