AI governance is the set of responsibilities, checks and review processes a business uses to make sure AI is chosen and used appropriately. Before adopting a tool, decide who is accountable, what the AI will do, what data it will handle, who could be affected and how a person will check its work. Australian Government guidance offers a foundations track for organisations starting out or using AI in lower-risk ways, and a more detailed implementation track for complex or higher-risk use. Privacy obligations also matter when personal information appears in prompts or outputs.

What AI governance means for a business

AI governance is not a certificate or a one-time approval. It is the practical system for making decisions about AI: who may use it, for what purpose, with what information, under whose oversight, and how the business will respond when the tool makes a mistake or circumstances change. It applies to purchased tools as well as systems a business builds or customises.

The National AI Centre’s Essential AI Practices provide the Australian Government’s guidance for responsible AI use. The government announced its six-practice Guidance for AI Adoption in October 2025 as an evolution of the earlier Voluntary AI Safety Standard. The Centre presents separate foundations and implementation guidance so organisations can start with controls proportionate to their maturity, use cases and risk profile rather than treating every AI tool as equally consequential.

The starting point is accountability. As business.gov.au puts it, “Your business is responsible for everything your AI tools do.” Buying a product from a supplier does not transfer responsibility for how your organisation deploys it, what information staff enter, or how people act on its output.

Choose the right guidance track

The two tracks are complementary, not competing standards. Foundations is a sensible starting reference for an organisation new to AI or using a standard tool in a comparatively low-risk way. Implementation guidance is intended for teams building or customising systems, using AI in more complex ways, or managing higher-risk applications. The nature and consequences of the use matter more than whether a tool is marketed as “AI.”

Decision factor Foundations track Implementation track
Typical situation Early-stage use, or a standard tool used in a lower-risk way. Building or customising a system, complex use, or higher-risk use.
Key question Can the organisation establish basic accountability, appropriate use and proportionate controls? What stronger governance, testing, monitoring, oversight and supplier controls are needed?
Risk considerations Consider the purpose, data, people affected and possible consequences of error. Examine those factors in greater depth, including system behaviour, oversight and supply-chain responsibilities.
How to use it Use it as a practical starting point and adapt it to the organisation’s size and risk profile. Use it to develop more rigorous controls for complexity and potential harm.

These descriptions are a way to select a starting point, not a formal risk classification or guarantee that a particular use is safe. A seemingly ordinary tool can become consequential if its output drives decisions about people, money, safety or access to services. Conversely, a business does not automatically need a large specialist AI office just because it uses AI: the foundations guidance explicitly supports adapting practices to organisational size and risk.

Read the current Essential AI Practices, then consult the foundations guidance or implementation guidance as appropriate. Guidance pages can be updated; check their current versions when using them to set internal policy.

Set up governance before staff adopt tools

A lightweight process can cover the important decisions without slowing every experiment into a major project. The following sequence turns the guidance into an operating routine. Assign owners and records first, then assess each specific use and set controls before it reaches routine use.

  1. Name an accountable owner. A senior leader should own the organisation’s overall approach and escalation route. Assign operational responsibilities to the teams that choose, procure, build, configure and use AI. Staff need to know who can approve a new use, who handles incidents and who can pause a tool when its behaviour is concerning.
  2. Keep an AI register. Record the tools and use cases the organisation knows about. Include the purpose, business owner, vendor, data involved, people potentially affected, and a review date. The business.gov.au announcement of 23 October 2025 says the guidance includes an AI register template. A register is useful only if teams keep it current and staff have a straightforward way to disclose new uses.
  3. Assess each use case, not just the product. Write down what the AI is expected to do and what decisions or actions may follow. Consider who could be affected, the seriousness of a wrong or biased result, whether a person can meaningfully review or challenge it, and what happens if the system is unavailable or fails. A writing aid used to brainstorm internal copy and an automated system influencing a consequential decision should not receive identical controls.
  4. Check data and privacy before use. Identify what staff might enter, whether it includes personal information, and how the provider collects, uses, stores or shares prompts and generated content. Consider who may access that information and whether the intended use is compatible with the organisation’s privacy obligations. Do not assume that deleting a conversation from a user interface answers every question about the provider’s handling of data.
  5. Define human oversight and transparency. Specify when staff must verify outputs, which decisions require a qualified person, when an issue must be escalated, and whether customers or other users should be told that AI is involved. Oversight should be real: the reviewer needs enough context, competence and authority to reject or correct an output rather than simply approving it by default.
  6. Review and improve controls. Set a review date and revisit the assessment if the model, supplier, data, purpose or affected population changes. For complex or higher-risk use, increase the depth of testing and monitoring, clarify accountability and examine supplier and supply-chain controls. Capture incidents and near misses so the business can improve its approach rather than treating each error as an isolated surprise.

