AI memorial chatbots are not one technology. Some search a library of answers that a person recorded while alive; others generate new text or speech that only simulates how that person might respond. That difference determines what can be verified, what data is processed, and how difficult it may be to withdraw or retire the representation.
The safest comparison starts with governance rather than realism: documented consent from the person represented and the people who will interact, strict access controls, a voice-clone policy you can understand, usable exports of original files, deletion that includes derived models, and a plan for closure if the provider disappears. Provider privacy policies describe their own practices; they are not independent audits. No source reviewed establishes that memorial chatbots improve or worsen grief clinically.

What an AI memorial chatbot actually is
The label covers several distinct formats. Treating them as interchangeable can lead families to assume that every answer came from the deceased person or that every service offers the same controls.
Prerecorded interview archives
The Associated Press described StoryFile as a system that matches a visitor’s question to a relevant prerecorded video response. The person’s words, facial expressions and voice in the returned clip were actually recorded. The system is selecting and presenting an archive, not inventing a new sentence. Its main risks concern who can access the recordings, how they are stored and whether the family can retrieve the source videos.

Life-story avatars built from prompts and stories
AP described HereAfter AI’s product as a “Life Story Avatar” created from prompts or personal stories. A service in this category may organize memories into a conversational interface and may generate responses from supplied material. Ask which parts are direct recordings, which are transcriptions and which are newly generated text or speech. A polished avatar is not proof that every statement reflects an event the person documented.
Text-based generative simulations
AP described Project December as a text conversation simulated from a questionnaire. A generative model can produce an answer that was never written or spoken by the represented person. That makes disclosure essential: the interface should clearly label generated responses, identify the material used to create the profile and explain that the output can be wrong or inconsistent.
Consent-first personas created during life
Afterlife AI describes a “consent-first” digital persona that an adult creates while alive and configures for designated contacts after death. Its published FAQ says a user can delete individual recordings, messages or the entire persona. Those are company statements, surfaced as published in June 2026; check the live terms and controls before relying on them.
How to compare privacy and consent
Consent is more than permission to upload photographs. A defensible policy identifies the person represented, the person who creates the profile, and the people who will later interact with it. The 2024 paper by Tomasz Hollanek and Katarzyna Nowaczyk-Basińska recommends mutual consent by data donors and service interactants, adult-only access and sensitive procedures for retiring a “deadbot.”

As Tomasz Hollanek told the University of Cambridge on May 9, 2024: “It is vital that digital afterlife services consider the rights and consent not just of those they recreate, but those who will have to interact with the simulations.” A service that obtains a recording from one relative but gives an unlimited audience access has not addressed that second obligation.
Questions to ask before creating a profile
- Did the represented person authorize posthumous use, and is that authorization recorded in a form the family can retain?
- Who is allowed to create a profile for someone who cannot consent, and what evidence of authority is required?
- Are future interactants warned that they are speaking with a simulation and offered a way to decline or leave?
- Can a person withdraw consent before death, and can an authorized representative do so afterward?
- Does the service restrict use to adults, or can a child be invited without a separate guardian process?
What data is collected and who processes it?
Request a data map, not just a short privacy summary. It should list text prompts, photographs, video, audio recordings, transcripts, chat histories, account information, device logs and any inferred profile. It should also identify vendors that provide cloud hosting, transcription, moderation, analytics or voice synthesis.
Model-training language needs precision
“Not used for training” can mean that a provider will not train its general-purpose model, while a processor may still retain data for abuse monitoring, debugging or backups. Ask whether uploaded material is used to improve a service-specific model, how long copies remain in disaster-recovery systems and whether employees or contractors can review conversations.

Look for retention periods for originals and derived data. A deletion request should address the source recording, transcript, embeddings, profile data, generated voice and conversation logs separately. If the policy says data may be retained to meet legal obligations, it should explain what remains, for how long and whether it remains available to the model.

Voice cloning: permissions, limits and deletion
A voice clone deserves its own consent and control path. A recording supplied to identify a memory is not automatically permission to synthesize unlimited new speech in that person’s voice.
Safeguards to verify
- Opt-in creation: Voice synthesis should require a separate, affirmative choice rather than being enabled by uploading audio.
- Purpose limitation: The policy should say whether the clone is confined to the memorial, can be used in other products or can be downloaded.
- Access controls: Determine which invited accounts can hear generated speech and whether links can be forwarded or embedded elsewhere.
- Withdrawal: Ask how consent is revoked and whether generated files, cached audio and provider backups are removed.
- Portability: Check whether the family receives the original recordings and a usable export of generated material, or only an account-dependent playback feature.
Example: Afterglow OS policy
Afterglow OS’s privacy policy, last updated April 2026, says voice samples are sent to ElevenLabs to create a voice clone within the memorial. The same policy says users can download memorial data, permanently delete the memorial and its associated clone, and restrict access through a Family Circle. These are the provider’s stated controls, not an independent verification and not evidence that other services offer the same protections. Confirm the current policy, the processor’s role and the exact export format before uploading irreplaceable recordings.
Who can access the memorial?
Access should be explicit, revocable and granular. A useful design distinguishes the account owner, administrators, invited family members, approved caregivers and any service staff. It should show who can add memories, change permissions, download files, invite others or delete the persona.

