AI Music Rights Are Advancing, but the Rules Still Lag

Music rights are adapting to artificial intelligence, but they have not caught up with it in a settled, comprehensive way. Licensing negotiations and new licensed-AI initiatives are under way, while key questions about training, generated tracks, voice imitation and payment remain unsettled. The answer depends on the country and on which rights and uses are involved; there is no single “music right” or one rule that resolves them all.

Why music rights do not reduce to one permission

A song and a recording of that song are separate works. The composition includes elements such as melody and lyrics; the sound recording is a particular recorded performance. Different people or companies may control each. A model trained on recordings can therefore raise questions involving more than one set of rights.

Other interests may matter too. A recognizable imitation of a performer’s voice can raise issues distinct from copyright in the recording, including questions about identity, performer rights, contracts or consumer protection. Copyright alone does not settle those questions, and the applicable rules can vary by jurisdiction.

Training a model and copyrighting its output are different questions

Can an AI music generator use copyrighted music to train?

That depends on the law that applies, the material copied, the way it is used and whether permission or a relevant exception covers the use. In the United States, the Copyright Office’s Part 3 report examines copying during AI development, fair use and licensing. It is an analysis of the issues, not a court ruling that all training is lawful or unlawful. The Office says courts and policymakers are still at an early stage and recommends letting licensing markets develop for now, with the possibility of targeted intervention if specific market failures emerge. Read the Copyright Office’s Part 3 report.

The Office’s AI initiative began in 2023 and received more than 10,000 comments by December of that year. That number reflects the scale of the proceeding, not public consensus or the number of music-specific submissions. The Office’s status page labels Part 3 a pre-publication version released on May 9, 2025, and says a final version will be published in the future. Check the Copyright Office’s AI report status and timeline.

Who owns AI-generated music, and can it be copyrighted?

In the United States, the Copyright Office says protection depends on whether a human determined sufficient expressive elements in the work. Human-authored material that appears in the output, or a person’s creative arrangement or meaningful modification, may support protection depending on the facts. Merely entering prompts is not enough under the Office’s stated approach. Using AI as an aid does not automatically prevent copyright in a work a person created. Whether a particular track qualifies depends on the human contribution and the work itself. See the Copyright Office’s Part 2 report on copyrightability.

That output question is separate from whether the model’s training used protected material with permission. A human’s contribution to a new track does not, by itself, answer whether the training process was authorized; likewise, a training license does not automatically determine who can claim copyright in a generated result.

What licensing deals show—and what they do not

The Copyright Office’s Part 3 report records that developers have licensed copyrighted works in areas including music and vocal recordings. It also describes the counterargument: voluntary licensing may not provide every developer with the quantity, diversity or type of data sought. The Office’s conclusion is cautious: licensing activity is growing, but its existence does not establish that licensing can meet every training need at scale.

Company announcements illustrate the direction of negotiations. Universal Music Group announced strategic agreements with Udio concerning a new licensed AI music creation platform. Warner Music Group separately announced a collaboration with Udio and a partnership with Suno. These announcements show commercial initiatives, not that every artist or work is covered, that every relevant right has been cleared, or that a service has launched with final terms. Universal Music Group’s Udio announcement, Warner Music Group’s Udio announcement and Warner Music Group’s Suno announcement describe the companies’ respective initiatives.

A license is only as useful to creators as its terms and administration. To assess a proposed arrangement, look for clarity on which compositions, recordings, performers, territories and uses are covered; who can authorize use or set conditions; how compensation is calculated and distributed; what training and usage information is reported; and whether creators can identify when their work or performance is involved. Scale matters too: a system that does not reach independent creators or substantial parts of a catalog may leave gaps. These are practical evaluation questions, not a claim that any announced deal answers them all.

Why the Music Modernization Act does not license AI training

The U.S. Music Modernization Act offers an example of rights administration adapting to digital music, but it addresses a narrower use. Its Title I blanket license, administered by the Mechanical Licensing Collective (MLC), covers certain digital mechanical royalties for musical works. The U.S. Copyright Office says songwriters and publishers must register with the MLC to receive covered royalties through the system. The license is not a general permission to use compositions or sound recordings to train AI models. See the Copyright Office’s Music Modernization FAQ.

That distinction matters because collecting a royalty for a covered digital music use and getting authorization to copy material for model development are different tasks. Existing royalty infrastructure does not automatically resolve the training-permission question, provide transparency about training inputs or decide how AI-related payments should be distributed.

What the global picture can—and cannot—establish

The U.S. Copyright Office’s reports provide a substantial account of U.S. policy analysis, not a universal rule for music AI. Elsewhere, the policy process is also active: the UK government published a report and impact assessment on copyright and AI on March 18, 2026. The publication establishes that the issue is under consideration there; it does not, on its own, establish the report’s legal conclusions or make them comparable to U.S. rules. View the UK report and impact assessment publication record.

The Copyright Office says it will continue monitoring changing technology, markets and law. That matters because the practical answer can change with legislation, court decisions, negotiated permissions and the details of a model’s development or a platform’s terms. A U.S. analysis should not be treated as legal advice for another country.

A practical way to evaluate an AI music use

For a creator, platform, rights holder or listener trying to understand a particular AI music service, work through these questions rather than relying on a blanket claim that AI music is either “licensed” or “unlicensed”:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. What material was used? Distinguish compositions, specific recordings and performances; identify whether the question concerns training, an output, distribution or more than one of these.
  2. Whose rights may be involved? Check who controls the composition and recording, and whether performer, voice or contractual interests are relevant.
  3. What permission covers this use? Ask whether a specific license, applicable legal exception or other authorization covers the material, activity, territory and relevant rights. Do not assume a digital mechanical royalty arrangement is an AI-training license.
  4. What does the permission say about control and payment? Look for who can authorize use, whether conditions or opt-outs apply, how payments are calculated and allocated, and what reporting creators receive.
  5. Can creators trace and verify use? Ask whether the service provides meaningful information about inputs, outputs and usage, and whether it can identify works or performances involved.
  6. What human contribution is present in the output? For a U.S. copyrightability question, distinguish prompting from human-authored material, creative arrangement or meaningful modification; the individual work’s facts matter.

These questions expose the central gap: negotiations and royalty systems can adapt, but coverage, consent, attribution, payment and legal certainty still need to work together. The U.S. Copyright Office’s 2025 training analysis and its announced licensing initiatives show movement, not a final settlement across rights, markets or countries.
