Yes, an event may be able to use facial recognition or other AI surveillance, but it cannot treat the technology as ordinary CCTV. Passive scanning can identify people merely because they enter a camera’s field of view, create biometric templates, and reveal attendance at sensitive gatherings. Whether deployment is lawful depends on the venue’s jurisdiction, purpose, legal basis, necessity, proportionality, notice, retention, and safeguards.
Organizers should complete a current impact assessment, test the system in the actual venue, provide a genuine non-biometric option where consent is required, and ensure that a trained person reviews every alert before any denial, ejection, or report. Attendees should look beyond camera signs: ask what analytics run, who controls the data, how long it is kept, and how to challenge a match.

What counts as AI surveillance at an event?
Facial recognition analyzes facial features to create a biometric template that can identify, authenticate, verify, or categorize a person. Live facial recognition (LFR) captures people in a space and compares images with a watchlist. Retrospective facial recognition searches stored photographs or video after an incident. Both can involve personal data and, in many situations, special-category biometric data.
The same privacy questions apply to systems that do not display a person’s name. Ordinary CCTV may use machine-learning analytics to detect behavior or track movement. Other event systems include automatic number-plate recognition (ANPR), body-worn video, drones, crowd-density tools, and software that infers age, gender, race, demeanor, or other characteristics. If identifiable people are processed, surveillance rules and data-protection duties can apply.

| System | What it does | Main privacy exposure |
|---|---|---|
| Live facial recognition | Compares faces in near real time with a defined watchlist | People can be identified without a one-to-one interaction; false alerts can lead to immediate intervention |
| Retrospective matching | Searches stored images or footage for possible identities | Large-scale indexing, repeated searches, and secondary use of footage |
| CCTV analytics | Detects movement, objects, behavior, or crowd patterns | Continuous tracking and inferences beyond the original security purpose |
| ANPR | Reads vehicle plates and links them to time and location | Detailed travel and attendance histories |
| Drones or body-worn video | Captures elevated or close-range views during operations | Additional angles, audio, bystander capture, and difficult-to-control retention |
A camera labeled “security” therefore does not tell you whether the system only records video or also identifies, categorizes, or tracks people.
Why passive facial recognition is unusually intrusive
At a ticket gate, a person can choose to present a ticket or identity document. LFR reverses that relationship: the system can scan everyone in view and decide who deserves closer attention. That loss of practical anonymity is significant even when no alert is generated.
Biometric identification can reveal attendance at healthcare, religious, political, labor, support, or other sensitive events. The US Federal Trade Commission (FTC) has warned that biometric surveillance can expose such information and that large biometric databases are attractive targets for misuse. An identifiable attendance record can also create a chilling effect: people may avoid an event because they do not want their presence logged, even when they have done nothing wrong.
Function creep and secondary use
Data collected for entry security can later be reused for marketing, attendance profiling, law-enforcement requests, or development of a vendor’s models. Those uses are not automatically covered by the original security purpose. A responsible program states its purposes up front, limits sharing, and deletes data when the stated need ends.