- Use individual accounts rather than a shared password.
- Require multifactor authentication for administrators and anyone who can export or delete data.
- Set invitations to expire and provide a visible revocation control.
- Separate permission to view original recordings from permission to converse with a generated model.
- Record an audit history for invitations, exports, profile edits and deletion requests.
- Provide a process for removing an invitee who is no longer authorized.
Ask whether a visitor can save a copy of a generated answer, screen-record a video or share a public link. Technical access restrictions cannot prevent every personal copy, so the service should state what it can and cannot control.

Can my family export the recordings?
Exportability is a continuity requirement, not a convenience feature. Before creating a memorial, obtain written answers about whether the family can download original audio, video and photographs at full quality, along with transcripts, captions, metadata and conversation history. A proprietary profile or model may not be portable even when the source files are.
What a practical export should contain
- Original recordings in a common, unencrypted format that ordinary software can open.
- Original photographs and documents at their uploaded resolution.
- Transcripts with timestamps and, where available, speaker labels.
- A machine-readable conversation export that preserves dates and participants.
- A manifest describing file names, creation dates, consent settings and any known transformations.
Download a test export soon after setup. Open it on a separate device, verify that files play correctly and store a second copy controlled by the family. Do not assume that an export button includes data held by a voice or transcription processor.

Ask for deletion at three levels: one item, one derivative and the complete memorial. “Delete the recording” may leave a transcript, embedding or synthesized voice behind unless the policy connects those objects.
Deletion questions to put in writing
- Can an administrator delete one recording or message without destroying the rest of the memorial?
- Does deleting source audio also delete its transcript, embeddings and generated voice?
- What happens to conversation logs, cached media and backups?
- How long does the provider take to complete deletion, and is a completion notice supplied?
- Can a processor retain a copy for security or legal reasons?
- After full deletion, can the same voice or profile be recreated from provider-held material?
Save the provider’s confirmation and your own export before requesting irreversible deletion. If a family member wants to stop interacting but others want to continue, look for a personal opt-out or account-level mute rather than deleting the shared memorial.
What happens if the company shuts down?
Continuity is often the least documented risk. A third-party review of five services reported finding no public documentation that covered all of these issues: continuity after company failure, an obligation to return raw source materials, transfer or sale of data in bankruptcy or acquisition, ownership of a model based on an individual’s data, and escrow guaranteeing access. The reviewer recommends obtaining export terms in writing and keeping original recordings in family-controlled storage.
Questions about subscriptions and acquisitions
- Can a memorial remain viewable after a subscription ends, and for how long?
- Will the provider give advance notice of a shutdown, price change or change in ownership?
- What happens to data in a bankruptcy, asset sale or acquisition?
- Can the family retrieve originals in a usable format before service termination?
- Is a service-specific model transferable, or will only source files be returned?
- Is there a named contact or legal entity responsible for handling closure requests?
Keep the family’s master archive outside the service. A local copy does not preserve the provider’s conversational model, but it prevents the permanent loss of the recordings from which the memorial was made.

These descriptions identify formats, not a ranking. A prerecorded archive may offer stronger provenance for each statement, while a generative simulation may provide a more fluid conversation but requires stricter disclosure and model controls.

- Write the consent record. Record who authorized the memorial, what media may be used, whether voice synthesis is allowed and who may interact.
- Inventory the material. Separate originals, edited clips, transcripts, photographs and sensitive documents. Mark material that should never be uploaded.
- Read the current privacy policy and terms. Note retention, processors, training language, account closure, deletion and changes to ownership.
- Configure the smallest audience. Invite named adults, use multifactor authentication and disable public links or downloads unless needed.
- Test provenance. Ask questions whose answers are documented in the source archive. Check whether the interface identifies a recording, transcript or generated response.
- Test controls before adding more data. Export a sample, revoke a test invitation and delete a nonessential recording. Confirm what disappears.
- Schedule a governance review. Recheck permissions, billing, policy changes and export health at least annually or after a provider acquisition.
- Write a retirement plan. Decide who can pause interactions, how users will be notified and what closure message or archive will remain if the memorial ends.
Wellbeing, grief and responsible use
There is no reliable clinical evidence in the sources reviewed here establishing that memorial chatbots improve or worsen grief. Cristina Voinea’s 2024 article in Think examines whether griefbots could aid or complicate grieving through philosophical analysis; it is not a clinical efficacy study.
Design choices can still reduce avoidable harm. Make the simulation unmistakably artificial, avoid claims that it is conscious or continuing a relationship, allow adult-only access and provide a simple way to stop receiving messages. Hollanek and Nowaczyk-Basińska specifically discuss opt-out protocols that let users end relationships with deadbots while receiving emotional closure.
A memorial chatbot should not replace qualified grief care. Anyone experiencing persistent distress, inability to function, or thoughts of self-harm should seek a licensed mental-health professional or local crisis service. Families can also agree in advance that the bot will not give medical, legal or financial advice and that sensitive conversations will be redirected to a human.
Choosing controls over realism
There is no universal “best” memorial chatbot. Choose a prerecorded archive when verifiable recordings and straightforward provenance matter most. Consider a generative system only when every participant understands that it can invent language and the provider offers strong consent, access, export and deletion controls. A convincing voice is not a substitute for documented authority, a family-held archive or a credible shutdown plan.
