These are separate parts of the process—not interchangeable tools. In particular, an appraisal waiver is not a waiver of title review or title insurance, and the rules for a real estate auction depend on the state and type of sale.
What “waiver” means in mortgage valuation—and what it does not mean
In this context, a waiver usually means an appraisal waiver: a lender or mortgage program does not require a traditional appraisal for a particular transaction, subject to its eligibility and underwriting rules. It does not, by itself, waive title review, title insurance, or other settlement requirements. The Consumer Financial Protection Bureau’s overview of the Real Estate Settlement Procedures Act (RESPA) treats title insurance and settlement as parts of the mortgage process distinct from valuation.

There is also a separate meaning of waiver in federal rules about receiving copies of an appraisal or other written valuation. That is about when the borrower receives the valuation, not whether the lender requires a valuation or whether the property has a clear title.
When a creditor must provide valuation copies
Under Regulation B, for covered applications for credit secured by a first lien on a dwelling, a creditor generally must provide copies of appraisals and other written valuations promptly after they are completed or at least three business days before consummation or account opening, whichever is earlier. A borrower may waive the timing requirement under specified conditions. If the borrower waives it within three business days of consummation or account opening, the creditor may provide a revised valuation later only when the revision contains solely clerical changes and an earlier version was delivered at least three business days beforehand. These requirements are in the Consumer Financial Protection Bureau’s Regulation B, 12 CFR § 1002.14.

A separate rule applies to covered higher-priced mortgage loans: Regulation Z, 12 CFR § 1026.35(c), does not allow the Regulation B timing waiver for its appraisal-copy requirement. Whether a particular loan is covered depends on the transaction and the applicable rule.
How AI and automated property valuations fit into mortgage quality control
An automated valuation model (AVM) estimates a property’s value using data and a model. It is one kind of automated valuation technology; “AI” is not a synonym for every AVM. Nor does the existence of an AVM mean a lender has waived an appraisal requirement. Valuation method and underwriting eligibility are separate questions.
A six-agency interagency final rule sets quality-control requirements for specified AVMs used in certain credit decisions and securitization determinations involving mortgages on a consumer’s principal dwelling. It took effect on October 1, 2025. Its scope is transaction- and institution-dependent; it should not be read as a rule governing every property estimate or every AI system.

Five quality-control aims
- Confidence in estimates: controls should help ensure a high level of confidence in the estimates produced.
- Protection against manipulation: controls should guard against the data used by AVMs being manipulated.
- Conflict management: controls should help avoid conflicts of interest.
- Testing and review: controls should include random sample testing and reviews.
- Nondiscrimination: controls should help ensure compliance with applicable nondiscrimination laws.
These aims make AVM quality control broader than model accuracy alone. For a specific compliance decision, the final rule’s definitions and scope—not a general description of “AI valuation”—determine whether it applies.
Appraisal, AVM and waiver are different valuation paths
Fannie Mae disclosures show why these terms should not be collapsed into one category. A disclosure can identify a valuation method and whether an appraisal waiver was involved; later categories also distinguish waiver-plus-property-data programs. A disclosure field reports how a loan was handled. It does not establish that every borrower or property qualifies for the same option.
| Path or label | What it describes | What it does not establish |
|---|---|---|
| Appraisal | A property valuation method identified in mortgage disclosures. | The disclosure label alone does not specify all appraisal procedures or eligibility rules. |
| Automated valuation model (AVM) | An automated method for estimating property value; certain AVM uses are covered by the interagency quality-control rule. | It is not automatically an appraisal waiver, and “AI” does not identify a single model or method. |
| Appraisal waiver | A status indicating that an appraisal requirement was waived for the loan under the applicable program or process. | It does not waive title review or title insurance, or mean all borrowers and properties are eligible. |
| Waiver plus property data | A separately identified disclosure category for a waiver combined with property data. | The label alone does not describe all data collected or determine eligibility for other loans. |
Fannie Mae’s 2020 disclosure announcement defined an appraisal-waiver disclosure, and its 2023 update described separate waiver-plus-property-data categories. Those disclosures are useful for understanding reporting, not as a substitute for a lender’s eligibility decision.