Security and re-identification risk
Raw video, face templates, watchlists, and linked ticket records can be combined to reconstruct where people went and with whom. A password can be changed after a breach; a face cannot. Encryption, strict access controls, audit logs, vendor restrictions, and scheduled deletion are therefore core protections rather than optional technical details.
Accuracy is a safety issue, not just a performance metric
A facial-recognition alert is a probability, not proof of identity. Image resolution, lighting, camera angle, motion, masks, hats, crowd density, and occlusion all affect results. Poor-quality watchlist photographs or outdated records add another source of error.
The Information Commissioner’s Office (ICO) warns that demographic differentials can place groups at a relative disadvantage. Organizers must examine false-positive and false-negative rates, use representative test data, and address bias. There is no single accuracy number that applies to every camera, venue, crowd, or demographic group; deployment-specific testing is essential.
Recommended Free Tools
| Condition | Possible effect | Control to require |
|---|---|---|
| Low light, glare, or backlighting | More missed matches or spurious matches | Test at every entrance and time of day; improve lighting or camera placement |
| Side angles, motion, masks, hats, or hair covering | Lower image quality and unreliable comparisons | Set image-quality thresholds and route uncertain captures away from automatic action |
| Dense or fast-moving crowds | Face crops can be incomplete or associated with the wrong person | Measure performance at realistic crowd levels, not only in controlled trials |
| Uneven demographic performance | Some groups experience more false alerts or missed matches | Report subgroup results, investigate causes, and suspend use if risks are unacceptable |
| Inaccurate or stale watchlist entries | People who should not be flagged remain in the system | Document provenance, review inclusion, and remove records promptly |
Human review must be active and meaningful. Staff should inspect the source image, the reference record, context, and confidence information; they should be able to reject the alert. An operator who merely clicks “confirm” is not meaningful oversight. No one should be denied entry, ejected, or reported solely because software produced a match.

What organizers must decide before deployment
1. Define a concrete security objective
Start with the problem, not the technology. Specify whether the objective is locating a particular person under a court order, preventing ticket fraud, finding a missing child, or another narrowly defined aim. State which data and watchlist are actually needed. “Use AI to improve safety” is not a sufficiently specific purpose.
2. Test necessity and proportionality
Document why the proposed system is necessary, what measurable benefit is expected, and why less-intrusive options were rejected. Alternatives may include trained staff, ticket checks, physical barriers, bag policies, targeted cameras, or post-incident investigation. Compare options against the same objective rather than assuming facial recognition is more effective because it is newer.
3. Complete a living DPIA
The ICO treats this type of processing as high risk to information rights. A data-protection impact assessment (DPIA) should be completed before deployment and updated for each materially different venue or use. Include:
The Tool Desk
Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →- the purpose, data flows, watchlist source, and categories of people captured;
- the applicable legal basis and, where relevant, the additional condition for special-category biometric processing;
- necessity, proportionality, alternatives, expected effectiveness, and foreseeable harms;
- retention periods for raw video, face templates, alerts, and investigation files;
- vendor roles, subcontractors, cross-border transfers, access permissions, and audit rights;
- accuracy testing, demographic performance, human-review procedures, complaints, and incident response; and
- deletion verification and a schedule for reviewing whether the system remains justified.
UK organizations should map the analysis to the UK GDPR and Data Protection Act 2018, while recognizing that ICO guidance is under review following the UK Data (Use and Access) Act. US organizers must also check federal and state rules; FTC guidance and NIST frameworks are influential, but they do not replace state, country, or venue-specific legal advice.

4. Establish a lawful, informed choice
People should be told before they enter the camera zone what is operating, who controls it, the precise purposes, what data is collected, retention, sharing, rights, and a contact route. If consent is the legal basis, it must be informed and freely given. The ICO’s gym example explains that consent is not freely given when facial recognition is the only way to enter. A practical alternative is a staffed, non-biometric route that does not impose a penalty or unreasonable delay.
5. Constrain the watchlist
Use written inclusion criteria, a documented source for each record, current photographs, an expiry or review date, and a process for removing people who no longer qualify. Do not add a broad “persons of interest” category without evidence and governance. Keep the watchlist separate from marketing or general attendance databases, and prohibit vendor model training or unrelated searches unless separately justified and disclosed.
6. Measure the system in the real venue
NIST’s passive-LFR work emphasizes accuracy metrics and privacy-by-design. Test entrances, lighting conditions, crowd density, camera heights, queues, accessibility routes, and the actual watchlist. Record false-positive and false-negative results overall and by demographic group. Define a stop rule: if performance or unequal impact exceeds the organization’s risk tolerance, pause the deployment rather than lowering the human-review standard.