Assess risk in the context of the use

A product label alone does not tell you how much governance a deployment needs. Consider both the possibility of something going wrong and the likely consequences. A tool that drafts text for an employee to review may need a different level of control from one whose output is used to determine eligibility, allocate work or communicate directly with a customer. These are illustrative distinctions; the business must assess its own context.

  • Purpose: Is the system helping a person, producing material for review, or influencing an operational decision?
  • People affected: Who could be disadvantaged by an inaccurate, incomplete or inappropriate output? Can they question or correct it?
  • Data: Does the use involve personal, sensitive or confidential information? What data is sent to a provider and what appears in generated results?
  • Consequences of error: Could an error cause inconvenience, financial loss, unfair treatment, safety concerns or another significant impact?
  • Human intervention: Can a suitable person check the result before it is acted on, and do they have the authority and time to intervene?
  • Failure and change: What is the fallback if the tool is unavailable or produces unreliable results? What changes would require a new assessment?

Use the answers to decide what approval, testing, monitoring, staff instruction and escalation are appropriate. The more consequential the use and the harder it is for a person to detect or reverse an error, the stronger the case for the implementation track and more rigorous controls. Do not treat this as a substitute for legal, sector-specific or technical assessment where those are needed.

Protect personal information and check commercial products

The Office of the Australian Information Commissioner (OAIC) says privacy obligations apply to personal information entered into AI as well as to AI-generated output that contains personal information. That makes both sides of an interaction relevant: a prompt may expose information, and an answer may reproduce or infer information about a person.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The OAIC’s guidance on privacy and commercially available AI products was published on 21 October 2024 and updated on 17 January 2025. It advises organisations to conduct due diligence on whether a product is suitable for its intended use. Its listed considerations include whether the product has been tested for that use, how human oversight can be embedded, potential privacy and security risks, and who can access personal information entered or generated. It also recommends providing clear information about AI use in privacy policies and notices.

Before approving a commercial product or new use, obtain enough information to answer these questions:

  • What information will staff enter, and can the task be completed without personal or confidential details?
  • How does the provider use input and output data, and who can access it?
  • Has the product been tested for the intended task and operating context?
  • How will staff check outputs, correct errors and escalate concerns?
  • What privacy and security risks are relevant to this particular deployment?
  • Do privacy policies or notices need to explain the organisation’s use of AI?

If a supplier cannot answer material questions about data access, product suitability or oversight, pause the proposed use or seek further advice rather than treating silence as assurance. The OAIC document focuses on Privacy Act compliance; it is not a complete account of every law or regulatory regime that might apply. Whether the Privacy Act applies depends on the organisation and circumstances, and other obligations may be relevant. Consult current OAIC material and qualified advisers for the specific situation.

Make oversight meaningful in daily work

A written policy has little effect if staff cannot tell what it requires while using a tool. Translate governance into clear work instructions: approved purposes, prohibited or restricted data, verification expectations and a route for questions or incidents. Give workers examples drawn from their roles, and make clear that fluent or confident wording is not proof that an AI answer is accurate.

For each approved use, define what “checked” means. It might require validating factual claims against a trusted source, confirming calculations independently, or having a qualified person review a recommendation before it affects someone. The level of verification should follow the potential impact and the limits of the system, not an assumption that a human review is automatically effective.

Transparency also needs to match the interaction. The OAIC advises clear and transparent information about AI use, including identifying public-facing AI tools such as chatbots. Decide how a customer can recognise an AI interaction, how they can reach a person when needed, and how staff should respond if the system cannot answer safely or accurately.

Monitor use and respond when something changes

Governance should continue after approval. A system’s behaviour, its supplier’s terms, the information processed or the business purpose may change. Establish a practical review trigger for changes to the model or vendor, a new data source, a new group of affected people, a change in how outputs are used, or a pattern of errors. Record the decision to continue, amend or stop the use.

For complex or higher-risk applications, the National AI Centre’s implementation guidance calls for stronger testing, monitoring, oversight and supply-chain accountability. That means considering not only the model but also the components, services and suppliers on which the system depends. The precise controls depend on the deployment; the guidance does not make every low-risk use subject to the same testing regime.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When an output causes concern, staff need a clear route to report it and an owner empowered to act. Depending on the use, a response may involve stopping reliance on an output, correcting a record or communication, informing affected decision-makers, or reassessing the system before further use. Keep enough information about the use and the incident to understand what occurred and decide whether existing controls were adequate.

Keep the process proportionate and usable

Small organisations can often begin with a named owner, a simple register, a short assessment for each use, clear staff instructions and scheduled reviews. More complex or consequential deployments may require deeper technical testing, formal approval, specialist advice and closer supplier oversight. This is not a fixed maturity ladder: a small organisation can have a high-risk use, and a large organisation can have a low-risk one.

A practical governance system should help people make consistent choices, not merely produce paperwork. If teams cannot identify an approved purpose, understand the data conditions or tell who is accountable, the control is not yet operational. Start with the decisions that materially affect risk, document them in a way staff can follow, and increase the rigour when the use or consequences justify it.