What an eNote is, and what it changes
An eNote is the electronic version of the mortgage note: the borrower’s debt and promise to repay. FHFA describes an eMortgage as a loan in which the eNote is generated, presented, and signed electronically as part of an electronic closing, or eClosing. Its earlier annual-report discussion describes the eNote as created, executed, transferred, and stored electronically.

The note is not the same document as the mortgage or deed of trust. The note records the repayment obligation; the mortgage or deed of trust creates the security interest in the property. FHFA’s Your Step-by-Step Mortgage Guide puts the distinction this way: “The mortgage note is a legal document that provides evidence of your indebtedness and your formal promise to repay the mortgage loan, according to the terms you’ve agreed to.”
| Workflow | Document handling described in FHFA material | Important boundary |
|---|---|---|
| Paper closing and note | FHFA’s eMortgage material does not state a complete paper-workflow specification. | Do not infer that every non-electronic closing follows one identical process. |
| eClosing with eNote | The eNote is generated, presented, and signed electronically; FHFA also describes electronic creation, execution, transfer, and storage. | This description is not a complete account of electronic-signature law or state recording requirements. |
Electronic handling changes how the note is created and managed; it does not erase the difference between the repayment promise and the property security instrument. The applicable institution’s workflow and jurisdictional requirements still matter.

How mortgage loans become mortgage-backed securities
A mortgage may remain on a lender’s books or be sold into the secondary market. FHFA explains that Fannie Mae and Freddie Mac buy mortgages from lenders, then may hold them or package them into MBS. Selling loans can return funds to lenders for further lending. When mortgages are pooled into securities, investors receive cash flows associated with the underlying loans, subject to the security’s terms.
Portfolio lending and securitization
| Route | What happens | Why it matters |
|---|---|---|
| Held in a portfolio | The mortgage is held rather than packaged into an MBS through the described secondary-market route. | The lender retains the loan as an asset instead of using a sale into that securitization channel to replenish funds. |
| Sold and securitized | A mortgage is sold and may be pooled into an MBS. | The sale can provide lender funding for further lending; investors receive the security’s mortgage-related cash flows. |
FHFA describes the common securitization platform as supporting issuance and administration of the Enterprises’ single-family securities, including Uniform Mortgage-Backed Securities (UMBS). Mortgage disclosures can also report valuation-method information, but that reporting field does not determine whether a particular borrower or home could have received an appraisal waiver.
Historical context should not be mistaken for a current market share: an FHFA 2008 primer said MBS sales funded “three-quarters of the dollar volume of single-family loans,” compared with “three-fifths in 2001.” Those figures describe the periods named in that primer, not today’s market.

Why “real estate auction” needs a state and sale type
Auction procedures are not one national process. Foreclosure auctions, tax sales, and voluntary property auctions can have different rules, notices, payment deadlines, title consequences, and rights after sale. The topic alone does not identify a state or auction type, so it cannot support reliable step-by-step instructions or legal advice.
Before acting on an auction listing, establish both the jurisdiction and the type of sale, then verify the governing notices and requirements with the relevant local authority or a qualified real-estate professional. Do not assume that an appraisal waiver, AVM estimate, or eNote tells you what title interests or sale conditions apply to an auction property.
Mortgage literacy: documents and questions to understand
FHFA’s mortgage education resources cover shopping for a home or mortgage, understanding mortgage rules, and avoiding foreclosure. A useful first step is to identify which document or decision you are looking at rather than treating “the mortgage” as one thing.
Quick Recap
- For value: Ask whether the lender used an appraisal, an AVM, a waiver, or a waiver combined with property data, and what that means for your transaction.
- For disclosures: Distinguish the valuation-copy delivery deadline from the underlying valuation requirement.
- For repayment: Read the note to understand the debt and promise to repay; identify the mortgage or deed of trust as the separate security instrument.
- For an auction: Confirm the sale type, state, and local requirements rather than relying on a general mortgage-technology explanation.
- For a loan’s later path: Recognize that a lender may hold a mortgage or sell it into a process that includes MBS; this does not change the borrower’s original obligation by itself.