7. Secure, minimize, and delete
Capture the smallest amount of data needed. Prefer on-device or short-lived processing when it meets the purpose; avoid retaining identifiable footage merely because storage is inexpensive. Encrypt data in transit and at rest, restrict access by role, log every search and export, review vendor access, and test deletion. Retention should be tied to a stated purpose, not an indefinite “in case it is useful later” period.
Best Value
8. Publish accountability information
Keep the DPIA, policy, contracts, test results, training records, incident plan, and effectiveness review available for regulators and meaningful public explanation. Be able to explain how an attendee can request access, object, seek deletion where applicable, or challenge an intervention.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.What a useful event privacy notice includes
A sign at the gate should be readable before a person enters the camera area and should point to a fuller notice. It should not simply say “CCTV in use.” Include:
- the type of technology: live or retrospective facial recognition, analytics, ANPR, drones, or body-worn video;
- the controller’s name and contact details;
- the specific security or access purpose and the legal basis;
- whether biometric templates are created, what watchlist is used, and whether automated matching occurs;
- retention periods for each data type and the deletion method;
- recipients, vendors, international transfers, and any law-enforcement disclosure policy;
- the human-review process and how a person can challenge a suspected match;
- available non-biometric entry or opt-out arrangements when consent is requested; and
- rights, complaint routes, and the date of the notice.
Notice must match reality. If the operator later adds behavior analytics, expands the watchlist, or changes retention, the purpose and notice need review rather than quiet expansion.
What attendees can do before and during an event
- Read the entrance sign and privacy notice before entering the camera zone. Note the operator, date, technology, purpose, retention, and contact details.
- Ask precise questions. Is facial recognition or another biometric analytic active? Is it live or retrospective? Who controls the data? Is footage shared, and when is it deleted?
- Request a genuine alternative. If consent is requested, ask for staffed or ticket-based entry without biometric scanning. A meaningful alternative should not require surrendering an essential service or accepting unreasonable delay.
- Ask how alerts are reviewed. Find out whether a trained person checks the image and how you can correct or challenge an error.
- Do not assume “CCTV only” means recording only. Ask whether software infers age, gender, race, demeanor, movement, or identity.
- Keep a record if you may exercise rights. Save the notice, operator name, event date, and any correspondence. Depending on local law, you may be able to request access, deletion, objection, or an explanation, or complain to a data-protection regulator.
How to compare surveillance options responsibly
An organizer’s procurement or governance review should score each option against the same criteria:
| Decision area | Questions to answer |
|---|---|
| Security objective | What specific threat is addressed, and what outcome will demonstrate effectiveness? |
| Intrusiveness and rights | Does the option identify everyone, track movement, or infer sensitive traits? |
| Lawful basis and choice | What legal basis applies, and can people use the service without biometric processing? |
| Accuracy and fairness | What are false-positive and false-negative rates in this venue and across relevant demographic groups? |
| Human oversight | Can trained staff override alerts, and is automatic denial prohibited? |
| Data minimization | Can the system work with less footage, fewer fields, local processing, or a smaller watchlist? |
| Retention and sharing | When are templates, footage, and alerts deleted, and who can access them? |
| Vendor and breach exposure | Are subcontracting, model training, audits, incident notification, and deletion enforceable in the contract? |
| Cost and effectiveness | What is the total operational cost, and is the measurable benefit greater than a less-intrusive alternative? |
The bottom line for trust and safety
Facial recognition and related analytics can be justified only for a specific, evidenced purpose with safeguards that match the risk. The ICO states that, across sectors, processing resulting from facial-recognition deployment is likely to create a high risk to people’s information rights. FTC consumer-protection guidance similarly emphasizes privacy by design, meaningful choice, transparency, security, and disposal. For attendees, clear notice and a real alternative are the minimum signs of responsible deployment. For organizers, a current DPIA, venue-specific testing, narrow watchlists, active human review, strict retention, and auditable accountability are the conditions that make any use defensible.
