AI Patent Review: Verify Claims, Ownership, and Product Fit

An “AI patent” label says little about what a patent protects or whether it is a sound asset. For U.S. diligence, start with the granted claims and file history, then test inventorship, patentability, title, term, and fit with the product or transaction. AI assistance does not create a separate shortcut to inventorship or patent eligibility.

What makes a patent “AI-related” is not what makes it valuable

A patent may concern a machine-learning model, training method, data structure, computing system, or an application of AI in another technical field. But its practical reach depends on the claims: the numbered statements that define the legal scope being asserted. A title, abstract, product description, or reference to a particular model type is not a substitute for reading those claims.

For a buyer, investor, founder, or counsel, the central question is whether the claims cover something relevant to the business and whether the records support relying on that coverage. A patent grant alone does not establish market value, freedom to operate, or the outcome of a validity challenge.

Which legal tests apply to AI-related patents?

Eligibility turns on the claimed subject matter and its application

The USPTO’s July 16, 2024 subject-matter-eligibility update, effective July 17, 2024, applies the general eligibility framework to AI claims. A key issue can be whether a claim that recites an abstract idea integrates it into a practical application—for example, by improving computer functionality, another technology, or a technical field. Merely using AI or naming a model does not establish eligibility; nor does an AI-related claim automatically fail. The analysis is specific to the claim and its context.

A December 5, 2025 USPTO eligibility update tells examiners to evaluate the claim as a whole and consider improvements described in the record, including improvements to technology, computer functionality, data structures, learning models, and applied fields. In diligence, compare the asserted improvement with what the claims actually require. A promising explanation in the specification matters differently from a limitation present in an independent claim.

Only a natural person can be named as an inventor

On November 26, 2025, the USPTO announced revised inventorship guidance and rescinded its February 2024 AI-specific guidance in its entirety. The current standard is the same whether or not AI assisted: AI systems are tools, not inventors, and only natural persons can properly be named as inventors. Do not apply the rescinded guidance’s separate “significant contribution” framing as a current AI-specific test.

The USPTO’s inventorship FAQs, last updated January 16, 2025, explain that existing inventorship law applies regardless of technology, with no new heightened standard and no additional general duty to disclose AI use. Existing disclosure duties still apply. The Office generally presumes that named inventors are actual inventors; that does not replace a buyer’s need to examine inventorship support when it is material to the deal.

Eligibility is one requirement, not the whole patentability review

AI-assisted inventions must also meet requirements such as novelty and nonobviousness. The USPTO’s examination guidance describes prior-art searching before patentability evaluation. A grant therefore does not answer every diligence question: review the cited references and prosecution history to understand what was claimed, what the examiner challenged, and what the applicant changed or argued in response.

How to conduct a U.S. AI patent diligence review

  1. Identify the assets and the claims that matter

Collect the patent and application numbers, identify each family member and jurisdiction, and check current status. Read the independent claims first, then the dependent claims that may add narrower requirements. Map relevant claim limitations to the product, process, or planned transaction; do not infer coverage from a shared use of AI terminology. Include continuations and related filings, since they may have different claims or status.

  2. Test the claimed technical improvement

Compare the improvement described in the specification with the limitations in the claims. Ask what the claimed system must do, how it does it, and what technical result the record says follows. Then assess whether the claims integrate any abstract idea into a practical application under the applicable eligibility framework. A broad statement that a model is faster, more accurate, or useful is not enough by itself to establish that a particular claim is eligible or valuable.

  3. Verify inventorship against the invention record

Check the named inventors and, where the issue is material, compare their roles with the conception and development records available for the claimed subject matter. Relevant material may include invention disclosures, dated technical records, and prosecution documents. The practical question is whether the people named can be supported as the human inventors under the applicable standard—not whether an AI system participated. Do not assume that a patent examiner routinely investigates AI use.

  4. Read the prior art and prosecution history

Review cited references, office actions, applicant responses, claim amendments, and the claims as granted. Track which limitations survived and what distinctions the applicant relied on. This can reveal how the patent was examined and where its scope may be constrained. The general USPTO examination materials support prior-art review, but they do not establish the validity or enforceability of any particular patent.

  5. Establish title and check related rights

Reconcile the inventors, executed assignment instruments, employer or contractor obligations to assign, recorded ownership, and relevant encumbrances. A company’s product description or project history is not proof that it owns the patent, and recordation alone should not be treated as a complete answer to title. The USPTO’s Manual of Patent Examining Procedure addresses ownership and assignment; its prior-art provisions also discuss circumstances in which common ownership or an obligation of assignment may affect the treatment of certain references.

Keep ownership separate from permission to operate. A patent grants rights in the claimed invention; it does not itself grant permission to use someone else’s patented invention. If the target technology depends on other patent rights, assess freedom to operate separately from whether the target patent appears patentable.

  6. Calculate remaining term and verify maintenance

A U.S. utility patent generally runs for 20 years from the relevant filing date, subject to patent-term adjustments, extensions, disclaimers, and the details of the filing history. Do not estimate remaining life from the grant date alone. Under MPEP § 2504, utility patents based on applications filed on or after December 12, 1980 generally require maintenance fees; plant and design patents are exceptions to that maintenance-fee rule. Check actual dates, fee status, and any applicable term adjustment, extension, or disclaimer for each patent.

  7. Keep the U.S. review distinct from foreign rights

This framework is U.S.-focused. For a family with filings elsewhere, identify the status and claims in each relevant jurisdiction and apply the rules that govern there; U.S. standards should not be assumed to control foreign filings.

How to compare multiple AI-related patent assets

Use the same questions for each asset, then weight the answers against the business purpose and transaction. The USPTO materials do not prescribe a universal valuation formula or a way to infer market value from an AI label.

Comparison axis What to examine
Claim scope and product fit Independent-claim limitations, relevant dependent claims, and the relationship between those limitations and the product or process.
Eligibility and technical improvement The claimed application and the evidence in the specification for the asserted technical improvement.
Prior art and prosecution Cited references, examination challenges, amendments, applicant arguments, and the claims that issued.
Human inventorship Named inventors and supporting records for the claimed invention, where material to the transaction.
Ownership and assignment Executed assignments, obligations to assign, current ownership records, and relevant encumbrances.
Term, maintenance, and geography Actual filing history, remaining term, fee status, and protection in each relevant jurisdiction.

A strong showing on one axis does not cure a weakness on another. For example, broad product relevance does not establish clean title, and a clear chain of title does not establish that a claim is eligible or covers the product.

What the available rules cannot tell you

USPTO guidance and the MPEP explain legal standards and examination procedures; they do not determine the validity, ownership, enforceability, remaining term, freedom to operate, or market value of a specific asset. Those questions depend on patent numbers, jurisdictions, current status, file records, transaction documents, and product facts. The USPTO’s online MPEP page also notes that its printed current edition does not incorporate all later policy changes, so later notices and memoranda should be checked alongside the manual.

For context, Kathi Vidal, then Under Secretary of Commerce for Intellectual Property and USPTO Director, wrote in a February 12, 2024 USPTO blog post: “The right balance must be struck between awarding patent protection to promote human ingenuity and investment for AI-assisted inventions while not unnecessarily locking up innovation for future developments.” That is a historical policy statement, not the operative November 2025 inventorship announcement.
