Allahabad High Court: U.P. Circular Requires Physical Service of GST Notices After Registration Cancellation

The Allahabad High Court set aside an ex parte GST adjudication order after a taxpayer said a show-cause notice issued after registration cancellation was sent only through the common portal. The court relied on a Uttar Pradesh Commissioner of Commercial Tax circular dated 7 May 2025, which it said required subordinate authorities to ensure physical service in adjudication proceedings initiated after cancellation. It described the circular as “founded on sound common sense.”

What happened in the case

In Mukesh Kumar Jain v. Assistant Commissioner, CGST, the petitioner said their GST registration had been cancelled on 5 September 2023. A show-cause notice followed electronically through the common portal on 25 June 2025, after the cancellation.

The petitioner said they learned of the proceedings only when recovery was pursued after an ex parte adjudication order dated 21 April 2026. An ex parte order is made without the affected party participating in the proceeding. The dispute before the court concerned the opportunity to know about and answer the notice, not a final determination of the underlying tax demand.

Why the court considered physical service important

The judgment referred to a circular issued by the Commissioner of Commercial Tax, Uttar Pradesh, on 7 May 2025. As described by the court, it instructed subordinate authorities to ensure physical service of notices in adjudication proceedings initiated after a registration had been cancelled. The court treated that instruction as binding on those subordinate authorities.

The court explained the practical concern: after cancellation, a taxpayer may not be required to use the common portal and may remain unaware of proceedings that appear there. Its words were: “The above Circular is founded on sound common sense inasmuch as once the registration of a person is cancelled, he may remain disabled and in any case he may not be obligated to work on the Common Portal, thereafter.” The judgment was authored by Justice Swarupama Chaturvedi and Justice Saumitra Dayal Singh.

That reasoning connects the method of service to a meaningful chance to participate. If a notice is placed in a portal account that the recipient may no longer be using, formal availability there may not alert them to a case moving toward an order. In this case, the court relied on the state circular and the circumstances recorded in the judgment when it intervened.

What the High Court ordered

The court set aside the adjudication order dated 21 April 2026 and restored an opportunity for the petitioner to answer the proceeding. Its directions set a timetable and identified what the authority must address before reaching a fresh decision:

  • The petitioner was permitted to file a final reply within two weeks.
  • Any request for cross-examination or for documents relied upon had to be made with that reply.
  • The authority was to consider those requests before the final hearing.
  • The date of the personal hearing had to be communicated with at least 15 days’ advance notice.
  • After the hearing, the authority was to pass an appropriate reasoned order.

Setting aside the order did not decide whether the tax demand itself was correct. The directions reopened the opportunity to respond and required the authority to proceed through the specified steps.

Does this mean every portal-only GST notice after cancellation is invalid?

No. This is an Allahabad High Court decision applying a Uttar Pradesh circular as described in the judgment. It should not be treated as a nationwide rule that every notice placed only on the common portal is automatically invalid. The decision’s significance depends on its setting: proceedings initiated after cancellation, the reported U.P. circular, the service record, and the petitioner’s opportunity to participate.

The judgment reports the circular’s purpose and effect but does not reproduce its full text. Its precise coverage, possible exceptions, and interaction with statutory service provisions therefore cannot be established from the judgment account alone. The decision also does not, by itself, establish how other High Courts have ruled or whether later decisions have refined the issue.

If you receive a demand after cancellation and did not see the notice

Act promptly. A missed portal notice does not, by itself, establish that an order will be set aside; the relevant service history, applicable law, jurisdiction and procedural stage matter. Keep the response focused on the record and preserve any time-sensitive remedies.

  1. Obtain the complete record. Collect the show-cause notice, adjudication order, portal notices and status history, any proof of physical or other service, and recovery communications. Note the dates of cancellation, notice, order and first actual awareness.
  2. Check the applicable jurisdiction and rules. Confirm where the proceedings were initiated and whether a state circular or other direction applies to that authority and those proceedings. Do not assume the U.P. circular governs a case outside its scope.
  3. Respond through the proper channel without delay. Consider getting advice from a qualified tax professional or lawyer about the available procedure, deadlines and whether to seek relief from the authority or court. The result in Mukesh Kumar Jain does not guarantee the same outcome in another case.
  4. State the service problem with evidence. Explain when and how you became aware of the proceeding, identify the service method shown in the record, and attach supporting documents. If you need relied-upon documents or seek cross-examination, make the request clearly and at the stage required by the applicable procedure.
  5. Track every next date and communication. Keep copies of replies and acknowledgements, and monitor any hearing notice or further order so that a renewed opportunity is not missed.

Before relying on the judgment in another dispute, verify the current circular, the governing statutory provisions, limitation periods, the actual service record and any subsequent authorities. The case offers a fact-specific basis for challenging an ex parte process where post-cancellation portal-only notice and the reported state instruction are relevant; it is not a substitute for checking those details.
